Now, the problem arise if you can't secure this. By PH law, illegitimate children are under sole parental authority of the the mother - until they turn 18. In our case, we were asked to provide an updated 1229 Form as the form we submitted was signed 3 years ago from the time we lodged the application. The father didn't provide one so I resulted getting a court order stating that I have full custody over the kids. They accepted this.

Form 1229 lang sir and copy ng passport ng other parent. As long as ma secure mo yung consent ng mother, wala ng problem.

@aanover ganon din po ba gnwa nyo? wala po ba naging problema pag labas ng bata from pinas? Like pg secure ng clearance from DSWD etc?
Hindi po pala kami kasal ng mother ng bata.

@ JedoyQueso hindi kami kasal ng tatay, di din nagbigay ng consent yung biological father para magmigrate yung kids. Dahil hindi kami kasal, nasalin ang sole parental authority ng bata. Ng affidavit lang ako dahil wala akong form 1229. Di ko din need ng DSWD clearance sir.
On your case, as long as pumirma ng form 1229 yung biological mother ng anak nyo, magrgrant sya ng visa. As for DSWD clearance, I think need nyo mag secure ng travel clearance kasi di kayo kasal ng nanay - yung first travel namin to AU iningian akp ng birth certificate ng mga anak ko and check illegitimate statis kasi wala kaming return ticket

Hi. May I know what exactly did you put in the affidavit? I also have an illegitimate child and I signed an Authority to Use Surname of Father kaya naka-apelyido sa father yung anak namin.
Just preparing for the lodging of visa for PR, hindi ko pa ina-approach yung biological father ng anak ko re signing of consent. Pero kung sakali lang na magresist na magsign ng Form 1229, ano po yung nakalagay sa sinubmit niyong affidavit?

hello po, i am legally married then un 2 kids ko lang po ang kasama sa EOI, no partner po. An affidavit po ba would do instead of court order? thanks po sa mga sasagot.
