Can i apply for visa 190 if i already have visa 489?

Hello po. Hope someone here can help me with my problem. I am currently living in regional Queensland for about 4 months now under visa 489. But recently, I checked the Skill Occupation List of Victoria and found out that they have updated the list and my occupation is now qualified to apply for visa 190. Kaya lang po there is a requirement there:

"You will be required to provide a current job offer in your nominated occupation to support your visa nomination application if:

you are currently living in another Australian state, "

So that means kelangan ko pa po ng job offer? Pwede po ba umuwi na lang muna ako ng Pinas so I can file the application without the job offer? I have only been here in Queensland for 4 months.

Your 489 visa can be converted into a permanent 187 visa if an employer is willing to sponsor you anytime without waiting for 2 years. Why not try to apply work in Victoria and if successful, ask your sponsoring state to release you(pero dapat in regional victoria din kasi if not you are in breach of your visa conditions). Or why not try to look for employer/job offer and apply without leaving Australia? Are you not confident of looking for employer in Victoria while in Australia? Unless you want to spend another $3600 and risk of your visa 489 to be cancelled. I suggest better sort out your options without leaving Australia kasi maraming uncertainties pag nasa labas ka.

@fgs Hi. Thanks for the reply. Actually yes I am not confident of finding an employer in Victoria because it has to be in my nominated occupation. Unfortunately, my occupation is so rare. Bakit po macacancel ang 489 ko if I apply for 190 in Victoria? Ganun po ba yun? Actually, today po we called the Victoria immi and they said i do not need a job offer anymore but i have to submit a reason of why i want to move to Victoria. Ano po sa tingin niyo? I'm actually thinking of going for it now. Thank you

@gracee macacancel lang pala yong current visa mo once maapproved ang new app so ok lang. Magaapply ka pa rin ng 190 sa Vic? At kailangan mo lang convince sila why you want to move?..actually pwede ka rin humingi ng permission from NSW to release you but i think pag apply mo later ng 887, kailangan pa rin sa regional area ka tumira at nagtrabaho. Kung titignan mo naman yong restriction ng visa natin, di naman nakaspecify na regional area in your sponsoring state..parang moral obligation na lang natin to avoid na din baka gawin reason pa not to approve 887 application..since di na regional area lilipatan mo, kung makakakuha ka lang din ng 190 sponsorship sa Vic, i think go for it...may work ka na ba now?

@gracee hi, I just read your previous concerns and thought of checking your experience. I too have a 489 state sponsored VISA from SA. I’ve 3 more years to go. Thinking of two options:
1) how to convert the 489 to a 190? Is this possible?
2) is there anyway I can get another 1-2 year extension? Is that possible.

possible po ba ito yung may visa 489 na tapos mag aapply for 190? nabasa ko po sa expatforum parang may successful na gumawa nito.. totoo kaya?

I will be doing this. Kasi when i applied for 489, my hubby wasn't included as dependent and I can't include him when I will apply for 887. So I will take my chances and apply for 190 so he will be included. Partner visa is more tedious and expensive kasi. Crossing my fingers na this will work

@l0ki nasa Au ka na ba? balak ko kasi kung ma invite ako sa 189/190 ituloy ko yung application.. ma apektuhan kaya yung 489 visa once na hindi positive yung result ng 189/190?

Yup, im here im no expert when it comes to visa. But 189/190 is more promising than 489 (you have no medicare benefits when you're with 489). But still, 489 is better than nothing.

@l0ki that's why I am aiming for 189/190 if given a chance na ma invite..though 489 is okay at tama ka better that nothing. though I'm still not in Au.

@Hunter_08 i know its so frustrating to wait but if you could wait a little more, 189/190 is so much better than 489. It's a bit of stretch of your patience but the benefits are incomparable like i mentioned before, medicare benefits plus you could build your own house (if you have savings na) and you can stay indefinitely

@l0ki na apply ko na yung 489 ko e kaya im thinking na if ever na mag invite ako for 189/190 e mag submit din ako.. alam ko medyo malaki yung bayad pero sabi mo ng ayung benefits kasi ay iba.

@Hunter_08 pede ba magsubmit ng dalawang visa application? E.g. SA 489 and 190 victoria? Meron na ako ita sa SA 489 pero waiting pa din ako ng ita sa 190 victoria...kaso sa december 11 mageexpire ung ita SA 489 ko...iniisip ko sagarin ung december 11 bago magsubmit ng visa for 489 visa...

@eking hindi ko sure kung pwede dalawang visa at the same time pero yung nabasa ko approved na yung 489 tapos nagpasa sya ulit for 190 then approved naman at na cancel yung 489 na nya at naging 190 na.. sa expatforum ko nabasa yun.. ganun din kasi plan ko if ever na ma approved na yung 489 ko then ma invite ako for 190 mag submit ako ng new app for 190.

@Hunter_08 oh i see tinanong ko din kasi agent ko sabi niya ang pede gawin is ipacancel ung 489 visa kung hindi pa na aapprove then apply 190 visa un nga lang magastos...kaya sabi niya may path naman for PR which is 887...ang di ko alam is pede pala mag appy 190 visa kapag na approve na ang 489 visa hmmmm ask ko din agent ko kung paano...nag followup ka na kay victoria katulad ng ginawa nila kymme?

@eking yup pwede from 489 to 887 pero you need to fulfill kasi yung 2 yrs stay sa regional at 1yr na full time work bago ka maging eligible to apply for 887 visa..

kung papa cancel mo yung 489 then ma refused yung 190 mas lalong sayang for me kaya mas okay na may sure na visa ka na then apply for 190/189 para kung sakaling ma refused yung 189/190 hindi ka pa din talo tlaga.. yun lang naman ang sakin.

Hi all question ulit...kung hahayaan ko mag expire ung 489 SA ITA ko kelan ako pede ulit mag re apply ng 489 SA? May waiting period ba na dapat ifulfill bago mag submit ulit ng application?

I've recently read from Migration Tasmania that current or previous holders of 489 visas would not be eligible for 190 visa. Not sure if this policy also holds true for other states/territories.
