Hello! Hoping someone can help. I am currently on 482 visa and already onshore. My previous boss has a company and wants to hire me. Can I accept po and maybe apply 186 visa? Thank you.

yes you can definitely get yourself sponsored for a 186 visa, whis is always best dahil PR visa na yun, but please do your due diligence for this one, need to get your previous boss to do all the neccessary works to make it happen, of course with your help, submitting all the documents they will need to get you sponsored :)

i would imagine you will need to get your sponsorship transferred, and normally, just my 2cents, it is better to get it done with a registered migration agent, para hindi ka po malito, people can definitely DIY, but with how AU time/sched/balance is, medyo mahirap to DIY (just talking from my experience), unless you have the patience to research all the neccessary details to make it happen...

    all the best po!

    God Bless!

Ngaun nag lodge ung agent ng 186 DE which is walang waiver.

May code of conduct po ang mga agent , looks dubious naman yung proposal nya , you may dodge the bullet now ,but may have consequences later on.
I suggest you run through other options besides the pathway na inapply sayo and get a second opinion from other MARA agents.

Kaya nga nkakainis, ni hindi man lng inexplain ung visa n ilalodge nya o kaya man lng nag tanong muna.

Kailangan nyo pa rin syang ideclare as a non-migrating family member and sa pagkakaalam ko the child will still be subject to a medical exam because alam naman ng immigration na may chance na in the future kunin on a subsequent entrant or child visa ang non-migrating family members. The only way na your child will no longer be a part of your family is if s/he is adopted.

Try to consult another agent. If you don't declare your child, that's fraud naman and pag nalaman yan in the future, mas mabigat ang consequences. Double check as well if your current agent is a MARA agent. You can actually report them for putting you in this situation.

Thank you po s pagreply.

Kung hindi naman well versed in family law ang agent nyo, I don't think they're in a position to advise you on how to remove a child from your family.

You can Google this, an Australian visa won't be issued if it's detrimental to a child. I think, at hindi ako migration agent, Immigration will not look kindly at the letter that your agent suggested. It sounds like child abandonment di ba? The child is legally still your child (not adopted out) pero sinasabi sa letter na tinatakwil na sya ng family mo. Ano pa ba yun. Parang lalong hindi maggrant yung visa if it will cause a child to be abandoned.

I strongly suggest you consult a MARA agent or an immigration lawyer at this point.

I was about to say the same thing.

Sobrang unsound and careless nung advice ng agent. Merong certain rules na sinusunod for migrating children, or people in general, with disability or sickness. And it's within the migration agents' capacity and responsibility to provide and communicate that information clearly to their clients. Dapat sila yung mas may alam tungkol dyan.

I strongly agree with the previous comment na mag-consult ka for 2nd opinion with another reputable agent or better yet, with a migration lawyer.

It is already a good start that you detected this as unreasonable, albeit you've already spent money for the visa application. Yung susunod mong actions ang magdedefine ng migration journey nyo given the situation.

Ano po work nila ,r u in a niche industry gaya po ng aged care? Or an employer sponsoring workers through a DAMA or LA ,check nyo po if may agreements na ganito employer nyo with AU, they may waive the age requirement when you apply for a PR visa.
Pwede po , mainvite this FY or next FY ng skilled visa , yung visa nyo ba is TR ? You need to stay in the employer for 2-3 years before being qualified to apply for an ENS 186 visa .

Which state po ba sila ? You can search South Australia DAMA for this option , they will accept under 55 years of age when you are transitioning to a PR visa depends sa occupation nyo may inooffer sila na age or skills concessions

Nagpa medical na pala yung anak mo, so may medical exam record na sya associated with your application. Lalong naging absurd yung suggestion ng agent mo to suddenly declare her as not being part of your family kasi magiging obvious na nilulusutan nyo na lang ang possible issue with her ASD.

Does your sponsor know na may problema with your visa application? If not, I suggest you discuss this problem with your sponsor. Explain na nagkamali sa visa na naapplyan. Unang-una, dahil may nagastos na sila for your nomination and if you withdraw your application and resubmit, as suggested by the second agent, it might mean another payment and submission of paperwork on their end. Tapos syempre, it will lead to delays in the visa grant. Kung sila, then they really need to know that he's behaved unprofessionally. He was very careless with your application and very disrespectful of your family. He has wasted everyone's time and money.

Regardless of who hired that agent, when you explain to them what needs to be done to correct the situation, I suggest that ask for a refund of your payment because of how they handled the situation. It's not just the carelessness, it's the disrespect that's so bad. If they're a MARA agent sabihin mo that you will file a complaint with MARA. He was practically suggesting you commit fraud and child abandonment to correct his mistake.

Definitely, agree! Discuss with your employer. Kasi in the end, kung mag lodge ng panibagong nomination and visa, gastos ulit yun. Pagusapan nyo pano nyo mababawi yung una nang nagastos from the agent as a compensation to their wrong advice and action. It's just valid to ask that since you and your employer fully entrusted the application to the agent knowing they'd do their best with due diligence and full knowledge. That's the whole point of getting an agent to begin with.

Hahaha.

Parang malabo nga tlga ung gusto ni agent.

    @1stym
