thanks, I was wondering about this scenario too.

    Hi

Please can some one clarify whether it is possible to move to another state after being sponsored by one state eg :

Friend has 475 State sponsored visa approved for South Australia but would like to relocate to Tasmania. can he do this and just let the South Aust gov know he is moving to Tasmania or does he have to reapply for a new visa from Tasmania
    thanks

    Any advise will be welcome..
    Brenda

    Hello Brenda,
As long as you have lived in ANY Regional part of Australia for 2 years and worked in ANY Regional part of Australia for one year (in ANY occupation) it does not need to be only one Regional area. The you should meet the criteria for the SC887 PR visa. You do not need to apply for a new SC475 visa. As a courtesy you should inform SA that you are unable to find suitable work in SA and that you are moving to another state. There is no need to inform DIAC.

    Regards

NT ang SS ko, I have been trying to submit job application online since Jan 2013 pero negative. Software development ang experience ko, but ang nakikita ko sa job posts are more on Infrastructure related like Desktop Technician. Now, I'm thinking to move to Perth kasi nandun yung friend ko and willing syang ampunin ako till i get a job. Naguguluhan po ako till now.

Nagreresearch po ako about this topic, and ito po yung isang nabasa ko:

Can 176 visa with SA SS move to another state in the first 2 yrs due to job?
    Hi Ozzdeam

The answer is yes, he can. There is no Condition on a 176 visa that prevents the person from moving to another State within the 2 years. No such visa Condition even exists.

The DIAC website is misleading about this, in my opinion. Policy says that if a State has been kind enough to Sponsor you then you should at least make a reasonable effort to stay in the Sponsoring State for a couple of years. However, Policy is not Law and DIAC should not pretend that it is.

The actual legal position comes down to the (written) Aussie Constitution. Apparently the Constitition says that an Australian can live anywhere he likes in Australia and can do whatever he likes by way of a job, as long as whatever he does is legal. A Permanent Resident counts as an Australian for this purpose.

The only way to change the Law about this would be to alter the Constitution first, which cannot be done without an Australia-wide Referendum of all its Citizens. That is not going to happen over something as trivial as this, so in practice 176 holders swap around between States until they are able to settle somewhere they like.

I suspect that the swapping probably happens in both directions - ie one 176 holder leaves SA but another one turns up from WA or similar. It probably evens itself out in the end.

Your friend does not need permission from anyone. He merely needs to pack his bags and set off if that is what he wants to do!

I called DIAC today and asked if I can study in South Australia even if I was sponsored by Western Australia, and she said yes. I can apply for visa subclass 887 after living in any regional area of Australia and work for 1 year full time.

@psychoboy thanks, oo nga mahirap nga makahanap ng work through online application. hopefully pagdating ko sa NT on April maging positive ang application ko.

@hotshot feeling ko meron ng nakagawa ng ganito hindi lang nagsasalita, hehe. and every year nag iiba ang immigration rules so mahirap madetermine kung anong mangyayari. bottomline, sumunod na lang talaga and magpaalam pag wala talagang makuhang work.

oo nga e...may mga nakagawa at nagbabalak din gumawa. hehehe! but for me, personally, takot ako sa karma kaya kung ako man ay magbalak lumipat ng state, magpapaalam muna ako before attempting. mahirap na at baka after 4 years ideny ang citizenship application ko. :)

She won't know the definite answer for sure... :) Pumunta sya sa Sydney and she said okey lang naman daw as there is no law against it. Kumbaga there were some loopholes daw ika ng migration agent na tinanong nya and it cannot be a basis against her is she applies for citizenship.

Only DIAC will know.

@olrac183 - why do you not want to stay sa state who gave you the SS ba?

    Hi guys,

Here is some interesting read I got from the other thread, to quote:
My flatmate was on a VIC SS. He landed a job in Sydney 1 month after his arrival in Melbourne. He mailed the VIC government explaining his situation. He was allowed to take up the job in Sydney. If you really see no jobs and would like to move to another state without a job then you need to give the VIC government evidence of all your applications and rejections (if any) and you also need to give it some time say 3 months at the least.
    http://www.expatforum.com/expats/australia-expat-forum-expats-living-australia/157912-possible-convert-190-visa-189-visa.html#post1196995

from the ABOVE; it seems his move to NSW was sanctioned after getting the job and informing the VIC government...

Q: Am I able to relocate to another state even though I have not resided in Western Australia for two years post visa grant and what is the course of action for the applicant?

A: By accepting State sponsorship you made a commitment to live and work in Western Australia for a period of two years and signed an agreement with the Government of Western Australia to do so. Applicants who request to relocate to another state will need to apply for release from their signed agreement through Skilled Migration WA.

@psychoboy, currently kasi may band 6 ako sa IELTS and hindi pa ako aabot sa 60 points but if I use NSW SS since as Analyst programmer puede ako for SS with band 6 and I will be able to meet 60 points.. No issue staying in NSW as long as may job but if the job opportunity arises in other state, dun papasok yung paglipat ng state.

@olrac183 - i suggest proceed with your application... and worry about this issue later..
just my opinion, mas marami pa ring jobs sa NSW compared sa ibang states, especially for your sklls.. so you dont have worry about that...

Napadaan lang sa site because I'm looking for a place to stay at Liverpool. Anyway, the only thing that worry me on this post is what if the Skilled Migration WA didn't grant your request? :)
Will they ask me to relocate to WA immediately?
