    Not really, as last ng as you’re in the same occupation doing the same tasks and can prove that when you lodge your visa, you can still claim experience even if that episode was not included in the assessment

    When you lodge an EOI, usually you leave the end date of your current employment as blank. IF the case is a continuous employment in the same employer (change roles/title lang), then gather documents lang that will support this.

    As mentioned, you can still continue to claim as long you’re doing the same occupation even if that period was not assessed. Put the end date on the previous employment the. New employment should have no end date on EOI.

    The occupation in the new employment is still relevant so choose yes

    Yung SSS, punta ka po sa Member Info > Coverage History, andun dapat list ng previous and current employers mo.

    Yung Pagibig naman, andun employer sa table.

    Counted as one payment evidence lang po ang SSS at Pagibig.

    Why would you be overclaiming something if the occupation is relevant? That’s when you need to provide further evidences to back up your claim during visa application submission. It will only be overclaiming when it’s not relevant but you claim that it is.

    acs only recognised up to a certain date since that’s what the applicant claimed. It doesn’t mean that the employment episodes beyond the timeline acs assessed aren’t relevant. As long as the applicant can prove that the succeeding employment episode remains relevant then there is no issue.

    Just to add, you follow the deemed skilled date as per acs, but you can continue claiming beyond what was assessed if you can prove that it is relevant.

    I believe it's always the latter.

    Now for the former, I had the same notion before that adding any new career episode not positively assessed by the assessing authority would always result to overclaiming points. So, I've always erred to the side of caution when responding to same questions before.

    But, if you think about it, you will potentially commit this by generally claiming a career episode that would effectively increase your points that is not positively assessed by the assessing authority.

    Ano ano yung mga instances na yun?

    • Any career episodes part of the assessment but before the skilled level met date
    • Any new career episode not part of the assessment that increased your points

    Logically, the above scenarios are potential disputes. Kasi the DHA could question that, why are you claiming the career episode that gave you points that is not even positively assessed? D'yan papasok yung palaging maging safe na kumuha na lang ng new assessment at isama yung new employment, lalo na sa mga DIY na walang agent na matatanong.

    So, sa huli, kung wala naman effect sa points yung bagong employment, and you think it's relevant to your nominated occupation and could prove it, then it's still fine to add it in the EOI. Safe lang yun, kasi wala kang ino-overclaim, technically. With or without that, same pa rin yung points mo. :)

    It's very logical approach, however, as mentioned earlier, the professional/legal practice is if the new job is the same type of work, then it's ok to claim on EOI. If tasks are still aligned with ANZSCO code and able to provide supporting documents ie employment reference letter and paid evidences, there is no reason why DHA will dispute such claim as what is being claimed is after the deemed date and conforms with the policy. It is very unnecessary to undertake another skills assessment as suggested.

    Unfortunately, the law supersedes human logic..

    The policy states:

    10.4.1 Assessing periods of skilled employment
    When assessing periods of skilled employment for the purpose of awarding points, the following must be taken into account:

    the opinion of the relevant skills assessing authority on the period of skilled employment including the date on which they deemed the applicant skilled; and
    the Australian and New Zealand Standard Classification of Occupations (ANZSCO) including any pre-requisite qualifications/work experience relevant to the claimed skilled employment; and
    any other relevant information (such as employment records and references).
    If the skills assessing authority’s opinion would result in the applicant being awarded less points than the applicant claimed in their EOI, then decision makers should consider the information in ANZSCO and apply the more beneficial outcome in determining when the applicant was working at a skilled level.

    While having regard to the opinion provided by skills assessing authorities, decision makers also need to be satisfied with the bona fides of the supporting documents presented in making their decision to award points.

    The regulations require only that an applicant is employed in a nominated skilled occupation for a particular period of time. The provision does not require the applicant to have skills of a particular standard during that period of employment. The decision maker can consider whether the applicant is undertaking at least some of the duties prescribed for the position in ANZSCO, for example, if a client is claiming employment as a carpenter, the tasks they are undertaking are those of a carpenter.

    Hope the legal policy above will put an end to the confusion re the initial question - Wouldn't it fall under overclaiming of employment points in case?

    Understandably, DIY applicants will approach this with caution. Hence, the key is familiarity of the policy.

    With regards to - Or is it overclaiming only if you put a date earlier than the assessment MET Date to claim points?

    I think their only job is determining your education equivalence in AU and **when ** you were deemed qualified for the ANZSCO position you applied for, if at all.

    I guess when you look at it that way, all job entries you added in your ACS application beyond your qualified date is redundant - because DHA will be the one to review that in your actual visa application.

    Is there a thing in the EOI (prior invite), where my employment points decrease because Skillselect will count from current year minus 10yrs? Or is it ACS' assessed relevant years of employment that should be acknowledged?

    Say for example, I got employment deemed relevant from 2013 to 2022 (15points). By 2023 and still no invite, will my skilled employment points be reduced from 15 to 10? Thanks.

    That's unheard of. And it might not be possible, kasi skills assessment is valid for 2yrs only for the case of ACS. So, palaging aabutin na mag re-assessment ka for the past 10yrs na period, and every time posibleng, magbago yung skilled level met date.

    Alam ko lang na sure, age points lang yung merong ganyang decrease.

    Skills assessment is not skilled employment assessment. Do not mix this up. That’s why skilled employment assessment is optional for other assessing authorities such as EA, AITSL CPA and others. All it takes for immigration is a positive skills assessment. So, going back to the policy I shared previously, when assessing periods of skilled employment for awarding of points, they will take into account the opinion of the assessing authority including the deemed date and the ANZSCO along with other relevant documents.

    The skills assessment outcome confirms that the applicant’s skills are of Australian standard and a deemed date is given. That’s all what the department needs to see. Employment experience claimed from this date whether it was officially assessed by an assessing body or not will be considered by the department if duties are aligned with ANZSCO tasks.

    ACS and VETASSESS include the employment assessment in their skills assessment as the work experience is part of their criteria for positive skills assessment. Other assessing bodies do not require this. However, for peace of mind, a lot avail the employment assessment service to validate their claim on employment. I myself encourage my clients to avail this service para it’s in black and white na, no uncertainty, mas confident when claiming experience …but when it comes to ACS outcome (or any outcome by any assessing body) where work experience were already recognised, I wouldn’t bother my clients to have their skills assessed again just so they can claim their new employment . The fact that the previous employment episodes was recognised by ACS, it follows that the succeeding experience (beyond what was assessed) can be claimable as long as tasks are still aligned with ANZSCO.

    That’s why there are members in this forum who post under EA skills assessment where they mention they did not avail the RSEA service and still claimed their relevant experience when they lodged their EOI.

    Sorry I’m not sure if I understood your question. If your deemed date on acs outcome is ie 20 July 2013, then you can claim only from 28 august 2013 ( because July is beyond 10 years already).

    If your employment experience was assessed until ie December 2022 but you are still in the same occupation (with the same employer or new employer), you can continue to claim until present. Skillselect will always count until 10 years back. So for example, by December 2023 still no invite but still in the same occupation, skillselect will calculatefrom December 2013 until December 2023. You still have 15 points because you’re claiming more than 8 years skilled work experience. Hope that makes sense?

    I am getting 90 points when I should be getting 85.. There's no place to put in the qualified date from ACS?

    My total employment is more than 8 years but I'm expecting to get -2 years so it should not be the full 15 points

    Don't mark the periods BEFORE the deemed skilled date as relevant.
