    Hi all,
Anyone here having 491 NSW visa? Just want to check lang if allowed ba tayo to work and live Canberr. Kasi sa list of regional areas ni NSW kasama yung Canberra but then part sya ng ACT.
We are planning to the big move around Aug this year though we got the grant last 28 Dec 2023.

    Thanks in advance.

Hi, we have 491 visa nominated by ACT. Kaya sa Canberra kami mag stay and mag work. It is regional.

Thanks for the info, just wondering if pwede ako sa Canberra kahit 491 NSW visa ako since sa list of regional areas ni NSW nandun yung postal code range ng Canberra

The list covers only the post codes under NSW. Canberra falls under a different state. Technically it is DRA but under ACT.

Hello! For those with 491 visa who recently had their big move, anu-ano ang need ipresent?
    PH

    • passport
    • visa grant
    • boarding pass

    AU

    • passport
    • visa grant

Since di need ng 491 visa holders to get CFO certificate, did you email CFO to confirm? Di ba hinanap sa Immigration ng PH and AU?

Do you still need to show covid vax certificate? Did you register your covid vax in the AU Immunisation Record? If yes, can this be done in advance?

    TIA!

3 months for us kasi hinabol namin yung start ng school year dito

Hi po I came across your message here, and question lng po sa experience nyo with schooling.
    1. Paano po ang naging transition? Did your kid/s stop attending sa current school and simply continue with the same grade/level in the new school in Australia? or depende sa assessment.
    2. Sa state school po ba o private nyo sila ini-enroll? Naaccept po ba un curriculum ng Deped?
    3. Ano-ano po ang mga hiningi ninyo sa previous school na documents at need pa ba ng authentication para dito?

Any advice po you can share would be greatly appreciated.

    1. Our visa was granted right before PH schoolyear started, so we didn't let them proceed na. We would be required to pay for the whole year kasi even if they attend a semester. Yung year nila that they were supposed to start in PH, doon din namin sila inenroll for this year (AU school starts Feb). Some schools will allow new students naman even in the middle of the year and let them continue the same level or even proceed to the next one na. I hear stories from my relatives na ahead ang topics in PH so di nahihirapan ang kids to adjust.

    2. We went with a Catholic school. It's not entirely private kasi Diocese ang nagpapatakbo. It's not free but not too expensive as the independent schools. Di sila ganun ka strict with curriculum but the school may opt to assess students. It varies with the school so it's something you can ask them.

    3. Yung nirequest lang namin from the PH school was transfer credentials which is parang transcript of records lang nila. Normally naka dry seal yung document.

Hello, saang state po kayo? I thought January ang start ng schools sa Au. And also, yung Catholic school po ba need na within catchment din like sa mga public schools? Around how much po ang tuition, if you don't mind? TIA!

Hindi kami hinanapan ng CFO cert. I think alam na nung IO na di applicable sa 491. Though nag ready pa din ako ng print out nung email from CFO (someone posted a screenshot here in the forum). Niready ko din yung COVID vax certs pero di din naman hinanap even here in AUS.

NSW. It's usually end of January, but for this year, sa Feb 1 ang pasok ng kids namin. AFAIK, sa public schools lang applicable ang catchment areas though it may depend on the school din. Tuition depends din on the schools, but they publish it naman so you can check. Meron din sibling discounts as much as 25% pag 3 kids.

Hello, do you have a contact number of Medicare where I can follow up my application? Thank you.

13 20 11. Best time to call is around 730am in the morning.

Just to share, a few weeks ago I followed up our application, ang sabi nila is nasa August applications pa lang yung pinoprocess nila.

I called again this week and told them I needed the Medicare number for our private inaurance. Ayun, naprocess na nung agent pero it took 2.5 hours on the phone (5 kasi kami in the application).

Thank you sa info. Ang tagal pla talaga. huhu. I applied last Oct 26 via email, no update until now. I also tried the online application, and still no update until. I went to the medicare office and they can't help me as well. huhuh.. I'll try again calling during that time.. Thank you for this.

Hellol! PR ka naman ano? So, you applied twice ba? Nag apply ka by email, then online application ka rin. Hmm those might clash.

Online applications are usually faster than email, or even the paper onsite application. Just keep trying on contacting them. Sobrang unfortunate lang nangyari sayo.

DIY all the way. Avoid preachy, know-it-all, and unscrupulous agents AT ALL COSTS!

Hello! okay lang ba na maghanap ng work offshore (remote) sa AU while waiting sa grant? currently working for australian company kaso NSW , VIC kasi kami nanominate.. and under sa agency dito sa pinas yung contract sa NSW. Trying my luck to look for a job in Melbourne (hybrid or remote), para pag na-grant na may work agad dun.. Any violations sa visa condition? Thank you!

    Hello po,
Hoping to make the big move sa May/June. Question po- if current boss sa Singapore offers remote work & I Migrate with 491 visa leading to 191 visa, can this remote work for 3 years be considered taxable income (for NOA)? Or LOCAL (aussie) full time work lang Ang icoconsider? Salamat

Saw this attachment in another thread. For your info.

    https://pinoyau.info/uploads/editor/58/qnidqew6k5fj.pdf

In short, to answer my own question, remote work from another country Not counted for 191 visa.

Meron kayang similar document pertaining to remote work for those on 190?

Sabi po sa document " The employer of a subclass 491 visa holder does not need to be located in a DRA, but if the employer is foreign owned or based overseas, the subclass 491 visa holder may be required to provide evidence that remuneration is paid to the visa holder in Australia and income tax is payable in Australia."

Dapat po kung "foreign owned or based overseas" need mag provide ng "evidence that remuneration is paid to the visa holder in Australia and income tax is payable in Australia."

You mean look for a remote Australia-based work while you're in the Philippines? That itself, as far as I know, wouldn't violate your visa. I did the same thing while waiting for my visa grant but couldn't proceed nga lang with any of the opportunities due to my pending visa (at the time). It can be hard to find a job that accepts offshore applicants without a visa on hand already but doesn't hurt to try.

Oh, that's insightful. However, my situation is quite different. My current employer here in PH is actually a global company based in Miami. Although I am technically Manila-hired, I report to those in Miami and work remotely full time. I was wondering about 2 scenarios:

    1. If I can continue working for the role in Australia and be paid in my PH payroll while I look for a local job in Victoria.
    2. If they can hire me and be an AU employee considering that their Australian HQ is in Sydney and that my visa is a nomination from Victoria.

In both cases, I will still be working remotely and reporting to Miami while living in VIC. I know both of these require the company's approval but I am just looking ahead. I'm looking to know if any of these can be done before I actually bring them up to my employer.

    1. You mean if you can continue working in your current remote PH-based job while in Australia? Technically you can although I suggest to do some research on the tax implications (if there are any in the first place).
    2. Your company can "re-hire" you internally for an Australia-based position, yes that is a possibility. You mentioned the company's Australian HQ is in Sydney, if so will you need to report in-office? If fully remote naman, I'm not sure lang sa setup but I think okay lang na sa Sydney based ang company.

Thank you, currently working offshore for australia-based, direct reporting din sa Australia bosses, pero yung tax and payroll ko dito sa outsourcing company sa PH. If ma-hire po ba ako direct sa AU employer, pero work remotely as offshore, ang tax ko ba nun is sa AU na babawas? Wala bang violation sa visa since hindi pa granted? Trying my luck lang na makahanap para may nag-aabang ng work pag-BM namin. Thanks again!

wala naman magiging issue since unlimited work rights naman yung PR visa. nauna lang ako i-process even before I landed in Au. pagdating dun, apply lang TFN and bank account, then pede na magstart.

Visa is 190. Okay lang yon kahit Sydney ang HQ and Victoria nagnominate sakin?

If ma-hire po ba ako direct sa AU employer, pero work remotely as offshore, ang tax ko ba nun is sa AU na babawas? Wala bang violation sa visa since hindi pa granted? Trying my luck lang na makahanap para may nag-aabang ng work pag-BM namin. Thanks again!

Hmmm tingin ko if ma-hire ka directly ng AU employer and you end up working remotely, ang magiging sistema ng payroll mo is sa PH bank account mo and ang tax declarations mo sa BIR pa rin diretso (depende na lang if the company chooses to hire you as contractor, so self-employed ka and you would need to declare tax yourself, or if may PH office yung company). Since wala ka pa naman sa AU/visa and wala ka pang TFN or other requirements to be eligible for taxation sa AU, I don't think sa AU system ang implications because technically you would be a Manila hire pa rin.

Usually naman, in my experience at least, at some point during the hiring process the overseas employer will talk to you about the admin stuff.

You mean look for a remote Australia-based work while you're in the Philippines? That itself, as far as I know, wouldn't violate your visa. I did the same thing while waiting for my visa grant but couldn't proceed nga lang with any of the opportunities due to my pending visa (at the time). That's right. So long as one is part of a company in another country's payroll, there is no tax implications in AU. That is, one's money goes into, say, a PH bank account and shall be taxed there (read more on Double Tax Treaty).

Once onshore though, that's another story. Staying in a PH remuneration/rate isn't economical in the long run when living in AU at the top of it all. This is self-explanatory. And so, the option is just either cross-border internal company transfer if they have an AU counterpart or move on and look for another job to get paid in an AU bank account. Eventually, one will need a TFN or ABN if one chose to become a freelancer.

Take note though that this info is for outright PRs only.

For 491 holders, I am not too sure since I believe they are bound by a more defined set of rules when it comes to employment and eventual 191 requirement. I think they can enter into similar remote work arrangement so long as the get paid in AUD for the obvious tax obligations and live in a regional area. Just do the due diligence on this part.

Hello! okay lang ba na maghanap ng work offshore (remote) sa AU while waiting sa grant? currently working for australian company kaso NSW , VIC kasi kami nanominate.. and under sa agency dito sa pinas yung contract sa NSW. Trying my luck to look for a job in Melbourne (hybrid or remote), para pag na-grant na may work agad dun.. Any violations sa visa condition? Thank you!

    1. This is possible but up to a certain time lang yata. After a certain period, magiging taxable na din sa AU yung income mo.
    2. What's your visa? If PR wala naman restrictions kung saan based ang company mo, kahit iba sa nag nominate na State. Kung 491, yung ang di sure kung pwede.

Visa is 190. Okay lang yon kahit Sydney ang HQ and Victoria nagnominate sakin?

VIC only "requires" you to stay and live in its state. Being a PR, you can work for a company located virtually anywhere in the globe that will allow you to work remotely. So long as you pay your taxes. Stay legal. ;)
