Hi all! I just wanted to double check if enough na yung requirements namin ng partner ko (De facto)

    1. Statements from friends (both sides)
    2. Statement from her dad (Di kami legal sa side ko)
    3. Affidavit of Cohabitation
    4. Both names on our lease
    5. Tickets for travel and concerts
    6. Photos with her family & our friends over the years.
    7. Both our names on our pets vet record
    8. Joint bank account (Very fresh pa. Wala pang 6 months)
    9. Fb messenger convo's, viber messages, & text messages
    10. Scanned copy of love letters
    11. Hotel bookings
    12. Barangay letter stating that we are living together

Ayan pa lang po ang meron kami. Do you think enough na po yan? also, yung sa joint bank account plan namin ipasa ang bank certificate rather than statement. Pwede kaya yan ipasa?

I would appreciate your insights. Thank you!

hi, I am currently on student visa pero on process na ko on skills assessment. I am also scheduled to take CCL test on March. Plan ko din sana isama yung partner ko as my de facto. I think enough naman yung requirements namin ng partner ko to prove cohabitation since yung relationship namin is 2011 and nag live in kami nung 2014.

I am willing to engage on migration services pero wag lang sana yung ganung kamahal. thanks! :)

Hi! Nagback read na ako and all and I still can't find a definite answer if kaya pwede ba ideclare na de facto kahit hindi live-in.

I get na other countries like yung sa Middle East, di pwede kaya madali i-argue yun, pero pag dito ba sa Philippines, meron bang same experience?

We've been together for 5 years, have heaps of photos, I can show our travels, and bank transfers too (no joint accounts)

I think you had the same situation as well?

@maryowni09 medyo similar tanong ko sa case mo po. havent submitted my eoi, but di pa kami married. sa question na "Are you bringing a partner.." i plan to tag yes. kaso pag dumating na ITA, di pa kami married, so dapat ba we should get married na bago pa dumating ITA? ano na update sa case mo?

as far as i know before ita, ang alam ko sa eoi pa lng they will ask for those coming with you on this application. correct me if im wrong. so if after ita, yung info mo sa sa ita maybe different from after visa lodging.

Hi.. andito n kami sa Melbourne. Nakapag big move n kami netong Feb 26, 2019. If you really plan to get married then you need to get married before you lodge your visa. Ok lng n hindi p married but you should tick "yes" during the submission of EOI. So may 2 months ako n dapat kasal n kami. We had our wedding last Sept 8, 2018 kasi kelangan mo din iconsider ung tagal ng release ng PSA certified n marriage certificate which is a requirement upon visa lodgement.

Thank you so much po in advance ...

Hello po I am new here. I already have my 476 visa as primary applicant. It's just recent nung makapagdecide kami nung bf ko na sumama cya. My problem is hindi ko siya nadeclare as defacto sa online application, only stated sa form 80 na boyfriend meaning parang di po yata sya considered na family member ko. I read na only family members partner and child can go for the subsequent 476 visa. I also read about visa condition ng 476 na not to marry or go under de facto before entry. Now po ang naiisip kong plan is to register our defacto relationship sa NSW Registry of Births, Deaths andMarriages after I get to Sydney this April but wala po akong nakita kung mawwaive ba ung 12 months na length of defacto. Meron po ba ditong nakaexperience ng same situation? Sana po may makapagshare ng experience and makapagcomment po sa plan kong gawin if this is ok.

So I think as long as hindi ka nag-cclaim ng points for your partner, walang effect sa visa mo kung ma-prove nyo man ang relationship nyo or hindi.

@CHARM0807 eto lang so far nakita ko sa immi site regarding waiving of 12 month period for de facto. I believe applicable din to sa lahat pero better wait for other forumers here to confirm : https://immi.homeaffairs.gov.au/visas/getting-a-visa/visa-listing/partner-offshore/provisional-309#Eligibility

    Hi Pinoy Au!

Just want to ask advice about my dilemma. Question ko po is ihabol/maihahabol ko pa po ba sa application ko as de facto / secondary applicant / dependent (not sure if we have strong evidence to suffice) or wait ko nalang po na makapagpakasal kami then partner visa?

Regarding sa evidence we only have travel itineraries, pictures since day 1 of relationship, we dont live together and no joint bank accounts. We have joint business pero yung DTI po kasi ay nakapangalan sa kanya.

Salamat po sa makakatulong sakin. Thanks pinoyAU!

Hi @kenroy and everyone. Just wanted to share ano pinagdaanan ko.

Sa EOI I put myself as “never married” (hindi ko pa gets de facto noon) pero nag yes ako sa do you plan to bring family members in a future application (yes— si BF) then how many (1pax lang).

After being invited at mas naintindihan ko na yung de facto inupdate ko “status” ko upon lodging the 189 as de facto, ininclude ko na details ko sakaniya.

Pero of course madaming supporting documents to prove na matagal na kami and legitimate de facto partnership. Joint bank account, car, affidavit from parents living in their house for more than 1 year already, support statement for aus citizen and PH friends. Travel and social events attended together, apart from de facto statements of each partner.

Kinabahan din ako na “never married” which means “single” nilagay ko sa EOI and not de facto. Pero I think i weweigh pa din nila sa documents mo so we both got our 189 visas naman without a problem. Direct grant.

I know case to case basis pero hindi siya impossible kahit at point of invite ay “never married” nilagay ko. Pero best to update before you get an invite kasi malolock na siya after.

Mas maganda kasing isabay mo na ngayon dahil mas mura ung 189 visa for dependent 50% lang, tapos mas mahal at mas strict din sila sa requirements for partner visa. Parang dapat andoon ka na and kaya mo isupport financially partner mo for I think 2 years. Kaya baka kas matagal na mapasama kayo. Though in the end diskarte niyo yan. Ang advise ko lang and advise samin was try to add your partner now than later on pa. Baka magbago pa policy nila mahirap na. All the best!

    Question po:

Current situation nmin is me and my bf living together for almost 2 yrs now.

    2. Plan din namin magsubmit ng EOI under him. He is annulled.

    3. ano po kaya need nmin iready
    - Dependent ko na rn sya sa work
    - supplementary ko sya sa credit card
    - flights itenerary
    - lease contract ng pinagsstayan nmin
    - bank transaction
    - postpaid bill (he is paying, im using the number that is also under him)
    - PUB i am paying
    - do we need to mention na annulled sya before?
    - how do we declare his 2 children?

    @anntotsky

eh ung are there any family members the client would like to include in a future application? Yes or no? - Yes sagot ko dito
What if ung partner ko may children? Pero partner ko lang kasama sa application - i included as non-migrating dependent iyong child ng partner ko sa application, kasi financially dependent iyong child sa amin.

And status ko is de facto tama ba? - if hindi kayo married but living together, yes de-facto.
