I inquired about this and as per ABN Support
Business name registration is managed by the state/territory
governments. You need to go to the business registration authority in
your state government for more detailed information. You can use the
ASIC's National Names Index - http://www2.search.asic.gov.au/gns001.html
to search for registered business names.
Please note that registering a business name doesn't give you the right
to own this name. This is why you see some same or similar trading names
being registered. If you want to protect your business name from use by
a competitor, you'll need to register it as a trade mark. You can then
control the use of the name or any part of the name. More information on
trade marks is available at:
http://www.ipaustralia.gov.au/trademarks/index.shtml
search TM here:
http://pericles.ipaustralia.gov.au/ols/tmcheck/

so in my opinion "Pinoy Australia" can be used as long as it's not "trade mark" registered and besides PROPRIETARY LIMITED is different INFORMATION FORUM.
another question here is... if you are not living in Australia does it apply to you?
