Evidence of parent’s citizenship or permanent residency

Evidence of citizenship of a parent includes:

Australian passport issued to a parent born in Australia before 20 August 1986, with at least 2 years validity, on or after 20 August 1986 and valid at the time of the applicant’s birth; or

full Australian birth certificate for a parent born in Australia before 20 August 1986; or

Australian citizenship certificate for a parent issued prior to the birth of the applicant.

one of the applicant’s parents was born in Australia on or after 20 August 1986 and neither parent has held an Australian passport issued with at least 2 years validity on or after 1 January 2000, the applicant will need to be referred to DIAC for evidence of citizenship.

If neither parent was an Australian citizen at the time of the applicant’s birth, evidence of permanent residence status for either parent may be confirmed by a permanent entry permit in their foreign passport valid at the time of the applicant’s birth. See ‘ Permanent resident ’ or evidence from DIAC.

If neither parent was born in Australia, had not acquired Australian citizenship or was not a Permanent Resident at the time of the applicant’s birth and the applicant believes they were ordinarily resident* in Australia for the first 10 years of their life, the applicant will need to be referred to DIAC for evidence of citizenship.

In cases where the applicant is unable to provide supporting documentation to confirm their Australian citizenship, refer the applicant to DIAC.

*the term ordinarily resident is used in s12(1)(b) of the Australian Citizenship Act 2007 in relation to a child becoming an Australian citizen on their 10th birthday. This provision applies to children born in Australia on or after 20 August 1986 who did not have a parent who was an Australian citizen or permanent resident at the time of their birth.

Acquiring citizenship automatically

Generally, you become an Australian citizen automatically if you are born in Australia and one or both of your parents are Australian citizens or permanent residents when you are born.

There are some other, less common, ways of automatically becoming a citizen.

Division 1 of Part 2 has details about acquiring citizenship automatically.

Also, if you were a citizen under the old Act immediately before the day that this section commences, you will continue to be a citizen: see subsection 4(1).

Acquiring citizenship by application

The other way to become an Australian citizen is to apply to the Minister. This is covered by Division 2 of Part 2. There are 4 situations in which you can apply for citizenship.

The first is citizenship by descent. Generally, you would apply for this if you were born outside Australia and one or both of your parents were Australian citizens when you were born. Citizenship by descent is covered by Subdivision A.

The second is citizenship for persons adopted in accordance with the Hague Convention on Intercountry Adoption: see Subdivision AA.

The third is citizenship by conferral. Generally, you would need to be a permanent resident and willing to make a pledge of commitment to apply for citizenship by conferral. You may need to successfully complete a citizenship test. There are some less common circumstances in which you can apply for citizenship by conferral. Citizenship by conferral is covered by Subdivision B.

The fourth is resuming citizenship. In certain cases where you previously ceased to be an Australian citizen, you can apply for your citizenship to resume. Resuming citizenship is covered by Subdivision C.

The Minister must be satisfied of your identity for you to acquire citizenship by application. Rules about identification are in Division 5 of Part 2.

The Minister may be required to refuse your application on national security grounds.

Lifetime Health Cover (LHC) today

Lifetime Health Cover (LHC) was introduced in July 2000 and involves a financial loading for people aged over 30 who do not hold private health insurance hospital cover and then take it out.

For each year after the 1July following a person's 31st birthday, a 2% loading (cumulative) is added to the cost of the private health insurance premium up to a maximum of 70%. Those born before 1 July 1934 are exempt from the penalty.

Health insurers are required to charge different premiums based on the age of each particular member depending on when they first took out private health insurance.

Currently, health insurers charge the financial loadings on top of premiums paid by people who did not have private hospital cover while they were younger or did not join before 1 July 2000.

The loadings have meant that a person who delays joining until the age of 40 has had to pay 20% more than someone who joined at the age of 30.

As of the moment wala pa rin talaga budget buti nalang we have until July 2014 to get this before the penalty starts kicking in. 🙂

On private insurance, na claim namin 100% gp cost and lab tests ni hubby worth mga 300 plus. We thought na 30-40% lng ibabalik but na balik 100% so worth it yung insurance and requirement naman ng 457 visa namin.

Sulit din kasi hubby needs regular check up for his diabetes..

Sa bupa kami but according to my friend mas mahal na ngayon bupa kaysa medibank..pero i have gotten used to the forms of bupa na. And this sept. if ever eligible na din for maternity coverage... So dito muna na lng kami : p

Kaya lang, may mga GP na may gap? Hindi ko lang din maintindihan ano ibig sabihin ng gap?

Gap ata pertains to your out of pocket cost... Hindi ito refundable. 🙂

My health insurance cover is from IMAN. There policy for 457 applicants is the cheapest and comprehensive so I chose them from other health insurance providers. Customer service is okay too. They have notifications too via email so I am always informed. 😃

I'm going to look into this din. Kasi, sabi nila, may mga no-gap cover eh. I assume, walang out-of-pocket payment?

Pero baka mas mahal ang monthly nito. Magtatanong-tanong ako.

@RodGanteJr: IMAN health with NIB din ang entry health insurance ko. Pero nung dumating na ako Oz, I saw na mas cost-effective ang Bupa. Kaya nag-shift ako. I compared health insurance talaga and sat down with their agents. Iba syempre yung face-to-face kasi nakakapagtanong ka. But ok na yan for now. You can always shift anytime depending on your needs. At hindi mapuputol yung coverage mo kahit mag-change over ka to another health insurance.

We just got ourselves covered yesterday; Medibank offered us a 6 wks free coverage plus instance waive for 2 and 6 months waiting period.

As we are planning a family in the next yr or so, we included coverage for pregnancy kay misis. It will come out a bit expensive but eventually it will pay for itself when we will have the bub in due time - private delivery is expensive kasi dito sa VIC (and the rest of Australia in general)...
