Hi there I want to ask if someone lodge a de facto visa in australia. what the requirements need to be prepared?I'm philippine passport holder. Me and my bf been for 2yrs and 8 months. Do u thinks guys we can lodge the de facto visa..?

If currently nasa Oz ung partner mo under tourist visa as long as wala syang 8503 no further stay condition pwede kau mag apply onshore.

hi Jovie, pwede nyo pong gawin by urselves lang di kailangan ng agent kc madali lang nman ung process. Download nyo lang ung forms sa immigration website. Then attach ung mga evidences including stat declarations. Hindi ko lang alam kung pano ang pag su submit ngayon dati kc sinubmit lang ng partner ko nag walk in sya sa Immigration office dto sa Melbourne, tapos from tourist visa bngyan sya ng bridging visa ng immig officer tapos mga after 3 months yata na approve ung partner visa nya. Medyo mabilis ang processing ng on shore as compared sa offshore.

Kylangan pa po ba ng letter ng partner ko like a invitation letter or hindi na po?honest po wala po talaga akong idea but I'm stepping forward po sa mga binigay nyong info so I still have month to prepared in case

@ Jovie, ok lang nman na mag submit as long as before mag expired ung visa mo, pero the earlier the better. Pagkatanda ko non ung tourist visa ng partner ko mag expire ng March'12 then Feb'12 kmi nakapag submit. Nakakataranta lang dahil sobrang rush. Nagtanong ako sa regional office ng Immigration dahil nga pa expired na ung tourist visa nya d nmin alam kung aabot ung mga ibang requirements dahil manggaling pa ng overseas like police clearance, birth cert etc sabi nung nakausap ko na officer ok lang nman daw na ung application forms at kung lang muna ung availablena evidences ang i-submit then kung may mga kulang nman sa mga requirements kokontakin ka nila para hingin although siempre mas maganda kung kumpleto n lahat. Hindi kailangan ng invitation letter from your partner, pero need nya gawa ng stat declaration (2 kayo gawa ng stat dec) as part nung evidences. Oki doks, hope this helps

@happyinmelbourne34 thank you po.. yung ibang document po meron na ako like birth certificate may nbi clearance na rin po but I need to get new again kasi po pa expired na sa may.tpos po I think ang passport din po ipa certified through copy ko din.thanks po sa Info mam.my di lang po ako maintindihan kasi meron po sila ng form na 47a not sure lang po kung tlgang kylangan sya . @Jovie kailangan lang nung 47A if my anak ka or dependent na 18yrs old and over. If wala nman yun lang form 40SP at 47SP ang isubmit mo at ng partner mo. Hndi kami nagssubmit ng 47A since wala p nman kami anak that time. My checklist yata ng mga requirements sa cover ng mga forms n yan na makakatulong.

hindi nman po sya complicated...If you & ur partner are applying on the basis of de-facto relationship kailangan nyo mag provide ng mga evidences that ur relation is genuine:

1. History of your relationship - gumawa lang kami ng written statement / statutory declaration kung pano kami nagkakilala, highlighted ung mga importanteng dates gaya ng kung kelan sya na introduce sa parents ko and vice versa. Kailan nmin nag decide to live together. Mga reasons bakit need nmin maghiwalay temporarily, Ung stat declaration nagpunta kami sa police station tapos pina witness nmin sa police officer.

2. Evidence of your relationship

• financial aspects; - nagsubmit kmi ng mga remittance example western union, paypal transfer na pinadala nya tapos ako recipint. Then parang welcome letter from the bank dto nung nag open kmi ng joint account. Plane tickets na binili ko para sa kanya, then vice versa. Rent receipts na nakapangalan sa aming 2.
• the nature of the household; - statement kung pano nman hnahati ung gawaing bahay; mga correspondence sa naka address sa aming 2
• social context of the relationship; and - example nung pinasa nmin ay yung statutory declaration galing sa auntie at pinsan nya na pinakilala nya ko sa kanila at dumadalaw kami tuwing iniimbtahan nila. Written statement galing sa mga kaibgan nmin at yung sa dati nming landlord. Mga pictures ng travel together. Meron din written statement galing sa magulang nya.
• the nature of your commitment to each other. - mga print outs ng email or ng mga messages sa yahoo during the time na kailangan nmin maghiwalay temporarily as a proof na maintain nmin ung communication. SInamahan dn nmin ng written statement ng plano nmin sa future.

Dun yata sa mga initial pages ng 47sp./40sp my checklist dun ng mga requirements.

tingin ko ok lang nman as long as ma submit mo before ung expiry ng 3 months stay. Nakapgsubmit kami ng application non 1-2 wks yata bago mag expired ung tourist visa nya.

Konti lang yung print nmin, mga 3-4 pages lang yata na yahoo conversation para lang pakita na maintain ung communication during the time na magkahiwalay kami. Ung sa history of relationship, parehas kaming gumawa, pero nag sign kami sa harap ng police officer parang stat declaration na dn.

Sa case ko snapshots lang na kita yung dates, then sinave ko as PDF file. Sa history of relationship naman namin, gumawa kami pareho, then signed lang namin, scan then sent online, blue pen ginamit for signature to show it is original copy. Hindi naman na namin pinastat dec..

@Jovie in my own experience nasubmit ko lang 12 photos, mostly bday cards, valentine's cards, Xmas cards and few letters we sent to each other. I never submitted our chats so far after 6 months visa granted ako and I'm already here in Australia.

History of our relationship sa Microsoft Word nmin ginawa, tight Isa kami at we just signed it. As long as you have 12 months living together as partners and u have some evidence that your relationship is genuine u don't need to worry. Just provide all the documents in the check-list.

@Jovie maybe the reasonn why my spouse visa was granted only 6 months coz me and hubby been in a relationship since 2010 and been to Australia on a tourist visa and hubby visited me in Phils many times and we got married 2014 and applied my spouse visa 2015. . You know the CO is the one who review all the documents submitted in the embassy, isa siguro yan sa mga reason kaya na approve agad ang spouse visa ko, we got married in Phils. by the way.
Iprovide mo lang lahat ng mga requirements, if i may ask how long you been in a relationship na? Ur in Australia on a tourist visa ba? Saan ka dito sa Australia?

Happy_gal 3 years and 3 month na Kami Ng partner Ko but we leaving together one year Palang sa Australia I'm on tourist visa Po for one year expired Po visa Ko sa October 2016 . Then I'm 3 months pregnant Po now . Original I'm in Perth but because of my partner work we stay in port Hedland mag one year na Po Kami dito on June . After that move na Po Kami sa Melbourne . This June din Po. Sa tingin nyo Po maggranted Po ba or may chance Ma grant ang visa Ko .
