Phil Immigration red tape on 457 visa holder

Hi guys,

Gusto ko lang po ask kung may nakaexperience na po ng ganito. Kc po ung friend ko nakakuha sya ng job offer from an agency at AU at nabigyan sya ng 457 visa. Nung paalis na sya ng pinas hinarang sya ng phil immigration at ang sabi di daw sya pede umalis dahil walang tatak ng POEA ung visa nya, wala daw po kc phil counterpart ung agency nya sa pinas. Hiningan sya ng 30K para makaalis sya na hindi na kailangan dumaan ng POEA. Kitang kita naman po na pangingikil ang ginawa sa kanya.

Ang tanong ko po kung sakali makakuha ka ng Employer sponsored visa kailangan mo pa ba talaga dumaan ng POEA at ano ang kailangan mo hingin sa kanila para di po ako magaya sa friend ko na hihingan ng 30K dahil wala po ako maibibigay sa kanila.

Sana po ay matulungan myo po ako para di po mangyari sa akin un.

    YES!! He needs to be (1) member of OWWA and then (2) get an OEC that will let him get out of the country without any hitch...

    Malungkot na balita.. Ibig nyo po bang sbhin hndi sya nag PDOS sa POeA?

    Meron pong post dito kung anu dpat gwin pag direct hire ng employer from AU with visa457.. Kailangan po tlgang dumaan ang contract nya sa POEA, bilang proteksyon na rin na hndi naabuso ang mga OFW ng mga employer abroad..

    Ang masasabi ko lang mag research at mag tanung kung anu ang tamang proseso at sistema bago umalis papunta ng ibang bansa. Magtanung sa mga dati ng nakaalis papunta ng ibang bansa katulad ng visa na inapplyan nya. .

    @jeff_deleon unfortunately oo. Ngayon, constitutional right ang mag-travel, technically may butas ka, kaso wala pa nag-contest nito sa supreme court eh. Besides, dami human trafficker sa pinas eh, kaya kailangan mo dumaan dito.

    I won't call it red tape kaagad...iniisip lang naman nila yung kapakanan natin hehe...Pero oo, bago ako sasabak sa ganyang trabaho (kahit employer nominated pa yan), hihingi muna ako ng mga dokumento para tuloy tuloy lang ang pag-alis

    Yung husband ko ay direct hire din. Hindi siya dumaan ng agency dito sa Pinas. Pero kumuha siya ng PDOS at OEC sa Poea bago siya umalis. Kelangan mo lang punta POEA dala yung employment contract at passport at evidence of visa. I rereview ng POEA yung contract at fill up sila ng compliance form kung may deficiencies ang contract mo. kelangan padala mo sa employer ang compliance form at ipa sign. pwede naman scanned copy lang ito pag padala sa employer at ibalik din nila sa iyo scanned rin. then bibi.0gyan ka nila ng declaration form na kelangan mo sign at pa notarize. Then kung okay na, mag PDOS ka na tapos bayad ng Philhealth, Pag-ibig, OWWA and processing fee na umaabot mahigit P8,000. pag okay na then release nila OEC mo.

    Hello po,

    Sa lahat po ng nag reply maraming salamat po sa post nyo. Marami po akong natutunan. Atleast aware na po ako na basta working ang visa mo kailangan mo dumaan sa POEA para di umabot sa mga gamitong aberya.

    I'm sure maganda ang hangarin ng POEA/OWWA pero sometimes naaabuse ng iba nating kababayan. Alternatively, I think one way to get around this kung di pa nalabel yung visa is to fly to Asean nation like SG na same day pwede mo ipalabel yung 457 visa sa AU Embassy. Then from there you can go to AU without the hassle of going through POEA. I think once in AU, you can arrange your OEC para pagbalik mo ng PH for holidays. - I'm sure ilan sa ating mga kababayan natin nagawa na ito kaya baka pwede nila ishare yung experience nila dito sa forum

    I can only speak for my experience when I worked in Singapore - majority of the Filipino employees here do not get the POEA/OWWA membership when they left the Philippines. Rather they get it in Singapore eventually after they have started working. Less hassle and cheaper to process.

    When I first came home 4 yrs back, wala naman problema sa Philippine immigration, I just showed the OEC.

    As long as your visa is a work visa.. Yes required po yun poea clearance.

    Any work visa po regardless of what country.

    Only permanent residents and citizens are not required to get a poea clearance. Also student visa holders.

    May nakasabay akong girl going to south africa from pinas, di talaga sya naka sakay ng plane kasi the cathay pacific ground staff told her she will not be able to pass immigration without a clearnace and i think it was good that cathay did that kasi if she passed by immigration without the clearance for sure they will ask her for money and being desperate will surely pay naman din.

    But i am not certain if it is cheaper to rebook flights or pay the kutong of immigration officials.

    Hehehehe.

    Hello June!

    Whereabouts in the province are you? Meron POEA sa Cebu. And there are various regional offices sa Bacolod, Iloilo, Davao, etc. ;)

    It's a 1-2 day affair lang naman. It would really be better off if you comply with it now and just be done with it. Rather than mag problema ka later on. Alam mo naman immigration satin.

    Naku, useless yung website promise. Kahit nga tawagan mo pa, walang mangyayari. In fact, mali pa yung address nakasulat sa website hahaha! I'm not sure if na-update na. Sa kaso ko, pumunta talaga ako dun kasi when I tried calling, they told me to bring some documents. Pag dating ko dun, hindi pa pala yun. Madami pa pala kulang. It really is an exercise in patience. But once you have OEC naman, smooth-sailing na sa airport immigration. :)

    Hehe :D. I guess, you will have to go with the Manila office, mayt. Hehe.

    The PDOS is 1 full day din po. So, very likely the next day mo pa makukuha ang OEC. I will be worth it in the end naman po. Di ka na mahihirapan sa immigration. Also, I doubt makakaalis tayo without it din kasi. :)

    eto mejo mahirap ito gawin if your work destination will be australia except perhaps if you will make it appear na magbakasyon ka somewhere like say singapore...

    From Singapore, you will take the flight to Australia...

    I don't think so for Aussie 457 visa holders.

    With Singapore kasi, people go there as tourists. Generally anyway. So nakakaalis without OEC. Then ayusin ang papers dun sa Ministry of Manpower and convert to an Epass or Spass (working visa). Once may hawak ka na working visa, you are OFW na. Pag umuwi ka Pinas and balik ka Sg, di ka na makakabalik to Sg without OEC because you're already a working visa holder. So what Pinoys do is that, if magbabakasyon na ng Pinas, they get OEC from POEA in Singapore. Mas mabilis kasi than the POEA in Pinas. Para after the vacation in the Philippines, wala na problema pag balik to Singapore.

    Now I'm not sure if you go from Pinas to Sg to Aus. Wala kaya paraan to track that you are an Aussie working visa holder?

    I think when your 457 visa is approved in principal they will advise you by email and tell you to send your passport to AU embassy for visa labelling. Visa labelling can be done in any embassy around the world, so you don't have it to be labeled in the PH. If you fly to SG on tourist visa, the PH immigration will only just question your intention to visit SG which you could say for social visit. You can then go to the AU embassy in SG - they don't require any appointment. They will stamp your visa while you wait. At least that's what happen to me several years ago when I was processing my 457 but I was working in SG back then.
    From SG, fly out to AU, don't come back to PH else they will question you about your visa 457 visa when you fly out from PH. In AU, you probably have to process your OEC so you won't have issue when you return to PH for holidays. Or, while working in AU, start processing your requirement for PR :)

    disclaimer: this is a general advise so if you have the time, effort and patience to do the POEA/OWAA, etc you probably have to do that

    from what I read in AU embassy website Manila. Hindi na kelangan ng visa label sa passport ngayon dahil electronic visa ang Australia. Kung gusto mo talaga may visa label sa passport mo kelangan mo na magbayad ng $70 yata. Dalhin mo lang copy ng grant letter mo dahil from your passport number makikita na yan online kung anong visa ang na grant sayo.

    As for exiting to other countries to avoid going to POEA. Advise ko lang na compute nyo muna ang gastos. kasi example punta muna kayo ng Singapore as tourist. Remember as tourist dapat round trip ticket ang hawak nyo so yung pabalik na ticket nyo masasayang lang tapos magbabayad pa kayo ng travel tax at terminal fee.

    Mas maganda pa rin ayusin nyo nalang yung OEC sa POEA. Magtiyaga nalang kayo sa POEA

    Hello po, bago lang po ako sa forum. Ask ko lang po kasi, working po kami ni hubby sa SG, pero waiting po kme ng visa 457 to AU. Ang worry ko po, since pareho po kami ni hubby na macacancel na yun work pass sa SG, balak po namin na umuwi ng Pinas muna then saka pupunta ng AU. Kaso po ang flight namin po kasi is from SG to AU. Di ko po alam kung kukuha kami ng OWWA at OEC since uuwi po kami ng Pinas, then going to SG to AU. May OWWA po kami pero dito po sa SG yun. Please help naman po. Thank you.

    yung OEC nyo sa Sg ay hindi na magagamit to Au kasi iba na yung employer sa Au. Kung uwi kayo ng Pinas, kelangan nyo kumuha ng bagong OEC na ang Australia na ang destination unless nga balak nyo kumuha ng roundtrip ticket mnl-singapor-manila at forfeit yung pabalik nyo na ticket kasi since ma cacancel na work pass nyo sa Sg so para na kayang tourist pag alis nyo ulit ng Pinas to SG. Pero kung kukuha kayo ng panibagong OEC na reflected dun na Au ang destination then pwede kayo Mnl-Sg one way nalang kasi may ticket na rin kayo Sg to Australia.. Ask ko lang bakit bumili na kayo ng Sg to Au na ticket kung waiting pa lang kayo ng 457 grant? hindi ba kayo magipit sa time nyan?

    i-try ko po kausapin. pero mas wino-worry ko po yun medical ko pa. Xray lang po kasi yun hiningi sa amin, then 1 week na nakalipas after ma-upload yun result until now wala pa din po update sa visa portal. di ko po tuloy alam kung need pa further medical exam or what.. kakainip po pala pag naghihintay na ng visa. thanks po sa reply :)

    minsan hindi updated yang sa visa portal. kami nga dati grante na ang visa pero kung check namin online status "on process pa rin". as for the OEC kaya naman yan mga 2 days depende lang sa schedule ng PDOS. basta completo lang requirements mo. As for the OWWA good for two years lang yung binayaran sa OWWA so kung expired na membership mo sa OWWA then kelangan mo magbayad ulit.

    @apc I saw your post in a different thread...gaano po katagal yung time of application niyo sa time ng pagprocess ng application?

    yung 457 nomination namin na grant 3 weeks after lodging tapos yung visa application mga 3 weeks din from the time of lodging so mga 6 weeks lahat
