Hello po. I am in a 482 visa here in NSW and I want to resign na with my current employer. However, may clause po sa contract ko na I have to pay $15,000 aud if I leave the company within 1 year or less in my contract. Question ko po is legal po ba yun? Meron po akong nahanap na ibang employer who's willing to continue my 482 sponsorship.

Generally, it's legal to have clawback clauses sa contracts especially if may bonus or sponsorship.

Pero nagsign ka na sa contract with that amount already stated, right? Hindi mo inask before? Parang too late. And normal yan with some job sponsorships.

The Fair Work Ombudsman's role is to ensure employers comply with the workplace laws. Nakalista sa website nila yung employee entitlements and protection that needs to be provided by employers.
Your concern isn't exactly related to workplace entitlements or safety. It's about an employment contract. You can contact the FWO to ask about it, wala naman mawawala. Just understand that a contract is legally binding and if there are points that aren't clear, these should've been raised before signing the contract.
Suggestion lang naman. Try to leave your current employer amicably. Acknowledge na pinirmahan mo naman talaga yang contract pero baka pwedeng mapakiusapan to lower that amount, maybe pro-rate it na lang based on the number of months you've been there. Mahirap din kasi for future employment if you need to provide them as reference or makatrabaho mo ulit in the future.

Question po: naka 482 visa po ako ngaun. Gusto ko sana kunin ung mag ina ko s pinas kaso diagnosed po ung anak ko ng asd. pg nag medical sya cguro mkikita un. May nababasa ako n hindi pwede kasi kelangan nya makapasa, may nababsa nmn ako n walang paki ang govt since hindi nmn sya under ng medicare. Meron po bang nka experience neto o meron b kyong kakilala na prehas na nadala ung anak dito kahit my asd ung bata? Salamat.
