hello! nag reresearch din po ko tungkol dito ngayon. yung mag wawait pa ng 2 years, under temporary residence stream. tapos nabasa ko sa ibang forums pwede na ngayon kahit less than 2 years mag apply for pr under direct entry stream.

ang direct entry stream po ay para sa mga walang hawak na 457 visa at least the last two years or hindi pa nakakapagtrabaho sa oz na willing naman i sponsor ng employer dito. meaning kung naka 457 na po tayo sa ngayon at active pa yun, hindi tayo eligible para sa direct stream to 186 and 187.

Ang nabasa ko kung magreresign ka sa employer na nag-arrange ng 457, kailangan may mahanap kang employer na "sasalo" ng 457...Question is, puwede ba na lilipat ka from an employer who gave you the 457 and you move to an employer who will give a PR visa? Is that possible?

Kapag ENS 186 visa kukunin mo after 2 years puede kana mag lodge from 457 visa (not regional area)

Kapag RSMS 187 visa kukunin mo after one year puede kana mag lodge from 457 visa (regional area)

Dadaan ka ulit sa nomination ng employer mo bago ka makapag lodge ng visa the same process ng pag apply ng 457 visa. Mas matagal nga lang ang processing time ng 186 & 187 visa it takes 6 to 7 months while ang 457 visa 1 to 3 months.

Paki check na lang sa immi.gov.au kung yung lugar ninyo ay regional area. cheers

It could mean din po kasi na eligible ang 457 visa holder na less than 2 years pa lang. Try ko din po tawagan immigration to clarify.

hello annie23. I read yung link: direct entry stream yung binabangit nila dun. Mas maganda kung mag enquire ka na sa immigration para malaman mo kung eligible ka.

eto naman ang explanation kapag from 457 to 186 or 187.

Kapag ENS 186 visa kukunin mo after 2 years puede kana mag lodge from 457 visa (not regional area)

Maliwanag na 2 years kana 457 bago ka mag apply ng ENS186. Pero tanungin mo rin kung puede ka mag apply ng direct entry stream.

found a couple of migration agent websites where they explicitly stated that it is possible to apply for ENS under Direct Entry stream if you hold a 457 visa for less than 2 years:

tama, it's much better kung diretso mo na ask immigration on that matter kasi magulo din yung explanation ng mga link . para kasing defeated ang purpose ng 457 kung pwede ka palang sponsoran ng employer mo agad agad ng ENS 186 diba? well, for one thing mas madali maapprove yung 457. Kung 457 to 186 via direct entry stream gaya ng sinasabi ng website, parang nawala yung transition stream diba?

yun din nakikita kong difference ngayon between 457 and ENS 186 (Direct Entry) base sa mga nabasa ko. mas mabilis (2 weeks for me) ang 457 if urgent yung need ni employer unlike sa ENS 186 na inaabot ng >=6 months.

just to clarify, under ENS 186, may 3 streams as posted in skill select. compare ko lang dito yung first 2:
1. Temporary Residence Transition
- easier way to convert to PR. pero mas matagal, kelangan 2 years ka mag work sa employer na nag sponsor sayo ng 457
2. Direct Entry
- under this, one can convert to PR immediately but you need to meet all these criteria to become eligible:
a. must pass IELTS (at least competent English)
b. must provide a positive skills assessment
c. must have 3 years of relevant work experience (locally or overseas)

so si Direct Entry, mas complex yung criteria unlike Transition stream where you just need to wait for 2 years - no need for IELTS/skill assessment/number of experience. but then again, will clarify with immigration kung tama ba tong pinag sasabi ko dito hehe.

Hello Sir! 457 po ako. May visa grant date and visa expiry date (4 years after the grant date). Multiple entries to Oz during the duration of the visa.

Wala pong initial entry date. May approval date lang. I'm thinking walang intial entry date kasi usually naman pag employer-sponsored, the employer sets the date when you should start working after being accepted to the position. Depends on the contract when you are supposed to start.

In my case, wala pa ako visa, may start date na po ako.

you need to make sure na ang employer ay qualified/registered na to nominate 457..
i think yun ang medyo matagal na stage (3 steps. 1. sponsor/employer registration, 2. nominating, 3. applying for visa), lalo na kung bago pa lang silang magpapa-register..
otherwise, mabilis lang talaga ang step 2 to 3.

Hi ang pagkaalam ko kahit hindi kana mag apply ng 457 visa kung lilipat ka ng employer pero dapat the same state o kaya regional area kung regional yung dati na work place mo. Ewan ko lang sa hindi regional may rules din na dapat sundin. Dipende din pala kung kinansel ng dati mong employer ang 457 visa mo isa pa yun kaya kailangan i clarify mo muna sa DIAC bago ka magplano lumipat ng employer.

About naman sa bagong employer sa pagapply ng PR, parang nabasa ko sa comparison chart na dapat 2 years ka na 457 visa holder at kailangan one year ka muna sa bago mong employer then staka ka puede i-sponsor for PR visa. Paki-research na lang to confirm kung tama sagot ko.

Sir lock_code2004, I think you're right on this one po. It would certainly be faster if registered na ang employer as a nominating organization and may history of bringing foreigners in to Australia already. They can't nominate an employee if sila mismo isn't registered .

Hmm...I've read that part before pero hindi ko inintindi masyado kasi employer side hehe...In that case, "how does a company become a nominating organisation" would be my next question.

sir, hindi po pwedeng magcancel ng visa ang employer. ang 457 visa po satin po yun and valid yun up to 4 years kaya no need to acquire it again pag lilipat ka ng employer kasi nga, valid pa ang visa mo, ang pwede lang nilang icancel eh yung nomination nila sayo. ang immigration lang po ang pwedeng magcancel ng visa kung napatunayan nilang unlawful citizen ka. after icancel ng employer mo ang nomination nila sayo, may 28 days ka lang to look for other employers who will sponsor you kung hindi, it's time to go back home na hehe. yun ang masaklap sa 457 or temporary workers na tulad ko. :-(

Wala ka ng visa kapag umuwi kana ng pinas at hindi kana allowed bumalik loki. kailangan mag apply ka ulit ng 457 sponsor by your employer. Yung 28 days na yun eh bridging visa na binigyan ka ng time para maghanap ng employer. Kailangan nasa Australia ka pa rin at inform mo agad ang DIAC kung may employer kana. Hindi ka muna puede bumalik ng pinas habang di mo pa naiaayos pag registered ng employer mo sa DIAC.

lumalakad pa din po yung 28 days kahit lumabas ka ng oz pero the best thing to do is itawag sa immigration kasi case to case basis pa dindepende sa circumstances ng tao, minsan nagbibigay sila ng extension. that's what happened to some of my friends here na nalay-off nakahanap sila ng bagong sponsor after nearly 40 days pa.

mga engineering technician sila. sad to say yun ang realidad ng 457, pag nagrason lang ang company sa immigration na humina business nila at sobra na sila ng tao, pwede agad sila magcancel ng nomination na walang bayad sa tao kundi ticket lang pauwi ng pinas kung dika makakahanap ng bagong work. but on the other hand, wala din naman panghahawakan sayo employer mo kasi pwede kang lumipat anytime basta willing magsponsor yung lilipatan mo.
