Hello I’ll be soon applying for my 476 visa.

Sa application ko should I put her as my de facto pero not travelling with me muna?
@skijom Check if your relationship falls into the definition of de facto...
What is a De Facto relationship according to Australian Law?
According to Australian Family Law, a De Facto (meaning: in practice) relationship means:
The couple has lived together or apart only on a temporary basis
The partners have a reciprocal commitment to a shared life
The relationship is authentic and will continue in the future
The partners are not related
The couple must have been in the relationship for at least 12 months before applying for the visa
The partners are not legally married
The partners are not related to each other
Partners living together
Living together is a part of some relationships. Here’s what you need to know:
The one-year relationship yardstick doesn’t require the partners to have lived together for the whole period of a year
The Australian authorities appreciate that you and your partner may have had to live apart for a period, due to work or family commitments.
Having said that, the couple has to prove that the separation was temporary, and that they had lived together at some point from the beginning of the relationship.
Evidence to prove De Facto Relationship
Providing the Australian authorities with the history of your relationship is one way to do it. You will have to submit a signed relationship statement that will provide the authorities with all details.
Such a statement should cover:
Details of how, when and where you met your partner
How your relationship developed over time
Proof of commitment when it comes to supporting each other: emotionally, financially and physically
If there was a period of separation due to certain commitments, how you kept close contact even during that time
Your plans for the future as a pair

Hi Sir and Madam, magask lang po sana sa functional english for spouse. We already lodged our 489 visa and my partner took PTE-Academic yesterday. Bale may isa po syang subtest na 28 ang score pero the rest more than 30 na. Overall nya din is 39. Need po ba na 30 each subtest for functional english or kahit overall 30 lang? Thanks in advance po.
in the 12 months before you applied for the visa, you scored one of the following: PTE - An overall band score of at least 30 for each of the 4 test components
To be on the safe side po baka pwede kumuha na din sya ng Certificate of English as Medium of Instruction sa school saan sya nag-graduate and submit it together with Diploma and TOR.

Thank you cucci. Bale po yung primary at secondary po need since hindi po sya nakatapos ng college, tama po ba? 1st year lang po kasi naabot nya nung college then nagstop na po sya.
@bellacomeros Sorry am not knowledgeable about the English requirements for 489 primary applicants... normally since need ng skills assessment, if I am not mistaken, English must be proficient... the exact details depends on which assessing body does the skills assessment. For subsequent entrant lang ang proficient english and first year lang natapos nya, di sya mabibigyan ng CEMI which means dapat ma-qualify ang English nya using standard exams like IELTS or PTE.

thank you po sa sagot, is it hard po ba to apply for a defacto visa by DoItYourself lang? kasi when we ask agents palagi po nilang sinasagot is dapat po kasal or may anak na . Mukhang priority nila is student visa talaga.
@skijom While it would seem that having a child/dependent in a de facto relationship adds weight and credence to it, we must bear in mind that here in Au, de facto relationship can happen to same sex couples. Taking that into consideration, I believe it is a matter of how you present your relationship specially in a StatDec and being able to prove such declarations with other documentary requirement.

Hi! I would like to submit an EOI as single, but in 12-months time, I will be getting married..will there be a change in the EOI-date of effect (i.e. Nov. 8, 2019) if I change my status as MARRIED (nxt yr) EVEN IF my total points would remain as it is? (Single= Spouse with Competent English+ Positive Skills Assessment) Many Thanks!

Hi guys..
Ask ko lng sana kng panu iapply ung defacto for subclass 476?
Hndi n b to ggawin online? Iffill up n lng b ung form 1276? Thanks!
Good Day Sir/Mam any Insights will be very much appreciated.
I recently lodged my EOI for visa 189 all DIY. To take advantage of the nov 16 additional 10pts for single applicants to claim 80pts.
I stated my relationship status as "never married" which is true but my partner and I are expecting our 1st child this Jan 2020 and now applying for marriage license. We are planning to get civil wed after the ITA(if fortunate) to not affect the claimed points. Ive read that it is more practical to include her in the Initial application as dpendent.
Would this affect my visa application?
Is it better to get married after the ITA or Visa grant?
Can I bring my partner/child along with me even though I initially stated that I am never married?
If i change the nver married status to engaged status would my DOE be queued again at the bottom list?
Thank you very much
@maryowni09 said: @maryowni09 medyo similar tanong ko sa case mo po. havent submitted my eoi, but di pa kami married. sa question na "Are you bringing a partner.." i plan to tag yes. kaso pag dumating na ITA, di pa kami married, so dapat ba we should get married na bago pa dumating ITA? ano na update sa case mo?
Hi.. andito n kami sa Melbourne. Nakapag big move n kami netong Feb 26, 2019. If you really plan to get married then you need to get married before you lodge your visa. Ok lng n hindi p married but you should tick "yes" during the submission of EOI. So may 2 months ako n dapat kasal n kami. We had our wedding last Sept 8, 2018 kasi kelangan mo din iconsider ung tagal ng release ng PSA certified n marriage certificate which is a requirement upon visa lodgement.
Hi! I would like to kindly follow up po sana about this scenario. I am currently on the same boat. Aug 6, 2020 kami naglodge ng EOI for visa 189 and 190 for vic. Pero dito pa lang naisip ko na ideretso ideclare as "married" na ako and na "yes" dadalin ko yung partner ko with me. That time alam ko na close pa ang states until October due to pandemic and na may 2 mos kami to get married for our Au application. Engaged na talaga kami with church wedding set to Feb 2021 so pinaaga muna namin via civil wedding. Kasi di kami naglive in ng 12mos kaya mahina ang proof for de facto kahit 5y couple na kami. So Sept 19, 2020 we got married. And hopefully by mid November 2020 makuha na namin yung PSA copy ng marriage certificate at maiready na. Pero with the current situation and recent federal budget announcements, we don't expect na mainvite any time soon until fiscal end years sa July 2021 since offshore kami and 90 pts lang sa visa 190. Ang silver lining is more time mag asikaso ng PSA copy and change of name siguro?
And if may proof naman ako na mashoshow. As long as before ITA. Hope someone can help enlighten me if what I did was okay lang and di kailangan magalala.

Living together is a part of some relationships. Here’s what you need to know:
Evidence to prove De Facto Relationship
Providing the Australian authorities with the history of your relationship is one way to do it. You will have to submit a signed relationship statement that will provide the authorities with all details.
Such a statement should cover:

Hi Sir and Madam, magask lang po sana sa functional english for spouse. We already lodged our 489 visa and my partner took PTE-Academic yesterday. Bale may isa po syang subtest na 28 ang score pero the rest more than 30 na. Overall nya din is 39. Need po ba na 30 each subtest for functional english or kahit overall 30 lang? Thanks in advance po.

Functional English:
https://immi.homeaffairs.gov.au/help-support/meeting-our-requirements/english-language/functional-english
in the 12 months before you applied for the visa, you scored one of the following:
PTE - An overall band score of at least 30 for each of the 4 test components
To be on the safe side po baka pwede kumuha na din sya ng Certificate of English as Medium of Instruction sa school saan sya nag-graduate and submit it together with Diploma and TOR.

Salamat po!

Hello po, meron po ba required number of statements/ statutory declarations from friends and relatives? Or is 4 enough? Thank you!
