  By overstay, do you mean na 7 years syang nasa Australia na walang valid na visa? Pag walang valid visa the person is considered an unlawful non-citizen and will be detained and deported kapag nahuli. Since balak naman ng Tito mo na umalis ng Australia, I don't think haharangin pa sya ng immigration pauwi. However, may possibility na mabigyan sya ng ban and hindi sya makabalik dito agad and it may also affect his chances of being granted a visa in the future.

  Yung Tita ng kaibigan ko nag-overstay din pero kasi nagkasakit at na-ospital for over a month kaya hindi nakaalis bago mag-expire ang visa. Nakabalik naman sya sa PH nung nadischarge na sa ospital.

  Ang pinakamabuting gawin siguro ay magconsult kayo ng immigration lawyer para mas ma-guide kayo based on the reasons kung bakit naging ganyan yung situation ng Tito mo.

  @maguero Thank you po sa sagot. Follow up lang po tsaka po baka may iba pang makabasa ang pinaka gusto po sana namin malaman is ok po or safe po ba sya makauwi. Bali po pagka tawag sa home affairs para sa travel documents hindi po ba sya i dedetain? and hindi po ba madadamay if may mga relatives sa Australia if ever?

  PS. Wala na po si tito na habol or intention na mag ka visa gusto nya lang po talaga umuwi.> @maguero said:

  If that would be the case, I don't think they still need to check the eligibility if wala naman intention bumalik sa Australia ever? I believe the immigration officers are more strict sa mga papasok na immigrants hindi sa mga paalis ng bansa.

  Still.. Try consulting lawyers. Kasi 7 years ang overstay niya. It was intentional. Baka may kulong yan worst case scenario. Hoping na hndi ganun ang gawin ng border. Kung mappaliwanag niyo ng maayus ung reason baka maging lenient and border. Mas mapapaliwanag yan ng lawyers, kesa iDIY
  niyo yung letter of explanation. God bless

  Speechless ako. Consult an immigration lawyer kasi siguradong intentional ang pag-stay niya dito ng walang valid visa. Nakalimutan ata na Australia 'to at hindi Pilipinas na pwedeng malusutan karamihan ng mga bagay. Matutong sumunod sa batas.
