annulment on going - can I migrate with my kid? do i need his father's consent?

Not sure if we have already topic regarding this, kid is 7 yrs old. Annulment is on going, the other party is actually trying to win back the other party. Does the mom still need a signed consent from the father?

yes... hindi pa sila annul so may right pa ang tatay nyan... kahit ata annul na may right pa rin ang ama sa bata...

so pag walang papers from the father, giving permission, nde pwedeng maisama ang bata?

actually this is not my case, its for a friend.she was insisting that she can bring her kid, even when the annulment is on going.

kailangan din ng proof/documentations kung bakit hindi isasama ang spouse... kailangn din ng signature/affidavit nya na hindi tlaga sya kasama..

@raiden14 as far as I know yes, kelangan may pirma ng tatay... mas maganda siguro sa abugado magtanong para sure.

@raiden14 - Yes need ng consent. You can create a statutory declaration, stating that the father is allowing the kid to stay permanently with the mother in Australia. For my case, the stat dec was signed by the father and witnessed by the lawyer/notary public.. Annulled na ko, pero walang court decision ng custody ng child kaya stat dec ang ginawa ko as consent ng father nya.. Na-apruv naman ang visa namin kasama ng kid ko.. 🙂

Is there a way for DIAC to check if the document is authentic? Di ba kasi dito sa pinas ang dali mag produce ng notarized statement?

@raiden14 - yes regardless ng age. sa pinas lng cguro applicable ung 7 yrs old and below, sa mother ang laging custody ng bata.. For my case kc tapos na ung annulment nung ngaaply ako, pero I think pde na rin mgapply kahit ongoing ang annulment basta may consent ng father ng child ung pagmigrate ng bata.. Ung reason kung baket nde kasama ung father sa application, pede nyang iprovide ung documents nung ngfile sya ng annullment.. In any case, hihingan naman sya ng case officer ng additional documents if nde pa sufficient ung na-provide nyang papers.

With regards sa authentication, usually nde naman ngcheck ang DIAC, pero syempre pag ngapply tau make sure naman na nde fake ung papers na isubsubmit natin para nde na mgkaproblema in future.. Sa mga notarised, certified true copy ang requirement lagi ng DIAC is meron contact details ng ngauthenticate, who knows baka ngra-ramdom calling pala cla for verification. ;P

What if hindi annulled? My flatmate before in nz separated lng sila ng hubby nya also no paperworks to show they were separated..naka aalis naman sila ng pinas. I think sinabi nya they were abandoned by the father and d na nila alam location. P.r. Na sila ngayon in nz.

@li_i_ren - I think depende na rin cguro if valid and realistic ang reason ng separation na i-provide mo sa application and depende na rin cguro sa CO na ma-aasign at mgreview ng papers. Meron cgurong strict meron ding nde. Pero mas safe na ung meron kang ma-provide kahit stat dec man lng especially now na pamahal ng pamahal ang application fee. As much as possible, we should try avoiding risks kc nde biro ung ibabayad natin..

I think that is just for travel purposes, as required by our immi and dswd..

Pero as per DiAC's guidelines, kailangn ng consent ng other parent..

Especially kung hnid ksma sa visa grant yung other parent..

That is what I know, correct me if this is wrong..

hi! newbie po ako dito at nag gather ng docs for application. ask ko lang po regarding dun sa child ko. he is born out of wedlock but gamit nya yung surname ng tatay nya. nakalagay din dun sa BC un name ng tatay nya. enough na ba un BC paramaisama ko sya sa applic?

@sheryl0126 - I got my annulment decision last year and was granted the custody but with visitation rights of the father, do you think I will still need a statutory declaration? honestly, I don't have a good relationship with the father, it will be a very big challenge for me to obtain a consent/statutory declaration from him.

Please advise @sheryl0126 or has experienced the same situation, kindly share. TIA

Australia must fulfil its international obligations in relation to the prevention of child abduction.

If your application includes a child under 18 years of age and that child’s other parent (or any other person with a legal right to decide where the child lives) is not also migrating, you must prove you have the right to move the child.

Acceptable forms of proof are certified copies of:

an overseas court order giving you sole custody of the child
a statutory declaration, signed by the child’s other parent (or other person with a legal right to decide where the child lives), that allows you to take the child to Australia
a death certificate for the other parent
an Australian court order giving you the sole right to decide where the child should live.

so i think dun po kayo sa first requirement papasok.. kung meron kayong court order ng sole custody ng bata.. pwede na po yan based dito..
