Defacto partner still married..Is it advisable to include him in my EOI (189&190)?

Need advise po!

Eto po yung case ko.I'm the main applicant defacto po yung status ko sa recent Eoi na sinubmit ko for 189 and 190. Sinama ko po yung partner and anak po namin as dependent (migrating). My partner po is still married but ongoing ang annulment.We've been together for 7 years. Ofw po sya so once a year lang sya umuuwi dito sa amin. We never lived together in the same house. Wala po kaming sariling bahay nakatira lang po kami sa bahay ng parents ko. Wala din po kaming joint account pero every month po sya nagpapadala sa account ko po.

Ang tanong ko
1.) Tama po ba na sinama ko siya(my partner) sa EOI pa lang?

2.) Or Pwede kaya ako na lng muna mag apply then if ma grant na PR ko I will apply for him a spouse visa?

Takot kasi ako baka di ma approve yung PR visa dahil not enough yung evidence na ma provide namin in the future based sa complicated case ko.
