De Facto Visa Applicant

@desert Stat dec is not a strong evidence to prove that you are separated as advised by my agent and in some forums. It is still advisable to file an annulment or legal separation. In my case, my ex-hubby promised that he will file the annulment but i dont know when he is going to do that and I doubt that he will do it. So I have no choice but to bite the bullet. I filed legal separation. But merong iba na sinusubukan nilang isubmit yung stat dec lang. But I didnt see anyone who get a successful PR application after they submit the stat dec. O baka meron din namn na successful kaya lang hindi na nag update sa forum. Meron akong nabasa sa expat forum na nagfile ng divorce and sinubmit nya lang muna yung documents na proof na nagfile sya ng divorce and nagrant naman yung visa nya. Dahil dito ngfile na lang din ako.

Dati gusto ko rin isubmit stat dec from my ex dahil naging cooperative namn sya na gumawa nito. At para na rin makatipid ako. Pero narealize ko bat ako susugal sa hindi ako sigurado. Mababalewala lahat ng pinaghirapan ko kung madedeny PR ko. Magiging back to zero ako ulit pag nagkataon. So nagfile ako at sinubmit ko yung certificate from the court na nagfile ako ng legal separation.

@nedz , Thanks for help, appreciated. it means kelangan mag file ako ng Annulment na lang, ok po ba kung annulment? then hingi ako ng certificate from the court to prove that I have a filed a petition for annulment. then saka ako magproceed sa processing of migration?

@desert For me mas ok kung magfile ka. If you have plans to remarry then seek for annulment.

@nedz yes i have plans to remarry in the future. However, pwede ko ba gamitin yung cert from court na nagfile ako ng annulment for my pr application.

@nedz additional question po. Yung partner ko po ngayon,gusto ko isama sa applicstion as my dependent with our kids.pwede po ba yun as defacto partner? Then,yung status n ilalagay ko sa application is separated ako.posible po ba yun.

@desert Yung cert sinubmit ko rin yun. Regarding po sa dependent hindi po ako sure. Kasi wala po kaming anak at wala po ako partner. Ako lang ang applicant.

@nedz pwede ba ako bigyan ng court ng cert katunayan n ngfile ako ng annulment.at yun ang submit ko as one of the requirements

@ desert sorry pero im a bit confused. Ano ba aaplyan mo na visa? Regarding sa mga still married but separated and may kids, may mga nagrant naman na partner visa.

Yung kids mo ba sa ex mo yun sis?

Im not sure kung ano gagawin if di ka makakuha ng stat dec. I guess maganda talaga magconsult ka sa m.a.

@desert paki liwanag po ng case nyo.. Bale ikaw ung main applicant and ung kids na isasama s application is kids mo sa wife mo or s partner mo? Kasi kung sa wife mo ung kids mo kailangan mo ng consent galing sa mama nla na isasama mo cla. Pero kung s partner mo ung kids no problem.

What do you mean sis? Nag apply ng de facto(partner visa) then hindi nagrant ng PR after 2 years of lodgement?
Wala akong nabasa na nadeny ang partner visa from the Phils.

@Sakura88 thank u. I have plans to get a visa 189 with my current partner and our kids as dependent.anak nmin ng current partner ko.as per nedz,kung di ako mkakakuha ng stat dec from my ex then i have to file annulment case against my ex to get a proof that we'd already separated.

@Sakura88 Regarding po sa de facto. Hindi ako sure kung partner visa or 189 yung nabasa ko. Or kung successful o hindi. Kasi matatagal na yung post na yun at wala ng update sa timeline nila. Kaya nga po sabi ko baka may successful din nman di lang nakapag update sa forum. Kasi ang concern ko lang nun is kung pano ko ipuprove sa DIBP na separated ako. Nag aask lang ako nun kung pwede yung stat dec. May nag sasabi na pwede din daw. Kahit yung mga kakilala ko na nasa Australia na hiwalay din hindi rin nila ako masagot kung stat dec lang eh ok na o baka ayaw lang nila magshare. Since gusto kong makasigurado nagconsult ako sa agent at pinakita ko yung stat dec ng asawa ko. Inadvise nila magfile ako ng annulment or legal separation. Pasensya po hindi po kasi ako familiar sa requirements ng partner visa. Kaya mas ok kung magconsult po kayo sa agent.

@nedz ok. You're right. To be sure magfile na lang ng annulment. Nakapagsubmit na ko ng applicatiin. Case to case basis talaga. Kasi yung sakin, separated ako sa ex ko then may australian partner ako.

@desert oo tama si nedz kung yun ang aapply mo na visa. Kasi kung ang partner mo is filipino citizen, tapos kasal ka sa filipino, mahirap yung situation kasi pareho kayong under sa laws ng philippines. Yung case ko kasi australian ang partner ko. So sya ang nag sponsor samin ng kids ko and ang inapply namin is partner visa. sa oz kasi kahit previously married then may partner, acceptable sa kanla yun. Just as long as the married person can prove that they are not living with the ex anymore.

@desert you wont have any problems including your kids in your application. As they are your kids with your current partner. @netzkeenet is right. In my case i had to get statutory declaration from my ex allowing the kids to migrate to australia.

bump ko lang po ito.. malapit na po magdagdag ng dependents ang bf ko at ilalagay ako and my kids from previous partner.. pareho pa po kami married although hiwalay na pero hindi anulled. what are the chances of being approved with this and what can we submit to help na de facto kami kahit na hindi pa legally hiwalay sa mga ex.. please advise.. kasi baka hindi po makipag cooperate mga ex namin in giving stat dec na hiwalay na or something, and wala pa rin pang annul as of now...

@BlessBBB Hindi ako sure sa requirements ng De Facto Visa. Sa case ko nagfile ako ng legal separation. Hindi ako nagrisk sa stat dec.

@nedz hello... petition pa lang ang sinubmit mo that time, hindi pa yung court decision? nag attach din ako ng petition for annulment sa application ko, wala pa sagot yung CO. Sana magrant din yung sa akin
