Here's an excerpt from the legislation pertaining to skills assessment at time of invite....

At the time of invitation to apply for the visa:

(a) the relevant assessing authority had assessed the applicant’s skills as suitable for the applicant’s nominated skilled occupation​; and

(b) the assessment was not for a Subclass 485 (Temporary Graduate) visa; and

(c) if the assessment specified a period during which the assessment was valid, and the period did not end more than 3 years after the date of the assessment — the period had not ended; and
(d) if paragraph (c) did not apply — not more than 3 years had passed since the date of the assessment.

Based dito yung assessment letter date niyo is more than 3 years na po.

Nakablurred yung Assessment Period Covered for the Nominated Occupation: < or equal sa 11/09/2019 rin - more than 3 years from the date of invite.
Nakanote sa baba is the assessment is valid for the three years from the date of this letter.

Date of AIMS Exam Result: 22/04/2022

simply put, dapat valid yung assessment at the time of invite according to either of these periods:

1. start date: assessment date,
   end date: as explicitly indicated in the assessment. e.g. for ACS, 2yrs; or

2. start date: assessment date,
   end date: 3yrs from the start date (assessment date) - this is in the situation that no explicit end date/period is indicated in the assessment, like EA.

Yes, that’s correct. the department will accept up to 3 years unless a validity period is specified on the outcome letter.

Question.. ive seen a lot of posts in FB saying if its pre invite, U can still renew your skill assessment and proceed with the state nomintation. so by the time na may invitation na from the DHA and u have a valid skills assessment that was renewed, u can use the new skills assessment and proceed with application?

An expired skills assessment will lead to a refusal. The legislation is up there already, been shared for everyone to see….but if one still thinks Facebook comments would be good enough reason to convince the department that such should be considered vs the actual legislation then he/she can go ahead with the invite 😉

If it feels like an uncharted territory, always go with the law and you’ll never be wrong.

I think what others may be referring to is a certain tharpa vs minister but it’s something only agents/professionals know and can argue. And since this is beyond an individual’s knowledge and scope I suggest one should action with caution. Even agents will use this with caution….so I suggest not to even go there if not trained.

Most professionals argue that such won’t be accepted by the department as it isn’t a legislative instrument.

Even me writing to explain this is already getting too technical for a normal person to understand so better stay out of it to be safe.
