491 requirements before applying for 191 visa

We know that to qualify for 191, the following requirements have to be fulfilled:

  • 3 years holding a 491 visa and
  • an income of at least AUD53,900 annually for 3 years

Let us consider the following scenario:
491 visa granted in November 2020
Person starts work in January 2021 with a salary of AUD5000/month

Salary from working from Jan 2021 to June 2021 = AUD30,000 ONLY

Knowing that the fiscal year in Australia is from the 1st July to the 30th June,
does this mean that 2021 is somehow wasted and that the person needs to wait until 2022 to have one year with at least AUD53,900?

20 Jan 2020 | Status changed from 'Waiting for Admin Review' to 'Case Officer Assessment'
19 May 2020 | Received declaration form from the NT; printed, signed, and uploaded it on the same day
28 May 2020 | Received invite from Skillselect
03 June 2020 | Lodged visa
19 June 2020 | Health clearance provided - No action required
24 Sep 2020 | CO contact asking for additional information: (1) Biometrics, (2) United Kingdom Police Clearance. I was given
70 days to provide those documents.
24 Sep 2020 | Uploaded a letter on immi explaining my inability to provide (1) as VFS Global has not reopened in SG yet since
their closure on 3rd April 2020; (2) the requirement must have been a mistake as I have never been to the UK.
06 Nov 2020 | Done with biometrics
09 Nov 2020 | Visa grant!:-) To God be the Glory!

    Im pretty sure computation is not based on financial year. They can just extrapolate how much youve earned for the past 12 months regardless of when you started not on the total reflecting on your income statements( which is based on July to June fin year). If you started working in January 2021, this means you are qualified to apply for 191 on January 2024 provided all other requirements were met.

    191 isn’t available until 2022...between now and then things can change. I think it’s best to concentrate your worries more on securing a visa to live and work in Australia before anything else. Otherwise it can be too overwhelming to take.

    @RheaMARN1171933, thanks for the input. i have already lodged my 491 visa and just awaiting grant. i believe that planning, especially on this critical piece of information, can be asked now. i am not worrying, i just do not want to be surprised when the time comes.

    the dumbest question is the one that is not asked. whether a question makes sense or not, it has to be asked. more so when there are people who are willing to give an answer.

    Yeah, I totally get the need to understand the requirements but i think likely you’ll get only speculations from this forum as no one would have experienced such situation yet given it’s a new visa. Hence any answer you’ll get won’t be 100% accurate so not sure it it will satisfy the need to understand. It’s a teething period for this visa so even us experts are awaiting as to how this visa will unfold...best to wait and see. The good thing is you’re waiting for your grant and there’s plenty of time to understand how this new requirement would pan out....but to answer your question, I’m certain that the 2021 you were referring to won’t be wasted. They won’t count 3 years as 3 fiscal years. Hope that helps.

    And btw, I don’t think anyone mentioned that it’s a dumb question you raised.

    @RheaMARN1171933 , I appreciate your response, as always. Glad to know that the 2021 in the example won't be wasted. 'The dumbest question is the question that is not asked' is just a general life principle I live by. Thanks again for your time.
