I am seeking advice on whether my partner and I are eligible to apply for a partner visa as de facto partners. We began dating online and met face-to-face in October 2022. Since then, I have been traveling in and out of Australia. However, I am still legally married, although separated for almost six years. I have attempted to file for annulment twice, but there has been no progress from the attorneys. Regarding my current partner, since our first face-to-face meeting, he has been sending me money regularly. We opened a joint account in November 2023 to ensure financial transparency and to save for my relocation. We use this account primarily when I am in Australia and occasionally in my hometown, though not consistently. We live together during my visits to Australia. The reason I can't stay longer is that I have children who live with me, and I have a job that I cannot afford to lose until we are financially stable.
