186 Direct Entry Question

Hello po, we are currently on a 482 with a regional employer as a Registered Nurse. They wanted to sponsor our PR and I have read that 186 ang visa for that. My question is there are 2 types (actually 3) of streams we can take. We can go for TRT but our problem is less than 2 years pa lang kami with them. Can we apply for a 186 Direct Entry if currently employed kami with that employer on a 482 visa for 1 year +++ now? Thanks.

    Hi @jcabz sa pagkakaintindi ko kase, ung ENS 186- Direct Entry can only be used by applicants who do not fall under the other two stream Labour Agreement or TRR Visa, which is what you are qualified kase may existing TSS visa ka. Yung DE stream is only for those na walang current working visa. Mawawalan din kase ng saysay ung qualification ng TRR Stream kung iba-bi-pass at pwedeng mag DE stream nlng. This is my understanding, pwede mo i-confirm sa migration agent, usually may free consultation nman ung iba. I am applying din kase sa ENS DE as Accountant nman, so feeling ko ung qualifications mo, hindi tutugma sa DE although you may have passed assessment. My concern is yung qualification or eligibility mo which I feel mag-fo-fall under the TRR Stream.

    Thank you po for this. Yun nga yung nakakalito rin kasi base sa immi site ang difference lng nila is ang skills assesment tpos ang qualification is as long as may Visa . Whatever happens ok lng naman din maghintay kasi sa sept na mag 2 years. Iba lang kasi sila ng processing times. Salamat po.

    Oo nga, mahal din kase ung visa application, kaya kapag nadecline dahil sa eligibility sayang nman. intayin mo nlng cguro para sigurado, or you can still conduct further research kung may na-grant ng DE with existing visa. Mejo matechnical kase ang DHA. Pero health industry realated nman ung job description nyo kaya for sure malaki ang chance nyo maging PR talaga in the near future. Laging may need ang AU sa mga katulad nyong nurse. Goodluck and all the best saten hehe.

    Yes, you can apply for DE 186 straight away. I was on 482 and lodged the PR application within a year. DE is meant to bypass the TRT stream. They have different requirements. The skills and experience that you will gain in the 3 year temporary residence is assumed you already have it in case of DE.

    Oh its good to hear na may positive responses nman pala sa ENS-DE kahit covid. @Bi27 kelan po nanominate? magsesend palang ung employer ko ng nomination for me next month, sa ngaun inaayos palang ung documents. sana mabilis lang ang process.
    Alam ko yes kapag may assessment na (I assume may english test nadin) and nomination # ng employer, pwede na i-lodge.

    by the way tanong ko lang po @Bi27 @cucci and anyone na may idea or experience. 1. kaya ba kung DIY lang ung ENS application? Willing ung employer mgsponsor pero not to the extent na magbabayad pa sila ng agent or immi lawyer to process. sa side ko nman, alam ko nadin ung mga docs na kelangan ko. Yung nomination lang nila ang diko sure if they will do it themelves nlng. 2. Mahirap ba patunayan ung pagsponsor/nomination, the fact na madaming laid off sa AU ngaun? My profession is accountant sa isang health clinic, so growing yung business nila kaya they need an Accountant.

    Maraming salamat po sa mga sasagot or makkpag share ng experiences nila. Thank you

    DIY mo? Currently employed ka ba nila as accountant or offshore pa? Pag currently employed na, pwede kasi you will need access to internal company info na need to justify sponsoring a current worker into PR... if offshore pa and not currently working for them, I am not sure kung paano mo magagawang DIY.

    Hi @cucci offshore pa ako eh, finafinalize na nila ung contract ko. target na magstart ako is October. I know how I can lodge ung ENS-DE application ko and I have all documents. Ang diko lang sure kung sila na ang magsasubmit ng nomination, malamang. kaya parang nangangapa ako, ayoko nman kulitin haha. curious lang ako kung may nakapag DIY na sa ENS or usually may agent talga.

    Diko lang sure kung mahigpit ngaun sa Labout Market testing after COVID. Pero nakaka-basa nman ako ng mga success story despite of COVID.

    Hi. I was on a 457 working visa RN. ng lodge ako ng DE 186 1 month before ako mag 3 years sa work June 4. Medical 29th of June. Contacted 3rd of Sept for another Australian police clearance because I included my middle name. Submitted it on 15th of Sept and granted it the next day 16 Sept. So I think wala nman difference ung TRT at DE.

    Unfortunately, walang health waiver provision ang 186 DE meron. Ang 186 TRT stream meron. :)

    Meron na po ba dito nakapagprepare ng Genuine Position report and Business Plan for the nomination requirements? Or may kinuha bang 3rd party ung employer nyo to prepare the reports/documents needed to submit? Also, kung via DE, tama ba na Genuine Position Report can overide LMT (Labor Market Testing)?     DIY lang yun sa ENS Sponsorship namin, naapprove naman. Di ako involved sa application process nila. Kasi may mga financial statements na need nila i-upload. Binigay ko lang sakanila yung requirements as listed sa immi. Sinabihan nlng nila ako na nalodge na with the TRN.

    Although, lucky ako kasi naaprove yung application ko kahit iba yung Nominated Occupation na nilagay sa Sponsorship vs sa assessed occupation ko. Napansin lang namin nung naapprove na yung sponsorship(6 months) eh na-lodge ko days after nila mag lodge.

    So kung mag DIY make sure na idouble check mo yung application bago nila i-submit.

Bale ung employer po ninyo eh hindi nagpagawa ng documents? or kumuha ng agent? tinutulungan ko na kase ung employer ko sa mga documents dahil busy din sila kaya I was trying to see if meron ba dito na may template or guidelines sa paggawa ng Genuine Position Report and Business Plan for Migration, un po kase ang kulang ko? Plan ko ako nalng maglodge ng visa application ng family ko pars tipid, di na ako kukuha agent. pero ung sa nomination ng employer ko lang ang concern ko ung documents.

    Did my 186 DE on my own but that was way back 2018 pa. Once the employer/sponsor has done their part and your docs are complete, it was relatively fast... granted in 2 weeks... some even less.

    No di sila nag Hire ng agent. But I don't know how they created the documents they uploaded.

    Thank you @cucci that gave me the confidence to lodge our own visas nlng, laking tipid din sa agent fee.

    @aanover siguro may experience na yung employer mo dati to sponsor kaya mabilis nlng yung documents nila. Yung saken kase first time, kaya pati ako concern sa nomination nila kase mmaya mali mali mga documents na masubmit.

    Yun employer ko happy ako sponsoran ng 482 TSS, pero nalaman ko sa colleague ko na pwede ko daw applyan yun 186 DE basta naka 3 years experience na ko. Ano po ba basis ng 3 years experience? Ang sabi kasi ng agent na nakausap ko mahirap daw ang 186 DE dahil need full time = 38 hours a week ang requirement. Sabi ko naman sa contract kasi 'part time' lang nakalagay sakin pero working naman ako ng 34.5-38 hours a week (kasi 3 nights & 1 PM shift minsan 4 nights a week). I can show him the statement of service and paylips pero ang negative po kasi ng dating ng response niya sakin sa kagustuhan ko applyan ang 186 DE. Para po sakin kasi kung eligible naman ako, mas pipiliin ko yun kaysa mag 482 pa.

    Kung sakaling hindi po talaga ako pwede sa 186 DE dahil kaka complete ko lang ng 3,952 hours as an RN. Yun 482 po ba kailangan ko pa tapusin bago ako maka-apply ng 186? Sabi kasi ni agent depende sa employer if happy daw sila sa 186 DE. Ang sabi naman ng HR namin today basta complete ko daw ang requirements, ako na bahala. Maraming salamat po!

    @goku_son Maraming misinformation about 186. May iba't ibang stream ito. Ang direct entry ay hindi nangangailangan na mag stay ka ng 3 years sa employer mo. Nag apply ako ng 186 makalipas ang anim na buwan lamang sa ilalim ng 482. Kailangan mo lang mameet ang requirements. Inaassume ng DE na meron ka ng 3 years experience or more. Ang 3 years requirement sa ganang akin ay para mapatunayan mo na competent ka sa propesyon mo.

    Sa temporary residence transition stream (TRT), ito yun from working visa to PR. Ang sabi rin sa website ay “ Usually, you must have worked for your employer full-time for at least three years”. Sa case ko, 6 months lang ako sa employer pero sa labas ng OZ ko na gain yun ibang years ng experience. Sabi rin dito ay full-time. Kontrata ang pinapasa sa immigration so hindi papasa na part-time ang nakasaad sa kontrata mo kaya ito dinecline ng agent.

    Walang kundisyon ang 186 na matali sa employer. Ito ay nasa saiyo kung tatanawin mong moral obligation mag stay sa kanila or kung may kasunduan man kayo.

    Ang kagandahan sa Australia, napaka transparent at available ng information sa mga websites ng gobyerno. Kailangan lang basahin at intindihin. Ito ang dahilan kaya maraming nakakapag DIY at may forums din. Good luck!

    Thanks sa pag sagot. Naka apply po ako ng 189/190 nun November 2019 pa with 75/80 points. Kaso wala pa rin invite until now. Nakaka 15 times na din ako take ng PTE, hindi ko pa rin mapasa.

    Kaya good news saken tong sponsorship, sana ma work out po.

    Salamat po sa pag-sagot. Nakapag basa2 na din po ako kaso confusing kasi yun binibigay na hours saken sa nursing home 34.5 or 36 hours a week lang eh ang sabi ng agent, 38 hours daw dapat. So kahit sa 482 hindi na ako eligible? Saka po pala nabasa ko may iba klase ang 482 may short at medium stream. Alin po dyan ang makaka help saken mag proceed sa 186? Yun medium stream po diba? Para masabe ko na din sa agent at employer na tulugan ako.

    @SAP_Consultant Sorry follow up question lang po pala. Yun 186 DE pwede ba DIY or kailangan din ng agent? Kinakabahan po kasi ako na baka i-turn down na ng employer yun pag assist sakin sa 186 DE kung months lang ang pagitan ng pag assist nila sa 482. Naka student visa po ako ngayon pero kausap ko na yun agent na mag assist sakin. Iniisip ko kasi ituloy nalang sa 482 kung alanganin naman working hours ko then papa-help nalang ako sa same agent sa 186 DE kahit ako na po mag bayad ng process if umayaw na yun employer. Possible po ba yun? Kailangan ko lang masigurado na yun 482 na ma-apply sakin pwede mag proceed sa 186, tama po ba?

    Basta nakikita mo yun visa type sa immiaccount mo, pwede ka mag DIY. Meron na ditong nakapag DIY ng 186. Backread ka lang ng ibang posts.

    DIY man o may agent, mayroong mga dokumento na kakailanganin mo sa employer mo. Kailangan ng nomination galing sa employer mo. Hindi ito basta basta DIY inaapplyan tulad ng 189/190. Tinanong mo na ba ang employer mo kung willing ka sponsoran ng 186? Sa kumpanya namin managers and above lang iniisponsoran. Klaruhin mo sa employer if payag sila mag 186 kung sakali.

    @goku_son , pwede DIY or agent. Ask mo muna si employer if willing sila mag sponsor ng 186. Need mo ng help ng employer mo kasi no-nominate ka nila at may mga documents for submission.

    Ano ba unang usapan niyo ng employer? 482 visa diba? If yun ang inalok sayo at hindi 186, kunin mo na muna. Saka mo iopen ang idea ng 186 visa pag employed ka na.
