475 Visa_ Secondary applicant

Hi po pede bong mag tanong kong may case na nauna mag entry ang secondary applicant.
Secondary applicant po kase ko 475 sa Mandurah ang punta nmen.. but sad to say mauuna ako kase separated na kame ng hubby ko (but not yet legally separated) balak ko sanang mauna this Aug or Sept and worry ko lang baka masita ako pag pasok ko kase alone nga ako at secondary lang. Meron bang case na ganito na pedeng pumasok muna ang secondary?

hmm tiningnan ko yung visa ng wife ko ang nakalagay "permitted to remain in australia for 3 years from date of first entry of the primary applicant".

Reply to @kellymacato: Pwede namansiguro na papasyalin mo muna yung Ex Hubby mo dun sa WA para lang maka enter na kayo agad kung di pwede yung scenario na yung secondary ang mauunang pumunta ng Oz.

Lam ko d pwede mauna ang secondary. Sa akin kc when i was granted may kasama sya na frequently asked question at isa dun kung pwede mauna ang secondary,sagot dun NO. Kc ang visa ng secondary was approved base on the primary applicant.

@kellymacato They are right. In our case ako yung main applicant and my husband is the secondary applicant. On our visa grant notice, they specified that one of the conditions in his visa is: 8502- Must not enter Australia before specified person. The holder of the visa must not enter Australia before the entry to Australia of a person specified in the visa.

hi tanong ko lang nakapasok na kse ung primary so pede na ako mag entry diba? hindi pa ako mag question sa immigration?

I think ok ka na mag-entry. Yun lang naman restriction ng visa mo e, dapat sabay or mauna mag-initial entry yung primary. Hope this helps.

hi, may tanong po ako, nakapag entry na kme last week at wala nman naging question samen kse nakapasok na ung primary nmen last 2 months. ang tanong ko is what if wala ng balak bumalik ang primary? mag kakaproblem ba ako in the future to apply PR samen ng baby ko? hope to hear some advise. thanks

@kellymacato - isa isahin po natin:

Issue 1: may obligation clause sa 475 about the primary/dependents should live and work in the regional area, tapos pag hindi na-satisfy, hindi magiging eligible for PR application..
- i've read in some discussions na pwede naman maging PR applicant ung 475 secondary visa holder, assuming ma-satisfy ung requirements (work and live in regional area)
- so kung magwowork ka fulltime, at ma-satisfy mo ang mga obligations, then pwede ka mag apply for PR (as the primary applicant)
- pwede din magpa-sponsor through an employer

Issue 2: Primary visa holder not in AU
- the visa was granted on the merit of the primary applicant.. and technically kung naging invalid na ang visa ng primary, the same applies for the secondary/dependents
- now, this is the main issue... im not an expert.. but im thinking if declarations (on both sides) can be presented sa PR application mo, as evidence na hindi na on-going ang relationship ng primary at secondary
- baka maging main issue din ang entry dates, dahil nauna sya, sumunod ka, tapos hindi na sya nag-stay...

Again, my opinion, there are other pathways:
- pwede din magpa-sponsor through an employer
- or apply as indepedent skilled migrant (through EOI/Skillselect), advantage is you have lived and worked in Regional AU, so mataas ang points mo dun sa work experience..
- kung wala sa SOL ang skills mo, then mag-aral ka muna ng mga in-demand skills
- marry an Australian PR/Citizen

Wow ang daming options pero nakakatakot din talgang sumugal. Best way cguro is mag pa sponsor ako sa employer?
Isa pa may brother ako sa Mel na mag PR na this feb I don’t know kng pede nya ako sponsoran lalo na kng wala namn sa SOL ang skills ko.
Hayz. Or pede din ako file ng abandonment sa gov na primary abandoned us?

magiinitial entry na ako...but i dont want my ex wife to go to oz...for reason so personal na nakakainis...ano ang dapat kong gawin?

pag hindi sya nka pag initial entry, magiging void ang visa nya (as secondary applicant)..
so kung ayaw mo isama, hayaan mong mag expired ang initial entry nya..

hi ang alam ko basta naka entry ka na eh pede na syang mag entry din at mav stay dito.. kase ako secondary din dba? pro eto ok na ako dito mag apply na ako ng PR ko next year

@dhey_almighty hmm why don't you try informing immigration about the breakdown of your relationship?yan eh kung gusto mo talaga macancel yung visa niya since secondary lang naman siya and she was able to get the visa because you're together. Since nagbreakdown relationship niyo parang in a way may change in circumstance na. Opinion ko lang naman yan.

@dhey_almighty naalala ko pala ung ex ko dati eh he wants to cancel ung visa nmen mag ina.. ang sagot ng agent nmen sknya is he needs to pay i think $2000 aud pra ma cancel lng ung visa nmen. But check na din sa immigration to be sure.
