Can I still work in other States if I am granted a visa 190?

I’m sorry di ko alam if may existing ng topic na ganito. Wala din kasi ako ma-search.
Anyway, just want to ask if I’d be granted a visa 190 from any States, can I still work and live in NSW?
Sa ngayon kasi 189 and 190 NSW lang EOIs ko since I have relatives sa Sydney so I prefer NSW. But since closed pa rin ang NSW, I want to lodge EOI din sana to other states pero worry ko naman if allowed ako mag-work sa NSW kung sakaling ma-grant ng visa.
Thank you in advance!

it has been discussed extensively, wala daw effect. (You can see this also in YT - Find Karl Conrad vids

Pero i read somewhere that there's a caveat to those working in different states other than the nominated state without the "release" or approval - na detrimental daw siya later on sa Citizenship.

    Wala for now.

Just be aware that policies can change instantly (e.g. the 35yr old cap on temp graduate visa), and the gov't might in the future decide to go after people who didn't meet this requirement, potentially impacting their citizenship status.

I suggest pursue 189 kung ganito na cannot magsettle sa inviting state. Kung long-term plan talaga is aus ah.

Yes, you can live and work in any state with your 190 visa. This topic has been confirmed by immigration agents and lawyers many times. No effect on citizenship as well as long as you meet the conditions of your visa.

To live and work in the nominating state is not one of the visa conditions for 190. Where did you see that???

You can check on the DHA site. It is a moral obligation, not a visa condition.

I used an incorrect word "condition", my bad. Na-technical tayo masyado haha. Yes, I know that it's just a moral obligation to follow this. If you will read, for example, Victoria's page for 190 criteria - You must be committed to living in Victoria. Ano malabo dun?
Ang point ko lang, hindi naman pala committed to stay in a state bakit ka pa magssubmit ng EOI eh iba pala target mong state in the first place. I'm just not for this kind of move na risky and medyo nagmamadali makapasok sa aus ang dating. 🙂 May 189 naman. Again, it's just me.

    butting in.

@nath143 - just read thoroughly each state's requirements. different states, different rules.

for example, ACT specifically stated a 2 year commitment.

with so much talk of immigration changes, anything can happen.

Yes. Medyo kelangan foolproof ang diskarte when it comes to this. Lalo as mentioned in a prev comment here, that there's a possibility na magchange ang immigration rules. This FY is an evidence already esp for students. Plus, agents will say it's okay to do that, kasi sino ba icconsult should there be paperworks needed to justify your citizenship etc, di ba sila? O edi additional client for them.

Hi. If I remember Victoria also stated the 2 year commitment in their Nomination Declaration during their pre-invite, which you need to sign also.

Best thing to do is just live in your nominating state. Saglit lang naman ang 2 years, pwede naman lumipat if hindi mo talaga gusto dun. At least diba naka black and white, walang gray area na pwedeng magka issue in the future.

That's a no brainer.

Hope you get it.

Yes, you can live and work in any state with your 190 visa. This topic has been confirmed by immigration agents and lawyers many times. No effect on citizenship as well as long as you meet the conditions of your visa.

Please explain, nalost ako. One of the visa conditions of 190 is to live 'and' work in the nominating state, hence 'state sponsorship'. Super contradicting eh. Anong paper works pinagdaanan nung mga naging citizen na dito who did this path please? Or wala lang pake ang DHA? Parang impossible. I still believe may caveat ito.

That's a no brainer.

Hope you get it.

agree on this one po as I have a friend na never nagka 'issue' when changing states dahil hirap sya to find a job related to his occupation in his nominated state. citizen na sya ngayon :)

@nath143 - just read thoroughly each state's requirements. different states, different rules.

for example, ACT specifically stated a 2 year commitment.

with so much talk of immigration changes, anything can happen.

Yes iba iba ang situation ng tao. Why promote something na complicated agad? Kaya papasok dyan yung preparation and research before making such big life decision - alamin mo job market sa field mo bago ka magssubmit ng EOI, mag-iipon ka ng enough before ka mag big move. Para hindi in 2months palang na wala ka mahanap na work sa field mo eh give up ka na. This one is a no brainer. Sadly, may mga iba talaga na nagmamadali (for whatever reason it may be) kaya the end up sa path na dinescribe mo. Hope you get it.

You should consult a migration agent or lawyer pa alam mo sinasabi mo. You should do more research pa kasi feeling marami kang alam.

Hahahaha!

Hi. I don't know kung agent ka or applicant. If you're an agent, I know where could your approach be coming from. Di ko lang gets why you kept circling back on the 'condition' topic when I had explained this part repeatedly. Nasaan comprehension and understanding mo?

If you're an applicant or speaking for other applicants, walang nagsasabing mali ang approach na yun, IT IS JUST NOT ENCOURAGED. Sinong tanga gugustuhin magtake ng complicated path sa migration when there is a simpler path. Know the difference, dear.

May valid points naman ang bawat isa. Siguro wag na lang mag declare ng blanket statements coz everyone's case and way of thinking are different.

Let's give everyone the benefit of the doubt when it comes to their sources. Let the readers decide for themselves. This is a forum after all. We are all entitled to our own opinions, but please be respectful.

Now, ako personally, I've said this before, wag magmadali sa pag migrate. It's a process. Now kung na-invite ng isang state at mas gusto sa iba dahil meron opportunity doon, it's easy to call and inform DHA and the state you are currently in to cover your bases. Take ownership of your situation. Let's not encourage complications lalo't immigration ang pinaguusapan at ang end goal is citizenship.

At the end of the day, iba iba tayo ng choices at pinanggagalingan, and let's respect that. So, guys... chill. :)

If you really wanna dig in into the legal requirements for Skilled Visas and Citizenship look at this regulations in Federal Register of Legislation :)

    https://www.legislation.gov.au/F1996B03551/latest/versions

    look for the titles:
    1) Migration Regulations 1994 - Volume 2 (189,190 and 491 visa grant provisions )
    2) Australian Citizenship Act 2007 - (Citizenship by Conferral and Eligibility Requirements)

Yes, you can still move or work in other states if you are granted a visa subclass 190 (Skilled Nominated Visa). The visa itself allows you to live and work anywhere in Australia, as it is a permanent residency visa. The same applies to the 491 provisional visa, but only within the designated regional areas in Australia.

Let’s say, for example, in Victoria, someone might tell you that it requires a commitment of 2 years of living and working in that state. Yes, that is 100% correct, BUT it is only part of the nomination process. Once the visa is granted, such as the 190, you must adhere to the conditions attached to your visa, which you can view on the DHA website or on your VEVO copy. You will notice that there are no words like “commitment,” “live and work in nominating state,” “2 years,” or anything about affecting citizenship. These requirements only apply during the nomination process and are no longer applicable once your visa is granted. State nomination approval is different from DHA invitation/visa approval.

Here are some screenshots of confirmation emails from states in case you need to inform them of your move:

    • From Victoria,

    • From NSW,

You can email them as well, but you will likely receive the same reply unless your case is different.

Also, here is the DHA’s reply to an email regarding state-sponsored visas such as 190 or 491. Read on for your reference.

Below is proof from a Facebook group showing someone who never lived in their nominating state but still successfully got their PR recently.

Therefore, to answer your question: Yes, you can move to other states while holding your 190/491 visa. Don’t overthink it. I suggest focusing first on getting your nomination. You still have a long way to go, but I wish you good luck! :)

Nice one @hhm9067. Detailed and comprehensive research with legitimate proof. <3

Sa huli, when in doubt, madali lang naman mag email at kumonsulta sa DHA at sa State for peace of mind as rules could change every FY. That way you are taking charge of your own situation. You can get your own "proof of release", if you will, for future reference and your own comfort.

Long way to go @nath143, saka mo na isipin yan once you get your visa, best of luck to you. 😉

    Yes, I agree with this.

And sticking to the premise @nath143 has shared sa unang unang post nya, he still has ample time to plan accordingly for his migration journey. If worse comes to worst, and if still applicable, he is covered by the above guidelines.

Is an encompassing issue that future and present and past migrants are searching for near first hand experience. Mas compelling and noteworthy pag may kakilala na may experience na. Great inputs from all by the way.

Yes near first hand experience (honest din sana). That if by fate I'd be in this situation, there's a guideline from someone's first hand experience bound by facts that I can refer to. For example, what step/s does this fit for release involve? What documents will be required from me to justify my circumstance? Will this have any effect if in the future I plan to sponsor a family member to come to Australia (be it for tourism or permanently)? Etc.

Mostly will just share their end state, but as to how they arrived there, I believe not all will disclose in detail. So there's still stuff for you to find out after all esp if you won't seek an agent's help.

I just don't favour sharing complicated advices to others when I myself have had a hard time dealing with it. Alam mo na ngang mahirap at nahirapan ka talaga, ipapasa at iaadvise mo pa sa iba.
