Honest Mistake in Visa Application

I made an honest mistake in my visa application which resulted to over claiming of points. Since EOI pa lang, overclaimed na pala yung points but I was really not aware of the mistake. I already lodged my 190 visa, and went through state invite and nomination approval. Take note - the overclaimed points was approved sa state nomination so talagang wala akong clue na nakapag overclaim ako ng points.

Come today, may nakapag chika lang sakin about sa qualification and that's the only time na narealize ko na I made a mistake.

Again, the visa application is already lodged but about to take medicals pa lang. So basically, wala pang action si DHA sa application ko.

Question is - should I notify DHA na I made this mistake? I'm worried baka I'll make it worse if I notify DHA kasi in the first place approved naman ng state ung points that I claimed.

    Is withdrawing your visa application then lodging a new EOI with the right points an option? I'm not sure lang if this is the best route, but voluntary withdrawal (and losing that money) is definitely better than refusal (which hurts your chances more and likely has long-term consequences). And 'di ko lang kapa how this would work now that you have a 190 visa application lodged, if that means you can't lodge another EOI (I don't think so naman, I think pwede but again not sure) but if there's a better time to get invited again, it's now. Let's see what anyone else says.

    Oo, high chance of refusal. Tawag dyan ay "overclaiming of points". Importante na pasok sa minimum requirement, yes. Pero yun ay para lang maging eligible ka to apply in the first place. Iba pa yung katotohanan or katugmaan ng documentation mo. Importante na yung points na ni-claim mo ay tugma sa situation mo at sistema/categorisation nila. For example, 'di ka pwede mag-claim ng points na katumbas ng Doctorate kung Bachelor's degree lang naman meron ka. 'Di ka pwede mag-claim ng points for 8 years of expi kung 3 years lang naman ang positively assessed sayo, ganun.

    Thanks so much for your inputs. I am actually considering to withdraw the application, sayang lang the fees kasi I already paid for 4 people. But do you think the nomination approval could possibly influence my case to be considered by DHA? Kasi the state approved my nomination with the points and documents that I provided.

    I still have an option to increase my work experience but not sure if it this stage, need ko pa ng new skills assessment since lodged na ung application, or pwede kaya I just provide additional references from my former employers. Hopefully this could cover the overclaimed points.

    It's just so frustrating to realize the mistake at this stage.

    Try communicating first with the government body, maybe there is a way to solve things before withdrawing.

    maybe you can try to go for assessment skills with added relavant working experience para ma satisfy ung points na kini claim mo? baka may hindi ka ini include na work experience hehe..

    For me, whether honest mistake or not. Iwithdraw ko rin. Sayang ang fee, sayang ang oras rin, Sayang ang invite.
    Why withdraw?
    a) Hindi ka magkakarecord na visa refusal para sa next Form 80 mo and to all visa applications mo pag gusto mo pumunta sa other countries.

    bKung di mo naman iwithdraw...
    a) then nafound out nila, irefuse nila ang visa mo

    Kung di naman nila nakita, and naapprove nila ang visa mo.
    C) and eventually nafoundout nila from entry up to living as a citizen sa au, you will eventually be DEPORTED sa Pilipinas. And lahat ng associated sa visa mo parehas ang mangyayari pati yung ipinanganak sa AU damay rin.
    May mga cases dito na Pinoy.

    Kung ako yan, iwithdraw. Then kung may time, write a letter of explanation sa DHA, na kailangan mo iwithdraw ang application mo because there is an oversight blah blah.

    Di kayang icorrect sa notifcation of incorrect answers yan if sa points ang apektuhan. Meron kasi sa part ng EOI, na sinabi mo true and correct and pag hindi true and correct na may ground for refusal. Basta may mga nabasa ako dun sa EOI stage up to lodgment stage.

    Oh no... Ang sakit ng x4 pala ang visa fee na nabayaran :( I wonder if a fee reversal/refund is an option? https://immi.homeaffairs.gov.au/change-in-situation/get-a-refund Pero seems like it might have consequences din. Re: your questions, honestly I don't know. If I were in your shoes, I'd find similar cases + immigration agent/lawyer to consult so I know the full extent ng impact ng pag-withdraw and if pwede pa ba mainvite ang new EOI, then likely withdraw. Pero it really depends on you if you want to keep your lodged visa application and take that risk to see if maooffset/compensate ang overclaimed points somehow.

    You can't use the reason na approved naman ang state nomination even with overclaimed points kasi visas are granted by the federal government, not the state government, so DHA ang masusunod. Some states have a line somewhere in their migration page that says after they've nominated you wala na silang kinalaman sa visa application & you must satisfy DHA's requirements.

    I suggest withdrawing kasi pag narefuse yung visa, all 4 of you will have a history of visa refusal.

    Sa education qualification po ung na-overclaim na points. ACS po ung assessing body. Nakalagay sa result was Diploma but I claimed bachelor's kasi I had bachelor's degree naman talaga. It didn't occur to me that Diploma is not the same as Bachelor's.

    Thanks so much for your inputs. I am actually considering to withdraw the application, sayang lang the fees kasi I already paid for 4 people. But do you think the nomination approval could possibly influence my case to be considered by DHA? Kasi the state approved my nomination with the points and documents that I provided.

    I still have an option to increase my work experience but not sure if it this stage, need ko pa ng new skills assessment since lodged na ung application, or pwede kaya I just provide additional references from my former employers. Hopefully this could cover the overclaimed points.

    It's just so frustrating to realize the mistake at this stage.

If I were in your shoes, I'd find similar cases + immigration agent/lawyer to consult so I know the full extent ng impact ng pag-withdraw and if pwede pa ba mainvite ang new EOI, then likely withdraw. Pero it really depends on you if you want to keep your lodged visa application and take that risk to see if maooffset/compensate ang overclaimed points somehow.

    I already have my medical tests scheduled for this coming Monday. Baka ipostpone ko na lang din to buy me more time. Baka kasi pag pumasok na sa kanila ung result ng medical, biglang maprocess agad ung application.

    Wala pong PRC sa computer society e. I can also try to check if possible na maging bachelor sya on grounds of Latin honors. Not sure if may relevance. I'm just panicking, overwhelemed and feeling so lost this time.

    Take note na when the time na nalaman nya yung mistake nya ay umaction agad sya.
    Yes, try to contact immigration lawyer na makakahelp sayo.
    Heto yung comment ng CO nya giving her a chance pa.

    in this case, maybe a good chance to increase ur work experience para ma compensate ang na overclaimed sa education qualification.

    b) Reassess ulit, para pasok ang points mo, syempre si agent na makikiusap sa ACS kung pwede ifast track. Pero kung wala talaga maicite, siyempre papayuhan ka na iwithdraw na ang application mo.

    Get an agent to advise whether you should go for another skills assessment or declare mo na lang, if gusto mo ipush. Disclose mo agad situation mo, what you know, and what you want to happen, as some agents might just opt that you withdraw—that way you filter out your options agad and find one who will want to fight for it with you. Have not tried them myself but Karl Konrad is well-publicised and I always see him being vocal about (and challenging) the system and championing applicants, at least sa videos nya.

    sadly, in the end refused din sya kasi she was not able to produce the additional 5 points to meet the points test as per the invitation letter.
