Statutory declaration-Authentication Outside Australia

Hi again! Need your help guys. We applied for Visa 475 and we got request from our CO for police clearance and medical. My problem is that I cannot obtain police clearance from Saudi Arabia. I worked there from July 2006 to October 2007. I got this form- Character Statutory Declaration- MSI 334 but I have to have it authenticated by an Australian consular officer or an Australian diplomatic officer, right? And I am currently based here in Bahrain and there is no Australian Embassy here... Please help me what should I do?

@smartbrat - baka pwede mo ipa-authenticate sa kalapit bansa na merong AU embassy/consular office..

one issue though is, Bahrain is under the Australian Embassy in Saudi Arabia..
so kung magpapa-authenticate ka sa AU embassy sa Saudi, baka questionin nila na bkit hindi ka na lang kmuha ng Police Clearance ng Saudi..

@smartbrat advise ba sau ng CO mo na mg stat declaration ka? Sinabi ko na din sa agent nmin kc si macaraeg-michael ping stat dec dib sila. Ung hubby ko ngrequest sa saudi arabia pero napakatagal ng processing

Faye: how did your husband request for Saudi police clearance. When you read kase yung booklet na "Character Requirements- How to Obtain police clearance (Updated as of April 2012)", the DIAC itself stated there that currently, non-citizens and non-residents are unable to obtain police clearance in Saudi Arabia. However, they require a copy of final exit document and a letter from previous employer. But I don't think I can still get a letter from my previous employer.

Statutory declaration is the fastest and easiest way that I know, but to whom should I have it authenticated is my problem now.

@smartbrat - pero tama ka...the witness should have a connection/relation to AU.. so for overseas, the only way is via Embassy/Consulate:

15. Who may witness a statutory declaration overseas?
A statutory declaration can be made overseas provided that it is witnessed by a person who:

-falls within one of the categories on the list of signatories in Schedule 2 to the Regulations, and
-has a connection to Australia.

For example:

Example 1

A doctor who is registered to practise medicine in Australia may witness a Commonwealth statutory declaration when he or she is overseas.

A doctor who is registered to practise medicine in a foreign country (and not in Australia) cannot witness a Commonwealth statutory declaration.

Example 2

A member of a police force in Australia may witness a Commonwealth statutory declaration overseas.

A police officer of a foreign police force cannot witness a Commonwealth statutory declaration.

If you need to make a Commonwealth statutory declaration overseas, you should be able to contact a person listed under Schedule 2 as an authorised witness at the nearest Australian Embassy, High Commission or Consulate.

@smartbrat dito sya sa DFA ngrequest ng saudi police clearance. Tpos si DFA pinadala sa phil embassy sa saudi tpos ang phil embassy ang magbbigay sa saudi authority. Medyo katoxic tlaga mghintay hay sana makakuha.

Pero i ask din nmin sa agent ung stat declaration d kc kmi inadvise na gawin un pwede nman pla. PCC nlang kc ni hubby ang kulang sa application nmin eh

@faye: Pareho pala tayo na may agent, actually they are the one who advised me to have stat declaration. While waiting for their reply regarding sa authentication, I just posted here. But they didn't actually insist na kumuha ng police clearance sa Saudi. Maybe you can also check with your agent baka may iba pang easier way.

@smartbrat buti pa agent mo yan ang advise mas madali nga yan eh kesa kumuha ng police clearance sa saudi. Sinabi na nga nmin sa agent nmin ang about sa stat dec pero binalewala nya eh pinakuha pa din kami ng police clearance sa saudi. Gusto na nga nmin dumiretso na sa CO eh. hay kkstress maghntay....

Yaan mo balitaan kita update kung ano ginawa nmin, so maybe you can also do instead of waiting sa police clearance from Saudi. Cheer up!

hi guys . question naman need ko kasi gumawa ng statutory declaration para sa current work ko kasi ayaw ako bigyan ng HR pero willing naman supervisor ko na pumirma.. May specific form ba na kailangan gamitin? tapos pde ba pa notary nalang

Hi guys! Update lang... I tried to submit an ordinary notarized affidavit in replacement of my Saudi police clearance but our CO emailed us and require us to get a statutory declaration signed by Australian Consular. Haysss... so I don't have any choice but to go to Abu Dhabi. I'll update you guys...

Hi @saintluke! Sorry guys di na ako naka-update kase medyo busy lately. Yup I didn't have any choice but to go to Australian Embassy in Abu Dhabi. The process was very easy. Before I went there I called them and booked an appointment. Then pagdating ko don I just sat in front of the officer and I signed in front of her the statutory declaration. It only took 5 minutes for the whole process. I hope this helps.

Hi everyone! bago po ako dito and I came across this thread. Baka may makaadvise regarding sa case ko. Tapos na ko sa lahat ng requirements except for my Kuwait Police clearance. Yung na lang hinihintay ng CO para marelease visa ko. 4 months na ko naghihintay ng clearance ko until now wala pa rin. Wala rin maibigay na status ang kuwait embassy sa Manila. Ano kaya ang pwedeng gawin. pwede kayang statutory declaration ang gawin ko? Yung agency na nagpoprocess ng application ko ang suggestion kasi hintayin ang kuwait police clearance pero ang tagal na kasi. Hope you could provide me your inputs. Thanks

Hi Milay! I strongly suggest na kuha ka na lang ng statutory declaration. Ganyan din ako, nahirapan ako kuhanin police clearance ko sa saudi kaya ung agent ko suggested na stat dec na lang. Punta ka lang sa Australian Embassy and then in 15mins nakuha ko na. Hope this helps.

OT ka @batman but to answer your question: Yes, may expiry date yan and the issue date is very important as this will be the basis on what will be your IED date.

@smartbrat - baka pwede po pakimail ng sample Stat Doc nyo..parehas po tayo ng case nag Saudi rin ako at wala Police Clearance. I'm here na sa Australia, aling government agency po kaya ang malapitan ko dito para sa stat doc na requirement.

Question po. Yun husband ko po 4 yrs contravt sa KSA and after 2 years ng bakasyon po and ndi na bumalik sa Saudi para tapusin un natitirang 2 years. So wala po siya Police Clearance sa Saudi. Paano po kaya un? Hindi n po b sya mkkpunta sa Australia pag gnun?

@lock_code2004 hello new po ako dito, tanong kolang po kung example wala kang final exit ano kaya yung other way para makakuha ng police clearance sa saudi, or any other supporting documents kung walang police clearance? salamat po.
