@Ricky78 Hi, based sa nabasa ko at gaya ni @Hunter_08 cloudy rin ako sa assessment situation mo, kasi kahit 8yrs or 13yrs ang positive assessment mo it can only claim until the maximum of 15points for skilled experienced. We should not count the number of years of work experience na pinasa natin sa assessing body, Our work experience could be 15-20 years example but what matters is if how many years will ACS count as your skilled experience which is basis to claim point and the department has the final say. Let us break down again your employment history:
Employment Y - is not counted since it’s beyond the 10years work experience window DHA requires since you lodged your visa year 2017, even though the department later said this experience equates to skilled experience=0pts
Employment Z- (2008-2016) Total number of years is 8 but knowing Assessing body they will deduct several years of experience because the 1st and 2nd yr experience is deemed not skilled yet, So ACS only counted the years from 2012 to 2016. Total years of skilled experience mo dito is 4 Years only. You cannot claim points here because as what your first ACS assessment result said it’s not relevant to your nominated occupation. Now, even sa sabi mong corrected ACS Assessment, the department agreed that your company Z experience equates to appopriately skilled level but they said it’s their decision to award you certain points
= 1st Assessment (4years only but irrelevant to nominated occupation) so result is 0 pts
= Corrected Assessment (4years skilled experience counted)
Employement O= they have counted your 1 year experience, so this equates to 1 year skilled experience.
Employement X= DHA said that your work experience here cannot be considered, so this equates 0 points or irrelevant.
Based on the information you shared and based from what I understand you only have a total of 5 years skilled experience as what your corrected or 2nd Assessment Result is which is good for 10 points BUT as what the department said it is their decision if they reward you a point or not.
I think ang malaking impact doon is your employment Z, doon nagkaroon ng conflict kasi if in the first assessment is na consider na ni ACS yun na relevant sa nominated occupation mo plus your 1 year experience sa Employment O should be a total of 5 years skilled experience walang magiging prob.
Siguro nagkagulo gulo na rin kasi bakit may incorrect at corrected assessment pa. Di rin sila na-satisfy siguro sa mga evidences na prinovide mo. I think nasa iyo na ang decision if isugal mo ang 1700AUD, if you believe strong yung case mo na they should reconsider of assessing your visa application mo isugal mo na sir but you have the option to re-apply again. Kaso this will go back to step 1 from lodging an EOI, then mga expenses and effort etc.
Lesson learned na lang siguro sir na let’s double check all our documents bago natin i-submit kasi the department have a lot of visa applications na inaasikaso, and they are only given a short period para i-assess thoroughly ang application ng bawat isa. Consult ka rin ng legal advise sir sa attorney para before you appeal sa AAT nabigayn ka na ng proper advise kasi 20 days lang din binigay sa iyo para mag appleal so kailangan mabilis ang action.
