Anyone here who has a student visa and tried getting their partner while studying? Or tinapos nyo muna yung school nyo and applied for your 190/189visa then tsaka nyo pinasunod partner nyo?

Hi!

I'm on a student visa and kasabay ko ang partner ko pagpunta dito last 2014. If you're already here, sana nasali mo si partner sa application mo mismo kahit hindi siya kasabay sa pagpunta mo. As far as I know, dapat nasa record ng application mo na may de facto partner ka na kahit hindi pa siya pupunta dito sa Oz.

I am in a LDR relationship with my gf. Pareho po kmi nagwork sa KL before pero umuwi sya and then saka lang naging kmi nun umuwi sya pinas. We are 7months now and I believe she is the one kaya meron na kaming joint account sa pinas which is few months old. Meron din kaming condo na binabayaran pero ndi pa nakaturn over. Okay ang relationship namin on my side but not on her family side. Mejo discreet din kami and not everyone knows our relationship. Ang tanong ko po:

Are we valid and what kind of visa po to apply for a de-facto relationship? Nasa oz na po sya ngaun but is having a temporary 457 visa. Can she apply for this kind of visa and ano po ba sa tingin nyo ang magiging complications namin? Kung may masusuggest po kayo na Agent im open po for that.

As I can see i have these options:

1) apply for skilled visa pero ndi ako makapasa pasa sa english exam!

2) Wait for her to get PR pero 2 years pa daw sya pwede maka-apply which is sponsored by company as far as I can read.

3) Dont wait for 2years and apply for PR right away but she will shoulder the 3060AUD visa and then we will apply for de-facto.

Any thoughts please???

Hi @lucid2010!

To qualify for a de facto relationship, you should have stayed in one address for at least 12 months unless may anak na kayo. Proof of this will be very vital. Sorry but this part was not really clear on your post though.

457 visa defacto din ako. Im the secondary. Pwede yan. Know first all the evidences that you need to submit. Gaya ng sabi ni markier kasama sa evidences ang coexistence in one house for 12months pero kung wala kayo nun ayos lang yun as long as you can explain properly your defacto relationship to them. Just say u havent stayed together. Besides may joint account naman kau very strong financial evidence un.

Gaya ng sabi ko gather first all those evidences u need to give them.

Ps. Kahit wala kaung living in for 12 months sabihin mo din na u bought together a property already and show them the papers indicating both ur names.

You dont need to hire an agent. Kau lang kaya nyo na yan. Basta basa basa lang online.

i have few more questions about the de facto relationship (same sex). I met my girlfriend online nung nagaaral pa ko sa UK. When I came back to the Philippines last year, we made the relationship official. To date, we've been together for more than a year living under one roof. Sa loob ng isang taon na yun, twice ako umalis ng Pinas para bumalik ng UK. una para umattend ng graduation ko and second for leisure.

Now, I'm about to lodge my student visa in Australia since kukuha ako ng masters degree which will start on November. sobrang rush na talaga kasi isang buwan na lang meron ako para i-process visa ko. I have no idea kung kelangan ko na ba siya i-declare sa visa application ko even if hindi pa naman siya sasama sakin pagalis - susunod na lang siya.

We can provide proof of relationship such as travel photos, lease agreement, photos with families, and phone call/video calls nung mga panahon na nasa uk ako.

My questions are:

Wala kaming joint account. How will I be able to meet the financial evidences?
We recently purchased a car nung June. Sakin po nakapangalan ang kotse. Meron kaming notarised affidavit na shared owner kami nung kotse at hati kami sa pagbayad ng monthly amortisation. Pwede po kaya naming gamitin na proof yon?
Also, nagsasama po kami sa isang bahay. Alam po ng parents ko san kami nakatira at nagsasama na kami pero I doubt na makapag provide po ako ng statement ng parents ko allowing us to live together kasi medyo hindi parin po sila masyadong open dun sa same sex relationship ko. pano po kaya pwede kong gawin dito?
Kelangan ko na po ba siya i-declare sa visa application ko kahit hindi pa siya sasama sakin?
Pwede ko po kaya siya i-declare na de facto relationship ko even if my visa application is financially supported by my parents?

Hopefully may makatulong po kayo sakin and if possible pahingi po ng list of documents that we may need once isama ko siya sa visa application ko.

For those staying in Singapore, Ask ko lng kung pwede na yun tenancy agreement as proof pero hindi notarized? Wala na kasi sa SG un landlord nun HDB unit nmain so un renewal ng tenancy agreement ay ginawa lng thru email? Then kumuha lng kami ng Duty Stamp sa IRAS for the renewal ng Tenancy agreement? Hindi lng kasi kami ni partner ang tenants sa unit namin may mga iba pang tenants. Bali isang room lng rent tlg nmin. nakalist nman kami ni partner sa tenancy agreement then nakadeclare nman kami sa HDB as tenants. Hunigi ako nun copy from HDB from the landlord. OK lng ba as proof ito?

@pidiong09 I believe that will be a strong proof. Do you have joint accounts, joint travel (eg. tickets, pictures etc.) then notarized statement from friends? You could include as well

@SAP_Melaka Thanks! Yup kakaopen lng namin ng Joint Account last month which is pahirapan pa. nakailang bank kami na napuntahan before finally nakakuha. Plan to lodge EOI by Nov pa nman para more than year after nmin mag live in. may mga travel din nman kami together at my mga upcoming travels pa. then un billing nmin same address nman. nagstart na kasi ako magcollect ng mga documents para di mahassle.

Un notarized affidavit from friends required pa ba? or pwede pictures with friends na lng(e.g travels with friends, invited from a friend's wedding)

Ang concerned ko lng kasi hindi open ang SG sa same sex relationship di ba? baka magkaproblema pag naggawa ako notarized affidavit? hehehe

@pidiong09 I would not say "required" but "recommended". It's a proof from them to testify the genuineness of your relationship, because false declaration of a notarized document could be held them liable. What I did - include their affidavit, then pictures, then scanned copy of their identification eg. passport.

@SAP_Melaka Saan po kayo ng pa notarized ng affidavit? pwede po ba sa pinas kahit dito kami naka based sa SG? un mga pictures and un IDs po ba nun friends na gumawa ng affidavit need pa ba CTC o ok na kahit hindi?
