Pwede naman siguro kasi pwede mo naman sabihin pag may CO ka na nag retake ka ng IELTS and mas maganda yung nakuha mong score kaya mo gusto palitan yung una mong nai attach na results. Kung valid naman yung IELTS wala naman problem siguro.

Yun example ko is what if wala pa CO. Sabi nun iba pwede ata yun form na Notification of Wrong Answer. Meron na kaya nakagawa nito? Curious ako eh. Kasi siyempre sa tagal ng hihintayin mo bago ka magka-CO, if magkaroon extra budget, okay din magtry maka-all 8+ sa IELTS if alangan ka sa points mo.

Another piece of correspondence regarding the IELTS`s term submission:

On 5 March 2010 the High Court of Australia handed down its decision in Berenguel v Minister for Immigration and Citizenship. The effect of this decision was to change the English Language requirement from a ‘time of lodgement’ criteria to a ‘time of decision’ criteria. This meant that if IELTS test results were submitted within 28 days of them being requested, those test results could be taken into account at the point when the application was assessed.

I think yun 28 days na ibig sabihin is upon request meaning pagnagka-CO. Yun 28 days limit na yun I think is kapag onshore eh. Yun din iniisip ko, hindi naman yata kailangan complete by lodgement date? Kasi pwede ka mag-attach ng mag-attach eh. Baka within 28 days after mo magka-CO. Can anyone confirm?

Yes pwede ka pa mag attach ng mga documents within the 28 days after mong mag ka CO. So it think pwede rin yung mag attach ka lang ng bagong IELTS result. Inform mo na lang siguro yung CO about the changes kasi diba di mo na made-delete yung mga unang documents na na attach mo.

Dapat by the time na nag-lodge ka meron ka na IELTS result and dapat decision ready na nga. Meron pala mga nade-decline dahil sa dates sa results form and certificates based sa ibang forum.

So based sa link ng DIAC.. hindi pwde mag update ng IELTS after lodging an application..

ok so here is another information... apparently because of that ruling in March 5, 2010, it became a precedent.. And DIAC saw an increase of cases where applicants are changing their IELTS score after lodging.. So in July 1 2011 they reversed the ruling.

Essentially therefore Berenguel ruling has been reversed:

”I have been advised there are Regulation changes on 1 July, which change the definition of Competent, Proficient, etc, English. This change effectively is a reversal of the position created by the Berenguel decision, as it is will be defined in the Regulation that the English test must have been conducted in the two years immediately preceding the date of the visa application.”

Upload ka lang po, meron dito mga nagshare ng experience na tatlo beses pa nga nagkamali. Itatanong naman ni CO yun kung nalalabuan siya. Hindi naman automatic decline. Hehe.

regarding IELTS, para hindi kayo malito, dapat yung IELTS results nyo were taken BEFORE lodgement date (parang sa skills assessment results). Makikita naman kasi sa IELTS results yung petsa ng exam.

In short, thou shall not lodge without IELTS and skills assessment results.

Dun sa isang forum, na refuse yung visa application nya kasi yung skills assessment result nya ay dated 3 days after lodgement. Inassume nya kasi na since nabigyan na siya ng reference number dun sa skills assessment ay pwede na siya mag lodge while waiting for the results.

I meron ka naman na ITRs na kumpleto to satisfy your 8 years of work e ok na yun. Pero if example 7 years lang yung meron mo na ITR the you have to provide the payslips na di covered nung mga ITRs mo.Hope this helps. 🙂

Ok lang po yun. Ang problem lang nun e kapag na visa grant ka dun yata naka depende yung Initial Entry date mo. Kasi nakabased dun sa expiry ng NBI or medicals yung deadline mo for IED.

thanks @k_mavs ! wala na kasi ako nung mga dati kong payslips e at hinahanap ko pa mga ITR's ko. haaaay...may silbi pala ang mga yun. kala ko kasi enough na ang mga employment references.

thanks! naninigurado lang kasi ako. di pa naman ako nakakapag-lodge kasi hinihintay ko pa ang SS result ko. pero if ever positive yun at maglodge ako ng 176, plano ko kumuha na ng nbi clearance agad kahit wala pang CO. wala kasi ako sa pinas e, ang hirap din umuwi ng biglaan.
