For Those Losing Hope in Getting Their Visa

I know Miley Cyrus was in the news lately, but before eyebrows were raised for her performance in the recent VMA awards, she had a hit single, The Climb which I used for this video to express my unwavering hope for a visa for me and my children. I did this video at the time i learned my application was refused 9 months before (ye, read it right!). All the top MARA agents in PomsinOz and Bristish Expats forums told me I could never get a visa because DIAC will never admit their mistake (i found a window of opportunity to contest the refusal, 175 has no right of appeal). It was only I who believed that we are still going to get our visa. I proved them wrong. With my steadfast faith, tons of prayers, and lots of hard work, by God's grace we are now on our 3rd year in Australia as PRs. Don't lose hope. Miracles still happen.

    negligence ng agent ko. at that time na inaayos ko ang documents, nagkaron ng changes sa ruling. prior to Sep 2007, pedeng magsubmit ng application without IELTS. pero nun sinubmit ng agent ko in Dec 2007, di pa ako nag IELTS nun. narealise niya siguro later na, kaya nun dumating ang refusal di niya sinabi sa akin. Nalaman ko lang after 9 months. Pinagaralan ko mabuti ang refusal and I found a window of opportunity dahil me mali ang DIAC sa application date ko. yun ang nilaban ko na sinasabi ng mga top MARA agents na di aadmit ng DIAC ang mistake nila. But i made DIAC turnaround their decision. Here is part of the CO's email to me :

    I have therefore determined that the application was lodged with the
    incorrect lodgement date and hence, based on the information provided by
    the applicant after the refusal decision, it s found the decision to refuse
    is unlawful.

    This decision to refuse this application has therefore been vacated. The
    result being, at this time, the application remains under consideration and
    has not been decided.

    @bananapeel if I remember it right, your application was paper-based di ba? Alam ko nga na your age was one of your concerns that time. All along, I thought that your application was denied until nabasa ko nga yung mga posts mo dito. And I am happy to know na 3 years na pala kayo diyan sa NSW.
    Kami nga, we almost gave up. We applied in 2008, tapos naging last sa priority yung profession ng wife ko. Sina escaussie na ka-batch ko settled na diyan samantalang kami naghihintay pa din ng visa. But God is so good. After almost 5 years, eh na-approve din last April. Yun nga lang, tumanda na din at pumuti na ang buhok sa kahihintay. Hehe!

    @sticky note...same batch pala tayo ng visa submission June 2008 dn ako. Tanda ko 8-Sept 2010 nag email ung migration agent ko na may bagong rules ang DIAC at un nga least priority na at mapro process daw in 2 years, nawalan na dn ako ng gana but somehow may nagtutulak sa kin to check online ung status ng visa ko the following week nagulat ako kc biglang nag change ung status like ung evidence of related work experience, english ability, naging "met" na. Nag email agad ako sa agent ako para i confirm kung may CO na ko, ayun confirmed na meron na ngapinaulit nga ko ng medical kc nag front loading ako inabutan ng expiry pati ung police clearance tapos un Oct 2010 na visa grant :)

    hello batchmate, hehehe :) oo nga natatandaan kta non sa philippines.com.au hehehe lagi kc ko nagbabasa non nung active pa sya pero d nga lang ako nag po post :) so far OK nman po at happy nman po dto sa melbourne, mag 3 yrs na dn po dto. Saan nyo po state balak mag settle? Buong family po ba kayo?

    hello. i don't want to dampen your spirits. maganda pa din dito compared with the life in the philippines. pero madami ng changes and it keeps on changing. sa benefits na lang madami na nagbago kumpara years back. like yung mga baby bonus lumiit na ng lumiit. yung first home grant, dati kahit anong property ang bilin mo basta first time home buyer eligible ka. now, for new construction na lang. yung mga ganun. sa employment naman, madami ng jobs ang inooffshore going to India and Manila. Madami na ding nagsasara like Ford, Holden. I work with one of the biggest insurance companies here as a perm employee, we're in 47 countries, dati 14000 employees. since 2011, inoffshore na unti unti. the most recent one, ang Finance where I belong, pero before the announcement, nakakuha ako ng secondment role in one of the subsidiaries. Kaya nung magannounce ng redundancy, inoferan agad ako ng perm role so di ako naredundant. majority ang operations ng Finance, dinala na sa Manila. Pano 1:7 ang ratio. salary ng 1 tao dito, para sa 7 tao sa manila. based on reports nasa AUD250M ang savings. Pati ang IT namin, halos Manila na rin lahat. Di pa tapos ang transformation, till 2015 daw global. one former colleague sa Finance, walang makuhang job sa Sydney kaya nagmove sa QLD. kahit sa retail affected. tama ang nabasa ko last year, baka in 5 years, extinct na ang accounting dito :( ang magandang work yung di pede iofshore like nursing aides, teachers, home carer etc. tumawag ka sa phone companies ang sasagot sa yo Pinoy kase call center nasa pinas na din. Even banks. Here in Sydney, masyadong mataas ang cost of living. median price ng properties going to 700k na. kaya sabi sa news, marami ang forever renters na lang kase di afford to buy. sorry but this is what is happening. pero sabi ko nga, mas maganda pa din dito. i had my triple heart bypass last year, wala akong binayaran. me private insurance ako kaya naka private hospital ako pero kahit wala sagot pa din ng medicare public hospital nga lang. tama ka sana manalo ang karapatdapat para gumanda ang buhay dito. sorry kung di masyadong good news ha... pag nagsearch naman kayo, malalaman nio din ang reality....

    kaya kung anong meron ako now, ok na ako. kahit di masyadong mataas ang pay, ok lang. my office is 8 mins away from home. dati sa city ako. enjoy ko na lang while it lasts. anyway, i'm single, my 2 kids are both grown ups. at least walang pressure :)

    tama si @Obi, take it as a challenge. sabi ko nga, mas maganda pa din dito. karamihan naman sa new migrants struggle ang pagsettle with all the adjustments. pinoys adapt to change parang bamboo tree kayang sumayaw sa ihip ng hangin. resilient kase tayo by nature and we will sacrifice whatever it takes especially for our families. :)

    I'm an optimistic kind of guy, i tend to block off negative vibes, even when im doing really bad. regardless, i think what bananapeel is saying is to prepare for the worst case scenario., that way, when we've all finally migrated and situation gets bad we are prepared for it.

    when my family and I did our initial entry, ofcourse it was more of a holiday yet in the back of my head, if talagang totoo na., i have to consider 1stly is funds....what if its hard to find a job? and we are racking up expenses...and savings start to go low, whats next? eh walang mga kamag-anak doon na auntie or mommy or daddy, pahiram naman dihyan short ako., wala din 5-6 bombay hehehe.

    also to add: the new prime minister i hear has different views on running a country., so, things like baby bonus, overtime pays, first homebuyer grants etc., might be affected.

    my two centavos yo!

    It's important to remember that, like anything else, negativity is relative and what may seem negative to some, may be something totally different to others. Just like viewing a white paper with a speck on it. See the speck or see the whole paper. That simple. It's a choice to be idealistic or realistic. Whatever works for you will see you through in tough times. If you sense negativity around, so be it. Negativity isn’t a bad thing. Negativity can be a motivation. It’s how you choose to respond to it that makes it what it is.
