Permanent Residence, Citizenship, Resident Return Visa

Hello mga ka-forum,

I just have some clarification about acquiring a Citizenship in Australia, based from the website and regarding sa residence calculator ay:


"Australian Citizenship Act 2007 Residence Requirements

To satisfy the residence requirements you must have:

4 years lawful residence in Australia. This period must include 12 months as a permanent resident immediately before making an application for Australian citizenship
and
absences from Australia of no more than 12 months in total in the 4 years prior to application, including not more than 90 days in the 12 months immediately prior to application."



Ibig po bang sabihin nito ay I can still get a citizenship based sa timing at activities namin below:

-Say June 30, 2013 - Fly to AU to satisfy the initial entry date (July 3, 2013)
-July 15, 2013 - Alis ng Australia to continue work outside AU.
-April 2014 - balik ng AU to permanently settle.

This means that out of the four years na reqt nila for citizenship, we will be absent from au mula July 16, 2013 to March 31, 2014 (8mons).. which is no more than 12mons.... as I understand, we can still get the citizenship before mag cease ang PR visa namin on July 2017?
Tama po ba ang aking pagkakaintindi?

kung sakaling hindi kami qualified for citizenship because of the absences, pwede naman po kami kumuha ng RRV diba? provided, we are in AU in the last 2 years of the visa... then since 5 years din ang RRV, we can already satisfy the residency reqt ng DIAC and we can already proceed with the application for Citizenship..

I just posted this to verify my understanding about citizenship based on my reading from the DIAC website..

    The expiry of the PR visa is only valid if you want to travel in and out of AU.. kung hindi ka nmn mag tatravel outside AU, you can stay as long as you want sa AU, and therefore masasatisfy mo ang Citizenship criteria...

    So, yung RRV will be used if your PR visa has expired, and you want to travel outside AU and comeback again.....

    ah okay, so kung mag stay ako permanently in AU say in the 3rd year of my 5yr PR visa, I don't need to apply for RRV as long as I will remain in AU at di ako lalabas until I acquired citizenship..

    just to further illustrate:
    1. Kung lalabas ako ng AU say for a holiday sa pinas ng 3 weeks say during the 4th year of my 5year visa or while the travel date is within the expiry of the 5yr PR visa, I can still go out and return to AU without any problem, anyway, im still holding a valid PR visa.

    2. If halimbawang, lumabas ako on the 6th year, where di pa ako citizen and i'm planning to go back to AU, that's the only time i'll be needing the RRV bago ako lumabas ng AU?

    pahabol lang po, so ang kailangan ko lang isatisfy kung ala pa kami plano mag stay permanently sa AU ay ang initial date of entry lng, then we can return to AU na kahit on the 3rd year pa of the 5yr visa?

    mmmmm, pero sa RRV, mukhang ang reqt ng DIAC na nasa AU ng last 2years of the 5yr visa to be granted with RRV. so if there are plans of going out after the visa has expired, kailangan nasa AU na on the 3rd year..

    Make your initial entry on July 3, 2013

    Go back to the Philippines on July 15, 2013

    Come back here in Au on July 2, 2018. (or before ur 5-yr visa expire)

    Enroll your kid(s) on July 3, 2018.

    OR

    Enroll yourself in TAFE for a short course

    OR

    You have a job offer on July 3, 2018

    OR

    Your purchased a house (even on installment basis) on July 3, 2018

    then

    Apply RRV the following day (July 4, 2018). You will be granted an RRV because you have established ECONOMIC ties in Australia.

    (pre sample lang yang mga date, wag mo namang sagarin. baka bumagyo at ma-cancel ang flight, eh di cancelled na ang visa, sayang naman hahahaha)

    one hella' skilled visa grantee. Happily ended up as an ICT gov't employee where SKILLS Australia is just one desk away!

    I didn't know na pwede pa pala sagarin yung Visa kahit a day or weeks or months before the expiry as long as the PR holder has established Economic Ties with AU.

    So if one is planning to go out of AU temporarily and the Visa is about to expire or has expired, to get an RRV, either the applicant has established the Economic Ties with AU OR you have satisfied the residency requirement to get an RRV.

    Ayan, mas malinawa na. Don't worry, di ko naman isasagad. Hahaha!

    Nagrant kami ng July 25, 2012;
    Magexpire ang visa namin ng July 24, 2017;
    Mag initial Entry kami ng June 2013 and exit kami ng July 2013 (satisfy lang namin initial entry reqt);
    Maybe mga July 2014 kami permanently mag stay sa AU, pero after your explanation, baka January 2015 na kami lumipad. Hahaha!

    hi @lock_code2004, yung namention nyo po na dapat magstay sa AU ng 4 years para makapag apply ng AU citizenship, ibig po ba sabihin nyan, as in 4 straight years na hindi uuwi ng Pinas?
    pwede nmn po umuwi:
    - hindi dapat lumampas ng 12 months na wala sa AU sa loob ng 4 years,
    - AT hindi din dapat lumagpas ng 90 days na wala sa AU ( 12 months prior to application date)
    - eto pa, hindi dapat tumira ng more than 90 days sa bawat lugar overseas, para hindi kayo i-require ng Police Clearance overseas.

    year 3 - pwede mag vacation outside AU for less than 3 months
    year 4 - pwede mag vacation outside AU for less than 3 months


    - so nasatisfy mo na less than 12months total in 4 years outside AU
    - and less than 90 days on the 4th year
    - kung kaya, mas okay na wag na magvacation sa Year 4, para walang tanong tanong sa citizenship application..

    Just a thought @onesilvertwo - if you forgo your permanent residence migration to 2015, remember na lalong pahirap dito in terms of getting a job. In my opinion, the sooner you can establish yourself, the easier your life will be in Australia.

    The longer you stay out of australia the harder you will get a stable job ....

    To add up .. maybe one of you can stay and find a job then the other one in PH to keep the funds flowing just in case

    We did this ... went here together with wifey for initial entry ... had a stable job?? after 3 months then wifey return back after 8 months ... after wife returned back ... meron na akong kotse lisensya at meron na ring pera pang gastos

    Google for Everything !!!
