457 Visa will be abolished and replaced with 2 new visas

The Government is axing the 457 visa class and replacing it two new visas.

This includes a two-year visa — which can be renewed for another two years — and a four-year visa targeted at specific high-level skills.

Both visas demand at least two years of relevant work experience, something not required under the 457 scheme, while the longer visa calls for higher standards of English proficiency.

Applicants must also complete a criminal history check instead of the self-declaration under the now-abolished scheme.

There are also changes to the permanent residency arrangements under the new scheme — previously, 457 visa holders could be eligible for permanent residency after two years.

There is no residency pathway under the new two-year visa, while four-year visa holders will see the permanent residence eligibility period extended from two to three years.

Who will be affected?

More than 200 jobs have been cut from the list of occupations that foreign workers can apply for under the new scheme.

    On 18 April 2017, the Government announced that the Temporary Work (Skilled) visa (subclass 457 visa) will be abolished and replaced with the completely new Temporary Skill Shortage (TSS) visa in March 2018.

    medyo naguluhan ako. kung iaabolish na sya by today. bakit may 1 year gap pa sa implementation ng bagong TSS Visa? puwede ka pa din ba mag-aaply ng 457 Visa kahit after today?

    here a summary from my friend in AECC Global about the changes.

    To all my friends who have been messaging and calling about the Australian government's announcement yesterday on changes relating to Temporary Work (Skilled) visa (subclass 457)

    Following the update on 457 visas, here is a look at how the new replacement scheme will work and what the announcement means for those currently on a 457 visa:

    • The new visa program will include requirements around work experience, English language proficiency and labour market testing.

    • The new visa will include a short term two-year stream with a broad list of occupations reduced from the current list of more than 200.

    • A second visa class, focused on strategic, long-term skills gaps will have a four-year limit and require a higher standard of English than the two-year visa.

    • Both visas will require a criminal record check, which is not currently required.

    • The four-year visa would also require mandatory labour market testing in the majority of cases.

    • The new two-year visa will not allow permanent residency.

    • Anyone now in Australia on a 457 visa will not be affected by the new arrangements and will continue under their current conditions.

    • The new scheme will require employers to advertise jobs before filling them with foreign workers.

    • A fee of $1,150 will apply for the short term visa, while medium-term applicants will pay $2,400.

    • A non-discriminatory workforce test to ensure employers are not actively discriminating against Australian workers.

    • Strengthened requirement for employers to contribute to training Australian workers.

    • The Department of Immigration and Border Protection will collect Tax File Numbers and data will be matched with the Australian Tax Office’s records.

    • Eligibility requirements for employer sponsored permanent skilled visas will be tightened.

    • English language requirements will be stricter.

    • A requirement for visa applicants to have at least three years’ work experience.

    • Applicants must be under the maximum age requirement of 45 at the time of application.

    • Employers must pay the Australian market salary rate and meet the Temporary Skilled Migration Income Threshold set at $53,900 as at 12 April 2016.

    • Concessions for regional Australia will continue to be available:

    • Employers in regional Australia will continue to have access to occupations under the temporary and permanent visas, to reflect their skills needs.

    • Existing permanent visa concessions for regional Australia, such as waiving the nomination fee and providing age exemptions for certain occupations, will be retained.

    • Consideration will be given to expanding the occupations in regional Australia that are exempt from the age requirement

    i just wanna ask po. my husband po is going to au nagstart po ung ung application ang visa nya was last year 2016 oct and just yesterdag po nagfollow up cya s friend nya as per hr last week still processing pa din po. kng ganyan po n may bagong law affected npo ba ung sa processing. ng visa nya?

    I supposed no new 457 visa will be granted starting the effectivity date which is 19 Apr. The new visas will be implemented early next year

    Who is affected?
    Current 457 visa applicants and holders, prospective applicants, businesses sponsoring skilled migrants and industry. Existing 457 visas will continue to remain in effect.
    457 visa applicants that had lodged their application on or before 18 April 2017, and whose application had not yet been decided, with an occupation that has been removed from the STSOL, may be eligible for a refund of their visa application fee. Nominating businesses for these applications may also be eligible for a refund of related fees.

    lodged application under 457 visa (no grant yet) na nawala ang job sa list ay hindi na ma a approve, refund na lang daw ng fees. If your job is in STSOL, if ma grant, 2 years lang. if your job is under MLTSSL, 4 years if ma grant.

    existing 457 visa holders not affected though hindi na sya pede i renew. Renewal will follow the conditions of the TSS visa. But still, conditions on your valid 457 visa ay effective pa din. Meaning pede pa din mag apply ng PR 186 visa after 2 years sa company given that i sponsor ka ng employer mo.

    under the new TSS visa, only jobs in MLTSSL are eligible for PR application through employer sponsorship VISA 186 with the following conditions:
    • Minimum of three years’ work experience required
    • Maximum age of 45
    • Strengthened training benchmark requirements
    • Employers must meet minimum salary requirements and pay a ‘market rate’ salary
    • Have an IELTS of 6+
    • Commit to working for the company for 3 years

    parang mas madali pa mag apply na lang ng 189 directly kung titingnan ang requirements. just my 2 cents.

    hello po .. tama po ba khit nsa MLTSSL job mo hndi kna pwede renew another 457 VISA after mo matapos ung 4 years s VISA mo . PR na ung kasunod ? at tama po ba dn pg kaaintndi ko 3 years bago pwede mag apply ng PR from 457 and need me 6666 ielts kkit SKILLED worker lang ? salamat po sa sasagot.

    My husband in currently under 457 visa and I'm his dependent. Both of us are working as a nurse. I read in an article na if under 457 kana same conditions padin pero you need to finish the working visa before applying for PR? Aantay pa kami ng 4 years tapusin ang working visa bago mag apply ng PR? Enlighten me. Huhu.

    I have a friend who got her PR last year after 4 years in 457. She was due to apply for her citizenship this June 2017, but unfortunately, affected siya ng changes, so she will now have to wait until 2020 to apply for citizenship.

    So I guess, if in her case, she was so close to the line but will now have to wait a few more years, any other pending applications on visas after April 20, 2017 would also be affected immediately.

    Hello, clarify ku lng po..does to mean na wala na 457 visa na e approve if na lodge after 18 april?and yung new scheme mag take effect pa next year?
    ..with this, wlang employer sponsored visa granted until next year?
    Hinanapan kasi employer sponsor visa ang hubby ko ng isang agency ngayun.

    @nikpam you can apply directly for SI189 visa, no need na hintayin ang 457 visa na ma expire. actually dpat tlga wag mo hintayin kasi kapag na expire yan then saka ka pa lang mag a apply, eh need mo umuwe pinas kasi wala ka valid visa to stay..

    ung sa husband ko po nalodge ng dec 2016 still procesaing pa dn po. affected po ba un sa bagong law kahit dec 2016 pa nalodge?

    Hello Po. Ask ko po sana kung ano magandang gawin. Currently nasa 457 visa po ako pero dahil sa recent changes wala na po ung nominated occupation ko sa bagong list. May chance pa po ba akong e sponsor ng employer ko after 2 years ko sa 457 for PR?

    Sa akin, was affected it was lodged on Feb 3 2017. My agent just got status from the DIBP that my application cannot be proceeded due for the new system visa.

    So, need to re apply again for the new visa.

    Sobrang dissapointment talaga biglaang nag announce to abolish the 457 visa.

    Who is affected?
    Current 457 visa applicants and holders, prospective applicants, businesses sponsoring skilled migrants and industry. Existing 457 visas will continue to remain in effect.
    457 visa applicants that had lodged their application on or before 18 April 2017, and whose application had not yet been decided, with an occupation that has been removed from the STSOL, may be eligible for a refund of their visa application fee. Nominating businesses for these applications may also be eligible for a refund of related fees.
    This greatly depends on the profession and the location I guess. I lodged mine last May 31, 2017 (Medicals were done prior to lodgement). 457 was granted on the 16th of June for my spouse and I.

    Originally End of April mag lolodge ang employer ko, pero na remove ang occupation ko sa list. So we tried using other code, still waiting for decision. My employer is hoping makarating ako dun before August.

    Anong docs ang binigay mo? I already have IELTS 6.0. Pano ka po nakapagmedical before lodgement?

    Yung requirement sa kanya very minimal naman. IELTS is not required if secondary applicant ka. However, kailangan din nya if magwwork sya so nagtake na din sya. Requirements like police clearance sa mga countries na pinagstayan for more than 6 months, insurance, photograph, passport copy, birth cert, marriage certificate nyo and the medicals lang.

    Medicals prior to lodgement is done thru emedical. Fillout lang online then they'll provide you with HAP ID, which you will use during the medical. This can be done in all sorts of visas. I'm surprised nga that a lot don't know about it and decide to wait for the CO prior to medicals. Pwede sya and it's valid for 1 year.

    Here's how:
    1.) Login sa immiaccount
    2.) Then new application
    3.) Under "health", click on on my health declarations
    4.) Go thru the following questions such as visa subclass you intend to apply. Then after that may question dun if the applicant has already applied and just waiting for a decision. Answer no. Please note that My Health Declaration is only for clients who have not yet lodged a visa application..
    5.) After completing the my health declaration, the system will generate a HAP ID for all the applicants. Separate HAP ID po ito.
    6.) This is what you'll present to the approved panel doctors.
    7.) Attend the medicals. They will directly submit this sa DIBP.
    8.) Apply na ng visa. :)
