Including partner in your visa application

Hi sa lahat..I'm new in this forum..may question me regarding sa pag include mg partner sa visa application..
Naglodge me ng visa last June under employer sponsored..bale I'm here in Australia for 5yrs now..Pero recently Lang ngpunta un partner ko..bale de-facto ko cya..she's holding a 457 visa under my visa..
Kso married kc Ako s pinas but matagal n kme hiwalay..ngyn hinihingi ng agent nmen un marriage certificate ko from my ex-wife..
Ang question ko e do we really need to provide my marriage cert? And will it affect my partner?

May Alam po ba kyo na ganitong case?
Sana po may mkapag enlighten nman smen..thanks po

    ..actually nkuha ko din nman cya papunta d2 sa oz bilang de-facto..

    Bale 856 ung visa na inapply nmen..but right now e we're still holding a 457 visa..

    Nung kinuha ko cya under my 457 visa e as de-facto na..Indi nman cya hiningan ng cenomar..
    actually dati din e hinihingi ng agent nmen un certificate n tlgang hiwalay n kme ng ex-wife ko..Pero sabi nga nmen e mahirap mkakuha ng annulment s pinas at wala din divorce..kaya nga kako e de-facto ang inapply nmen..

    ayun..naging positive nman..

    hi sa mga ka group, mag ask lang ako sa inyo sir, if nagpasa ba kayo ng kopya ng previous nso marriage certificate nyo nung kinuha nyo yung de facto partner nyo kahit di pa kayo legally annulled nagpasa pa rin po ba kayo sa embassy? same problem din kasi sir ako, ako legally married pa kahit 6 years ng hiwalay, kinukuha ako ng partner ko na australian we've been together since 2010 and lived in Australia for total of 1 year nag tourist po kasi ko don and now have applied for a defacto provisional partner visa 309 and yan po yung acknowledgement letter ko eh nagrerequest other than the medical nagrerequest din ng nso birth and if previously married copy of marriage cert with annotation of annulment or divorce which is wala pa nga annulment. Ok lang po ba magpasa ng NSO marriage cert without any annotation for annulment dahil nirerequest nila yung previous marriage cert? thanks po sa pagshare ng ideas.

WIll it be possible for him to be included in my application? de facto ang idedeclare ko we have been living together for more than 2 years already and our baby just turned one year old. Mejo natatakot kasi ako na magproceed if di ko naman sya maisasama :( thank you po sa mga sasagot. btw im not claiming any points from him.

    @steve211 - sir basahin nyo po ung start ng thread saka ung link na binigay..
    based po dun mukhang naging okay naman ang result ng visa nila kahit na hindi pa annulled/divorce ang previous marriage..

    mukhang wala pang masyadong naka experience ng case nyo dito sa forum.
    kaya wala pong makapagbigay ng concrete answer..

    i guess kailangan lang po malinaw ang situation nyo sa case officer..
    previously married kayo, pero hindi pa annulled/divorce, kasi nga mahirap talga yan sa pinas..
    at kaya nyong patunayan ang current de-facto relationship nyo.. un ang importante..

    based on your statement, im guessing you are applying for a skilled migrant visa.
    kung oo, then walang problema kung gusto mo isama ang anak mo (from a previous relationship) at ang current partner nyo..

    you can declare your partner as de-facto relationship.. you need to provide some doc/statement to prove your relationship...and of course he has to satisfy other requirements (english, medical, police check).. see this thread.. read from the start..

Never kung ginamit and family name ng ex ko..lahat ng identification ko still gamit ko sa pagkadalaga,,nakapag tourist na rim ako sa partner ko now sa australia at nilagay ko sa application is never been married,,now plan namin mag apply ng de facto visa...concern ko is titingnan kaya nila previous form ko? If ever na i dedelar ko na kasal ako this time..worried aok baka mag ka conflict..or paninindigan ko nalng talga na nver been married me..plez help anyone..much appreciated..god blees

    1. If you are a dependent, you get the same visa as the person who declares you as his/her dependent. There shouldn't be any effect on your subsequent visa applications provided that you abided by the rules of your 457 visa (e.g. didn't overstay etc).

    2. Since 457 is just a temp residency visa, I'd suggest that you apply for a skilled independent visa na lang (and have your partner as your dependent) if you feel that you have enough points to qualify for an invite, para permanent residency na agad. Given how Australia changes its migration policies yearly, if qualified ka na for a PR visa now, go na.

    @Allysond..No, it will only take a month.. Mabilis lg pag ok na lahat ng requirements. Kung minsan medical lg ang ngpapatagal.

    06-01-11: Arrived Australia (457 visa dependent on my dad)
    28-05-12: Lodged RSMS 857 visa (seperate from my dad already)
    28-06-12: Done Medical check
    30-10-12: Submit AFP check
    07-11-12: Went home on a bridging visa B for holiday and wedding..:)
    12-01-13: CO allocated and nomination approved
    18-01-13: CO asked documents of my husband to be included on my application as migrating dependent..Thank u LORD!
    15-02-13: Husband completed all requirements (police check, medical, english requirements and joint statement)

    Plan kasi naman by march 15 flight ko so sana marelase visa before nun,.

    @Allysond..Just wait for your CO, he/she will be the one to give you a referral for medical. As long na complete na lahat ng requirements grant na lg agad yan.

    @Allysond, hirap namn kasi malayo sa asawa ehh..so dapt lg talaga na pumunta ka ditto. Yes, mahal ang cost of living. Pero pag dalawa kau ang my wrk at wla pang anak, malaki talga ang ma save mo compare sa Pinas. Sa paghahanap ng work tyaga lg ang kailangan at dapt wag muna maging choosy..

    Yap nakaset na sa mind ko na hindi ako magiging choosy, my plan naman is magsimula sa baba since nasa ibang country ako,..ang usapan kasi ng husband ko if d ako susunod dun e uuwi n siya kaya no choice kundi sumunod dun kasi mas better yung opportunity para s aming dlwa,

    @Allysond..Yeah, that's right much better ang opportunity nyo ditto. At isipin mo maraming kababayan natin ang ngkakandarapa na mkapunta dito, tapos sau sasayangin mo lg ang chance na mkapunta dito sa medaling paraan. Ung iba ilang libo ang ginastos eh pra lg mkapunta dito. So saying talaga pag indi mo e grab.

    I'm working in an aviation company at dito ako sa Broome WA.
