Applying for 190 without legal spouse

Hi! Asking for a friend/coworker na naghe-hesitate i-push through ang GSM application dahil sa relationship status niya.

Has anyone ever intentionally left their legal partner out of their application? Basically, they're still married on paper, but no longer together. She has sole custody of their child and a permanent protection order against her spouse. They can't afford to annul.

Can she exclude him and just include her child?

Could this raise issues at any point during her application, if she goes through with it?

December 16: VETASSESS - Result - POSITIVE ASSESSMENT!

December 23: EOI - Lodged 190 for VIC and NSW

January 6: Submitted petition for correction of birth certificate (just in case)
January 10: STATE NOM - Received pre-invite from NSW for 190 TYL / Discontinued VIC ROI
January 23: STATE NOM - Submitted nomination application to NSW
January 24: Received ITA from NSW for 190 visa first thing in the morning tears of joy
February 17: Lodged 190 visa application / Scheduled my medicals at St. Luke's BGC
March 4: First-time visit to Melbourne and Sydney
March 13: Medicals
March 17: Police clearance
March 21: Medicals cleared
April 5: Uploaded corrected birth certificate (TYL, my LCRO was efficient)
October 16: Received commencement email
December 28: PR VISA GRANT

    Would definitely advise to hire an immigration lawyer. Ang alam ko lang pwwde niya makuha bata basta may pirma ng spouse na hinahayaan niyang dalhin sa Australia ang bata without him.kumabaga May kasulatan, tapos notarized.

    Yeah... Sige, I'll let her know. Not sure lang how the permanent protection order would apply, pero mukha ngang it's too deep into legalities and needs someone more knowledgeable. Thank you po!

    One of my friends had this situation and nakapagmigrate naman sila dito ng mga bata. She had a migration lawyer to assist with the process. The child's father will have to sign a form allowing the child to be granted a PR visa. They are Aussie citizens now.
