06-01-11: Arrived Australia (457 visa dependent on my dad)
28-05-12: Lodged RSMS 857 visa (seperate from my dad already)
28-06-12: Done Medical check
30-10-12: Submit AFP check
07-11-12: Went home on a bridging visa B for holiday and wedding..:)
12-01-13: CO allocated and nomination approved
18-01-13: CO asked documents of my husband to be included on my application as migrating dependent..Thank u LORD!
15-02-13: Husband completed all requirements (police check, medical, english requirements and joint statement)
15-02-13: CO issued pre-grant letter instructing hubby to apply tourist visa to enter Australia in order our 857 visa to be granted.
27-02-13: Hubby applied Subclass 676 tourist visa.
06-03-13: Hubby's tourist visa approved.
16-03-13: Hubby arrived Australia.
18-03-13: Our RSMS 857 visa granted.. (nothing to ask more)

- pwede sya lumipat, assuming same occupation, at willing mag sponsor ang new company
- parang transfer lang ang visa to new company..

Changing your employer or occupation in Australia
If you want to change your employer or occupation you are not required to apply for a new visa (unless your visa is close to expiry).
However, before you can start working for a new employer or in a new occupation, you must be nominated by your proposed new employer and have that nomination approved first.

Una po, tanong ko lang po. Ano po work ni hubby niyo? The reason I asked is so we can actually assess the chances of getting a new employer. Kasi, the first thing to do sa sitwasyon niya ngayon is to get a new employer. AND fast. Really, it is NEVER allowed to work unpaid, nor is it ever legal to work beyond what the contract states.
But we can look at it in a postive way. The fact that he has local experience for almost a year, will not hurt him at all. Makakatulong eto para makahanap siya ng panibagong employer. It will give him the edge from all the others. Kung offshore nga natanggap siya sa trabaho, ngayon pa na may experience na siya. This is certainly not a hopeless situation, one of those challenges lang, ika nga.
Things to do:
1. Hanap new employer. Urgently. The new employer though must be able to take over the nomination. Ang new job niya dapat is pareho lang, or the same ANZSCO. Kasi yun ang nakasaad dun sa 457 visa niya. If may change, he has to apply for a new visa and cancel the old one.
2. Hindi na po kailangan ng new IELTS. Parang change-over lang to a new employer.
3. Sis, this is reportable. This should be filed in writing to both DIAC and Fair Work Ombudsman Australia. In QLD, may anti-discrimination agency eh. I'm not sure about Perth, pero baka meron din. This to me is discriminatory. Actually, report this to as many people as you can. The thing is, the more you make noise, the more you send a message. Also, you can actually file a case. Talk to a solicitor. By law, you are entitled to your superannuation, paid overtime and cannot be forced to work beyond a number of hours. If it were me, I will include moral damages pa.
But you can't do this Sis if walang new employer. So first things first, get a new employer. I know it's probably frustrating. Kaya nga if may chance to file action, mas ok kung they will award compensation for all these. Don't stop at just getting new employer. Work to recover what is rightfully yours.
PM mo sakin email mo and I'll send you po a copy of FairWork Statement. Lahat ng workers meron dapat nito eh. Kahit hindi 457. But in case wala kayo, send ko. Merong hotline and email add/website written and all rights and entitlements.

Kung lilipat sya hindi na nya kailangan mag renew ng 457 working visa lalot 4 years ang valid ng visa nya. Ang mag iiba lang ay ang documents ng sponsor. Kung willing na sponsor sya ng company na lilipatan nya.
Kung plano nya lumipat kailangan confidential ang pag apply nya sa ibang company. Magsimula na sya maghanap sa mga job site.
Kung mag rereklamo sya dapat handa din sya umalis expected nya dapat na ite-terminate sya afte nakapg reklamo sya. Kaya kung mag rereklamo sya dapat may company na sya na malilipatan.

@nadine, glazier cya dun. Aun nga nag sesearch na kami para makahanap na ng lilipatan. Kya nga na voice out ko din ito, makahingi na din muna ng suggestions and maging eye opener na din sa iba, dahil who would have thought it could happen? So any update d2 sa sitwasyon ng hubby ko, i-post ko agad. Thanks ulit sa mga guidelines nyo.

Kaya minsan, naisip ko na tama din siguro na regulate ni Gillard ang 457. May mga kumpanya kasi na abusado eh. Example, pag redundant na position, bigla na lang masisibak. Kung hindi man, cost-cutting. Kaya benefits (like superannuation) suffer. It all boils down to economics.
@prettyme1026: sorry ha, not very familiar with glazier. Ano po industry eto? Pasensya na kung hindi ko rin alam ano estado ng paghahanap ng ganitong klaseng work. Pero go lang ng go. Pag nakahanap na, lipat agad. Basta importante, andyan pa rin visa. Hopefully, makuha din niya yung mga benefits niya dapat. Tingin ko, kaya to. Sis, sa mga 457 na tulad namin, importante kasi ma-anticipate yung 1-2 years down the line, e.g. PR (at marami pang iba). Actually, kung hindi pa ako nakarating dito, di ko rin maiisip eto.
