Any members with the same dilemma?

I am quite confused on the wording regarding spouse points/ partner skills.

My wife's occupation is listed in Short term skilled (STSOL). Positive skills assessment obtained. Competent english

My occupation is listed in Medium and Long term (MLTLSSL). Positive skills assessment obtained. Competent english

Since we are applying separately for visa (to get more chances). Both of us are applying for visa 190 (as wife is not under 189 stream)

  1. Can the short term skilled STSOL wife claim for points from husband who is in the MLTSSL? And vice versa?

The wording in the immi says must be:

“had nominated a skilled occupation that is on the same skilled occupation list as your nominated skilled occupation”

I am confused with the technicality of this clause.

Can anyone provide guidance please.

    Both STSOL and MLTSSL are eligible for 190, so I think you can claim points for each other's skilled occupation.

    Both STSOL and MLTSSL are eligible for 190, so I think you can claim points for each other's skilled occupation.

    Meron kasi ganitong note:
    "had nominated a skilled occupation that is on the same skilled occupation list as your nominated skilled occupation"

    So kung primary is STSOL, dapat sa STSOL din yung partner mo?
    Kung MLTSSL, dapat dun din sa list ng MLTSSL yung partner?

    My understanding with this is that both occupations that you are claiming points for should be eligible under the same Subclass. For example, if main applicant is applying for 190, the partner's skill should also be available for 190. Applicant cannot claim points if partner's occupation is only available under 491.

    When you submit the EOI, you will be asked to enter the ANZSCO code of your partner's occupation and it will recognize if you are eligible to claim points for it. It will give you a summary of points at the end.

    Hi Hi! We intend to lodge the EOI separately and we just want to make we are claiming the points accurately. We are trying to lodge separate EOI so that we have better chances of getting invited.

    So.... are we able to claim points for each other's EOI application?

    Both can claim 10 points for 190 and 491. Just enter details on skillselect, it will calculate on its own.

    You could claim 10 for 190 and 491. 5 on 189.

    Auto claim yan basta i - fill up mo yung EOI mo and your partner accordingly. If I remember correctly, 5 pts lang na claim ko sa wife ko since di kami same stream ng STSOL/MLTSSL.

    Ako - CPM - MLTSSL
    wife - Specialist Manager NEC - STSOL

    Good thing sa 190, plus 5 sa partner, plus 5 sa state. Goods na din naka 10 (total 90). HTH

    Following this thread and before we proceed on the Vetassess, I would like to ask lang po that if I am an engineer and my wife is a real estate agent and as long as the partner skills are in the system, I can claim for points?

    You can claim points as long as you have relevant skills assessment document to provide as proof upon invitation. Otherwise, it's overclaiming of points.

    Eto lang po kasi ung confusing sa immi website "had nominated a skilled occupation that is on the same skilled occupation list as your nominated skilled occupation" yung word na " same skilled occupation list" po yung medyo confusing..which should I refer to kaya po to check ?

    "Same skilled occupation list" means you and your partner's nominated anzsco must be both eligible for the same visa subclass you are trying to apply for. Depende yan sa subclass na iaaply nyo. Mababasa mo dito sa eligibilty na kelangan ng skills assessment.

    You can only claim for points for 491 but not with the permanent visas.

    You and your wife can't claim partner points for each other because your occupations are on different skilled occupation lists (MLTSSL for you and STSOL for her). To claim partner points, both occupations need to be on the same list. Applying separately is still an option, but if you're unsure, getting advice from a migration agent is a good idea.

    You can still submit EOI for 189/190 even without partner points, unless hindi aabot sa minimum pag wala.

    Currently po submittied EOI and with 80 pts for Visa 189. Waiting since August 2023. Here is the breakdown of pts:

    You and your wife can't claim partner points for each other because your occupations are on different skilled occupation lists (MLTSSL for you and STSOL for her). To claim partner points, both occupations need to be on the same list. Applying separately is still an option, but if you're unsure, getting advice from a migration agent is a good idea.

    There are maximum 10 points available for partner skills.

    If you have a partner who is not an Australian Citizen or permanent resident, then you can obtain the following points for partner skills:

    5 points if your partner has minimum Competent English
    an additional 5 points if your partner has a skill assessment in an occupation that is on the same skilled occupation list (MLTSSL, STSOL or ROL) as your nominated skilled occupation
    There seems to be some confusion around the criteria for the 5 points for partner skill assessment above.

    Here is a clear answer, assume "You" is the primary applicant:

    If you are applying for 491 State Sponsored visa, your partner can be on any list - MLTSSL, STSOL or ROL
    If you are applying for 190 visa, your partner has to be either on MLTSSL or STSOL
    If you are applying for 189 visa or 491 Family Sponsored visa, your partner has to be on MLTSSL

    How do you know it works ?

    When you are creating an EOI in SkillSelect and claiming points for partner skills, you will automatically see partner points calculated and added to your EOI score, using the above mentioned logic.

    You can check out the Skilled Occupation List to see what list your occupation and your partner's occupation is on.
