What is a De Facto relationship according to Australian Law?
According to Australian Family Law, a De Facto (meaning: in practice) relationship means:
The couple has lived together or apart only on a temporary basis
The partners have a reciprocal commitment to a shared life
The relationship is authentic and will continue in the future
The partners are not related
The couple must have been in the relationship for at least 12 months before applying for the visa
The partners are not legally married
The partners are not related to each other
Partners living together
Living together is a part of some relationships. Here’s what you need to know:
The one-year relationship yardstick doesn’t require the partners to have lived together for the whole period of a year
The Australian authorities appreciate that you and your partner may have had to live apart for a period, due to work or family commitments.
Having said that, the couple has to prove that the separation was temporary, and that they had lived together at some point from the beginning of the relationship.
Evidence to prove De Facto Relationship
Providing the Australian authorities with the history of your relationship is one way to do it. You will have to submit a signed relationship statement that will provide the authorities with all details.
Such a statement should cover:
Details of how, when and where you met your partner
How your relationship developed over time
Proof of commitment when it comes to supporting each other: emotionally, financially and physically
If there was a period of separation due to certain commitments, how you kept close contact even during that time
Your plans for the future as a pair.

I see, so hindi considered na "applicant" din yung de facto partner. Sa options kasi nung Visa Pricing Calculator ang tanong is ilan yung additional applicants na above or below 18 yrs old.
Ito kasi yung sabi sa immi website
"Cost

Possible po ba na multiple EOI na yung isa isasama ko yung de facto partner and yung isa hindi? Kasi nabasa ko dito affected ng de facto partner yung invite/grant if hindi masyadong strong yung evidences.

Hello po mga kapatid :-) Sino po dito yung ikinasal while waiting for the ITA? or sino po sa inyo ang may idea kung okay lang po ba na "Certified True Copy of Marriage Certificate" from Local Civil Registrar yung e su-submit upon lodging visa 189/190? Kasi 1 to 3 months pa po bago makuha yung PSA copy, baka matagalan sa visa lodging :-(

Guys we need some advice regarding our 190 app.. My partner (defacto) is the Main applicant, we both have a child from our previous relationship. The problem is she cannot secure the consent for her daughter from her ex husband for some "ampalaya reason". so she opted to file a custody case in court which will take maybe a year or more. We have until July 20 to lodge our Visa everything's ready naman na sana..
Our question is how can we proceed with the lodging? we should include her in migrating member? or in the non migrating member? while waiting for the court decision.. TIA guys.

@cres_rod I would go with proceeding with the lodging and just wait for the court decision regarding your partner's child. After which she can file for a child visa (subclass 101) when she gets a favorable decision from the Ph court. How old is the child/dependent, btw?
