Dependent's Medical condition

Hello mga Sir and Mam,

Galing po ako sa isang registered migration agency. As per assessment nila ay confident nman daw to achieve the required points. Kaya lang nung nasabi ko na may Down syndrome ang bunso namin, bigla siya natigilan at i-double check nya. Pagbalik nya "I'm sorry sir, but your application will be refused due to your son's medical condition". Nanlumo ako dun....

And so, I'm here. Gusto ko sana malaman ung totoo, kung bound for refusal ang medical condition ng applicant na may Down syndrome. Although may inquiry na rin ako sa DIBP tungkol dito. Pero sana makakuha rin ako ng information through your experiences.

    @zndr it's my first time hearing about this, did some research and found this article http://www.news.com.au/lifestyle/real-life/baby-gammy-isnt-the-only-one-the-ugly-law-shaming-australia/news-story/02b91be7758e5090c03e50910a7391c6 and saw another article about Canadian immigration too. All I know is that immigration is strict about Active TB, I think regarding this you really should wait what DIBP says.

    Hello @guenb, thank you for sharing this info. Binasa ko xa at naging masaklap ang laban ng pamilyang iyon. Pinalad pa rin silang makakuha ng PR pero hindi nito nabago ang batas. Sa tingin ko kailangan ko pa mg-inquire sa ibang NGO's sa Australia about this issue. Thanks for your time doing the research, I appreciate it. Sana may iba pang makabasa nito at baka may maishare na information para makakuha ng PR.

    I read previously sa isqng article about isang indian n RN n may anak n may congenital disorder. They were applying for PR visa also. What they did was sign a declaration stating that all expenses relating to the care of their child will be shouldered by them and not through the health care system (Medicare/centrelink) do basically they could not apply for any carers benefit and/or medicatlre if incase magkaka sakit yung anak nila.

    as far as I am aware n grant yung visa nila. you might need to do more research on this and weight if this is a feasible option for you. kasi if wala kang medicare at di k eligible mag apply for centrelink..ang mahal nang cost of hospitalization dito may cost you thousands to a hundred dollars...kaya pagisipan nyong mabuti.m

    @tooties, Thanks for sharing your insights. A waiver or declaration, hmm, yun nga kc ang iniiwasan nila, ang gastusan ang dependent na may medical condition. Sigurado need ng mga legal advisers or officers para ditto. Our 4 yr old son's condition is Down syndrome, over all health, wala nman major problem, delay lang sya sa kanyang development as a child. cguro mga 1-2 years behind delay nya. Yes, I need more reliable and factual information para makasiguro. Kasi ung agency mukang di nako I-entertain, ayaw siguro nila mag-risk. Wala pa rin reply ang DIBP sa enquiry ko. I'm still hoping na baka may paraan pa...Salamat ulet..

    @zndr Hi, Tama yung agency.
    If you are applying for PR almost guaranteed that your visa will be refused. Its like 95% it will be refused. But, I say 95%, coz you still have a 5% fighting chance. How to get the 5%?
    Prove to the Australian Medical Officer that your child will not require any of the ff:

    Special education services
    State disability services
    Commonwealth disability services

    Meaning, need mo gumastos ang additional $$$$ so supplement your application. Provide documents from psychologist, development pedia. therapist, etc.

    Pwede mo try i contact si gorge Lombard . Meron silang risk assessment na around AUD$300 ata to determine if its wise to pursue your application.

    Based on experience po to. pero under waiting game pa ko...Hoping na kasama ako sa 5% na yun. Case ko kasi, my dependent has learning delay :(

    another info: All disability law are waived during migration process...so basta me disability ka na mag fall the disability benefit nila, its almost guaranteed refusal. unless you can prove otherwise.
    Sa PR po, visa 189,190, wala pong health waiver na ino-honor. meron kasing ibang visa na me health waiver like , Child dependent at parents visa. pero, I think you are aiming to apply for 180/190 visa... thats the sad truth :(

    @mharcute, it's been a while, nag lay-low muna ko dito sa forum dahil nga sa issue na ito ng bunso ko. The 5% chance ay sapat na para magkaroon ng pag-asa. pero sa case namin, d namin kakayanin ang gastos, so palagay ko, tatanggapin ko na lang yung other 95% na refusal. Although, I have other option, visa 457, mag OFW na lang daw ako. tas' magvisit na lang daw family ko sa'kin. Kaya ngayon, work abroad naman tinitingnan ko.
