badly need help

Hi,

I would like to seek advice for those who have knowledge on my tough situation.. I am currently holding BVA (SUBCLAS 820),
havent done my medical test yet.. I came here for woRking visa and eventually met my partner and changed it to partner visa, the problem is, we're both having hard times with each other, to end it up were not okay but we still talk like normal human being. My question is, is it possible to switch my partner visa to another working visa? i cant call immigration to inquire on this matter as I know they will ask my name and I dont want them to have false believe in my case..Pls help po... I just cant take this anymore.. TKS!

    Naku po ang hirap naman po niyan...may contact po ba kayo sa isang migration agent diyan? This is a legal matter kasi so they would be the best person (next to immigration) who can help on this.

    Migrante is a Filipino organisation but just a quick look suggest they may not be of direct help but can refer you. http://migrante.org.au/about/

    ^ Australia is very strict with what a certain profession can only do...hindi tulad sa atin a self employed accountant can even offer legal advice by just reading books hehe...So migrante is just protecting their *** from potential law suits hehehe. The best they can do is refer you to the very specialists (which in the case of the threadstarter should be someone licensed)

    @orrighfella, i will call them up on Monday just to make sure office is open for setting appointments. Another question, does cheating means I can save my visa on this case? I'm planning to see the immigration with my partner's lola as his families dont like how my partner treats me.. i cant expect but only the worst possible thing.. im gonna lose my husband and a visa that keeps me staying with him.. i'll keep you updating if this organization can really help me..

    If the relationship ends before the second stage of processing

    If the relationship ends while you have a temporary visa, you must inform the department immediately. You may still be eligible for a permanent Australian visa, without having to fulfil the normal two-year waiting period, if:

    - after entering Australia the relationship breaks down and you or a member of your family are the victim of domestic violence committed by your spouse; or
    -after entering Australia the relationship breaks down and you and your Australian spouse have children under 18 years of age; or
    - after entering Australia, your spouse dies.

    Hi guys,,


    I know this is really personnal but I need help from anyone..

    So I caught my partner msging his ex and planning to move in together, I gather related proofs but is this acceptable to win my visa, knowing relationship is nearly falling down???? does cheating, ei. bringing the ex to our house and holding hands infront of me, do I have rights to fight for my legality as his wife and to save my visa since I gave up my 5 Yrs WV for my husband just to be with him??? I havent called any of the links posted above since I want to make sure everything is settled.. Thanks,!!!

    Domestic violence doesn't just mean physical violence but I think you need to get your situation assessed by someone who does. You need to do something quickly because DIAC will ask why you didn't act sooner. I think your best opportunity is to contact the organisations advised here and see who can help best.

    i agree with @orrightfella, the situations you mentioned above might not cause physical violence but can cause emotional pain/distress..

    one question: you had work permit before, are you not qualified for a PR visa because of that? im just thinking other options..

    @orrightfella, my aunt also suggested me to go directly to the immigration and show all the text msgs captured by my phone and screen shot of their emails, but im afraid my husband will get in trouble. my heart and mind is fighting for this...

    @lock_code2004, I cant go back to my old employer as they already advice immi that im switching my visa to PV...

    im not talking about going back to work visa.. what i meant was applying for a PR visa as a skilled migrant.. like most of us did in this forum..

    Might I be so unkind to suggest that it doesn't matter what happens to your husband. He cheated on you and if you are to stay in this country then you need to look after your interests not his. Your first move is to go to see someone who can give you professional advice about your situation. If your financial situation allows you then it is a registered migration agent from www.mara.gov.au (Westly Russell from a previous forum is a RMA and seemed like a pretty good fella but do your own research RE reputation and price) If your financial situation does not then you need to contact the organisations as suggested here and see how they can help you. You need to do it now because further delay will not help your case with DIAC and IMO it may even affect it negatively. Get to it girl, look after yourself now!

    As to the visa, get the migration agent to look into your case. Worst case scenario would be to come back here and start from scratch :(

    If you have not contacted the organisations suggested then you need to do so. If you can afford a migration agent then contact one from the Migration Agents Registration Authority (MARA) and they can assess your case. If you wish to stay in Australia and there is a chance you can then you need to do it before your husband contacts DIAC and tells them he is no longer sponsoring you for the spouse visa.
