    @anntotsky nung dineclare ko iyong non-migrating dependent namin form 1221, passport at nbi clearance lang kasi more than 18 yrs old na. nasa mother din iyong bata na dineclare ko sa application. however, discretion niyo din kasi iyong pagsama sa knila sa application as immediate family. I am only basing this sa experience namin sa application kasi may balak kaming kunin iyong anak ng partner ko kaya dineclare namin siya. wait natin sa mga ibang ka-forum baka may same case na hindi na nila dineclare.

    @anntotsky need mo siya iupdate na yes, kung kasama dependent sa application mo, pagkakaintindi ko sa "future visa application" e kasama na yung instance na maiinvite kayo based on that EOI. same case tayo may de facto partner din ako claiming 5 points din.

    What is a De Facto relationship according to Australian Law?
    According to Australian Family Law, a De Facto (meaning: in practice) relationship means:

    The couple has lived together or apart only on a temporary basis
    The partners have a reciprocal commitment to a shared life
    The relationship is authentic and will continue in the future
    The partners are not related
    The couple must have been in the relationship for at least 12 months before applying for the visa
    The partners are not legally married
    The partners are not related to each other

    Partners living together
    Living together is a part of some relationships. Here’s what you need to know:

    The one-year relationship yardstick doesn’t require the partners to have lived together for the whole period of a year
    The Australian authorities appreciate that you and your partner may have had to live apart for a period, due to work or family commitments.
    Having said that, the couple has to prove that the separation was temporary, and that they had lived together at some point from the beginning of the relationship.

    Evidence to prove De Facto Relationship
    Providing the Australian authorities with the history of your relationship is one way to do it. You will have to submit a signed relationship statement that will provide the authorities with all details.

    Such a statement should cover:

    Details of how, when and where you met your partner
    How your relationship developed over time
    Proof of commitment when it comes to supporting each other: emotionally, financially and physically
    If there was a period of separation due to certain commitments, how you kept close contact even during that time
    Your plans for the future as a pair.

    Hello po. Me and my boyfriend are planning to apply in Aus. Qualified po ba kami sa de facto even if we are not living together. Sa case kasi namin madalang kami mag kasama. Seaman po kasi sya. 2 to 3 months lang bakasyon nya.

    My question is for people who have lodged their visas (189/190). The initial fee is AUD 3,755, do I need to pay the additional AUD 1,875 for the de facto partner? Just trying to compute costs. :)

    I see, so hindi considered na "applicant" din yung de facto partner. Sa options kasi nung Visa Pricing Calculator ang tanong is ilan yung additional applicants na above or below 18 yrs old.

    @agentKams yup, sorry if I sound confrontational... hehe :) ayun po yung initial ko din na assumption, kaya napatanong ako baka sakali meron nakapag lodge and ma confirm. To be safe yun na lang din ang ang pag-ipunan namin.

    Hi new here also, mas ok ba na magapply nalang kami ng defacto kesa habulin ko ang 190. alam niyo na para di na magexam. ung isa sa amin is nasa Aus na under 189. And tama ba na ang iaapply ko na visa is Partner (Provisional) visa 309. sa mga nag apply na magkano ang unang bayad nito at kaya bang gawin to ng walang agent. maraming salamat mate

    Possible po ba na multiple EOI na yung isa isasama ko yung de facto partner and yung isa hindi? Kasi nabasa ko dito affected ng de facto partner yung invite/grant if hindi masyadong strong yung evidences.

    Hello po mga kapatid :-) Sino po dito yung ikinasal while waiting for the ITA? or sino po sa inyo ang may idea kung okay lang po ba na "Certified True Copy of Marriage Certificate" from Local Civil Registrar yung e su-submit upon lodging visa 189/190? Kasi 1 to 3 months pa po bago makuha yung PSA copy, baka matagalan sa visa lodging :-(

    @karlboy in support of de facto relationship po ba? If parents are Australian citizens or PRs, use Form 888. https://immi.homeaffairs.gov.au/form-listing/forms/888.pdf Otherwise use affidavit format using the form 888 for what to put in the affidavit.

    Guys we need some advice regarding our 190 app.. My partner (defacto) is the Main applicant, we both have a child from our previous relationship. The problem is she cannot secure the consent for her daughter from her ex husband for some "ampalaya reason". so she opted to file a custody case in court which will take maybe a year or more. We have until July 20 to lodge our Visa everything's ready naman na sana..
    Our question is how can we proceed with the lodging? we should include her in migrating member? or in the non migrating member? while waiting for the court decision.. TIA guys.

    @cres_rod I would go with proceeding with the lodging and just wait for the court decision regarding your partner's child. After which she can file for a child visa (subclass 101) when she gets a favorable decision from the Ph court. How old is the child/dependent, btw?

    Thanks po! Although with the changed in points sa 189 and 489 baka di na lang sumama si partner kasi ang taas na ng minimum points na kinoconsider nila for pro rata skills :(

    Based dito ang pag asa na lang ata ng mga de facto is 190
