Visa 189 Refused

Hello Guys,

Narefuse po ako dahil:

>Your date of invitation was 29 August 2014 and your Skills Assessment from the Australian Computer Society is dated 18 September 2014.

Pero, My Australian Skills Assessment was initially Dated 14 of July 2014. There was a correction on the position that they provided, instead of R&D Engineer II it was noted as R&D Manager so I requested it to be corrected. Upon the correction they provided a new date for the Assessment and it was then dated 18 of September. So I uploaded the corrected ACS Skills Assessment.

Ine-mail ko na po sila pero sabi sa akin is

Unfortunately as a lawful decision has been made on the evidence before the case officer we cannot accept any further evidence after decision.

Any ideas kung pwede ko po siya maappeal? Or if aapply ko ulit siya ng 189 visa magkakaproblem kaya?

so sorry the hear that... when was the decision of refusal and when was your lodgement date? did you upload both your assessment 14 jul 2014 and 18 sept 2014?
very strict nga sila sa mga submissions ng assessments after invitations, rejection agad. but yours is a valid case. not sure whether maaappeal mo sya but I think la ka na problem pag magapply ulit ng panibagong EOI.

@gerardds hi sir, gud pm po....sir I'm just new here, i don't know if this is the right thread for this, but can you please help me? I just took my my IELTS exam (General) last april 2014 and got a score of R-8.0, L-7.5, W- 6.5 and S- 6.5 with OBS of 7.0. I will take my AIMS assesment this coming March 2015. I just want to know if I can already apply for EOI despite of having a 0 pts on IELTS after I pass my assesment,.Coz if I calculate my total pts as of now, I already have the 60pts passing rate. I am 30.yrs old, 8 yrs working experience and a Bachelor degree holder..I am just wondering kung pede n ko di kumuha o mgretake ulit ng IELTS kac nka 60 pts naman n po ko.... Hope you can help me. Thank you po....

@johanncedrick kelangan mo muna mag pa assess sa AIMS before you can claim points
sa education saka sa work experience.

hi sir thank you for the reply...ay sir bali po sa march 2015 n po exam ko...npaassess n po ko at i need to sit the theoretical exam this march 2015..if ever po i'll pass based on my situation ok lang po kya n magapply n ko for eoi?kac i have 60 pts already?..thanks po ulit

Hi @dizzynueve, wala po ako alam sa mga ganitong case pero if I were in your situation these are the things that I would take into consideration before making my next move:

1. Ichecheck ko kung magkano babayaran sa appeal kung meron man, kung halos parehas lang ng bagong application, apply nalang siguro ako ulit.
2. Ichecheck ko kung gaano katagal ang pagprocess ng appeal, kung matagal, apply nalang siguro ako ulit ng bago. Habang open pa yung current anzsco ko.

Pero kung sa akin po nangyari ito, di ko na iaappeal kasi tingin ko hindi pa talaga valid yung unang date of assessment kasi mali yung position. Then at the same time, kayo po yung nagrequest na ipacorrect e. Again, opinion ko lang po ito.

@gerardds Thanks sir. Mahabang nilay nilay na lang muna ako.. sayang ung pera sa unang application. Pero I guess very expensive lesson learned na lang.

@RED Un nga, pero sir may effect ba ung refusal sa bagong if magsusubmit ako ng bagong EOI?

@dizzynueve if you dont mind me asking, sa tingin mo ang reason ng refusal is because na una ang invitation date mo kaysa dun sa date nung bagong acs assessment? Or is it because yung sagot mo sa eoi na "date of assessment" di nag tugma sa date na inupload mo na document?

Naitanong ko pa ila kasi, i have a similar case.. yung first assessment ko was july 2014, then netong dec 30 lang ako ng EOI tapos dun ko lang din na notice na mali yung name ng company namin.. so sa EOI ko nilagay kong date eh yung date na nrcv ng acs yung request for assessment ko, kasi i was thinking if mag sesend uli yung ACS ng panibagong assessment baka iba yung date..nung ng email ako sa acs ni-indicate ko na if pwede same lang din ang date nung una ko na rcv yung assessment which was july 14, but then sagot nila sa akin system generated daw yun date.. kung kelan nila ginawa ang letter yun daw talaga automatic sa assessment.. but then he said ma pwede daw gawing reference yung email conversation namin if incase may mga question or confusion in the future... yung panibago kong assessment ay dated january 5 then i was invites january 9.. kaya ko naitanong yung question ko sa taas para ma gauge ko kung ano ang mas magandang gawin.. sana may maka tulong sa mga forumers dito.. salamat in advance! :-)
