employer na nag sponsor sa akin, naka sign na ako ng employment agreement. naka pag medical na rin ako. so vetassess nalang antay ko. what if na negative ang result ng vetassess ko. ano po ang mga dapat kung gawin? salamat

Need ko sana help and advise about getting a Visa for my Sister and her family.
Bale my Brother-in-law has 20 years experience pero nde cya college degree holder.
Meron siyang 10 years experience dun sa Occupation code (hotel managment) na pasok sa kanya.
He is 39yrs old and will turn 40 later this years.
Pde ba sya mag pa assess ng skills / experience kahit ala cya college degree?
Please pa advise hinahabol kasi namin bago sya magturn ng 40.

He's 25 = 30 pts
IELTS (Academic) = 20 pts
Education (Section 1 [UP] school - with Bachelors of Arts degree holder but with undergrad in Mech Engg) = 15 pts?
Work experience (3 years) = 5 pts
Partner Skills = 5 pts (with bachelors degree, CSOL (HR field but 1 yr experience), age is 22

TOTAL (as of my very rough computation) = 75
He's experience as Chief Welder-Fitter sa Engineering business ng dad nya. Detailed COE, JD, Payslips, ITR, Government contributions are all available.
Questions are:
1) Will experience required will affect sa pagkuha ng points? 189 ang plan namin actually kung ito yung route na tatahakin namin. Nalilito kasi ako sa may minimum required na experience for Welder-Fitter is 5 years pero Victoria Sponsorship ito.
2) Will his employment with his family will affect too? Nagwowork naman sya. Asset lang talaga sya sa dad nya kasi anak at mapagkakatiwalaan but kasama naman sya sa payroll.
3) TRA ang assessing body nya and di nila need ng IELTS. Sayang naman yung IELTS ng husband ko, ang taas pa naman nya. Talaga bang di un kasali sa points kapag di required?
4) Will his bachelors will affect the pointing system? He shifted out kasi sa BA nung undergrad pa sya but the TOR will show the history of his background in machines and engineering. Ngayon lang sya nagka chance mag complete ng units kasi konti na lang need nya grad na sya ng Engineering.
Please enlighten me. Thanks!
PS I will be studying masters by coursework pala this coming July 2015 kasama sila ng baby ko, so prolly dun na kami magaapply for 189. My friend said this is possible, sana may makapag attest na it's possible to transition from Student visa to 189. Thanks!

2. regardless if family business sia or not, as long as u can provide evidence na he is working in his father's company (e.g. ref letter, Coe, tax assessment, pay slips, etc)
3. Indi required ng TRA ang IELTS but u still need that for the actual visa lodgement for claiming of points. U can claim 20 points if he managed to obtain a minimum score of at least 8 in each of the 4 components.
4. he can still claim 15 points for education since grad namn sia ng BA.

cafe or restaurant manager falls under Group C whcih requires at least Diploma and ung hotel or motel manager namn is group A, requires at least bachelor's degree. u can check other occupations na TRA ang skills assessing body na incharge.
