Married But Not Legally Separated - Need urgent advice!

Hingi po sana ako advise baka meron po akong same case dito. Nag submit na po ako ng EOI 189/190 and waiting na lang po sa invitation. When I submitted my EOI ang nilagay kong relationship status is Married though hiwalay na po kami ng asawa ko for 2 years. Pero wala akong hawak na legal documents na proof na hiwalay kami. Kasi di pa kami nakapagfile ng annulment. Ang question po ay ito:

1. Pwede bang baguhin yung EOI ko na separated kahit kukuha pa lang ako ng statutory declaration ng separation namin ng asawa ko?

2. Or hayaan ko lang sya ng married and wait sa invitation tapos pag naglodge na ko ng visa dun ko isubmit yung stat dec ko.

Sinubukan ko kasing kausapin asawa ko na makipag cooperate muna sakin sa pag aayos ng requirements ko pero ayaw nya. Kasi sa pagkakaalam ko kahit non-migrating need pa rin ng medical and other docs nya. Kaya lang ayaw nya makipag cooperate.

Sana po may makatulong sakin. Thanks in advance!

    @nedz pag nag lodge ka ng visa at ng fil up ka ng application form. dapat separated kc kung married ilalagay mo dun magkaka problema ka sa application visa mo. Remember legal documents yun. Meron sila rights na ideny ang application mo.

    @don2 kasi nung nagsubmit ako ng EOI married nailagay ko. So ibig sabihin pwede ko syang baguhin as separated pag naglodge ako ng visa? Magpafile pa lang ako ng annulment. Sana umabot sya bago mag expire invitation ko.

    hi nedz...same case tayo..2 years na din kami inabandon ng husband ko and yan din ang concern ko sa supporting documents... are you planning to file annulment? dbah matagal yun? pwde kaya legal separation nlng kunin natin? hirap talaga pag uncooperative ang partner... please share ka ng experience mo..salamat

    @racer06 Nagfile ako ng legal separation. Then yung court order ang ginamit kong supporting docs.
