Filling up of EOI & Requirements after invitation

Hello. Ask ko lang po yung ganitong situation ng sister ko. She got pre invite sa far south coast nsw around November 2021. She waited for the nomination approval and got the approval and invite February 17,2022. She is about to lodge her application only to find out na her skills assessment expired February 14,2022. Di nya pinroblema kasi all along akala nya ok naman kasi may pre invite na sya then naexpire nasa kanila na application. Now meron na sya new skills assessment pero natatakot sya maglodge na. Meron na lang sya one week to lodge bago maexpire ang final invite.

Tama po ba ang gagawin nya na mag procees sa visa lodging and attach old and new skills assessment or should she let go of the invite and make a new EOI with a new skills assessment?

How long does it take to have the letter of assessment renewed. Mine takes 3 days with EA. Have it renewed first to be safe. It's gonna be quick. You still have 60 days before the invitation expires. Having it renewed takes only a week at most with EA.

Kayo po ba ganyan case din? Naexpire ang skills assessment but still proceeded with lodging kasi may new assessment naman na?

In my opinion, most likely that you will not be invited again for the same visa type.

I have the same case in the sense that my EA Assessment expired before being invited and preinvited. EA said I don't need to be reassesed because my qualification and experience will never expire. Unless I cheated it of course. EA said that I only need the "Letter" they sent me to be renewed and it only takes 3 days.

Question lang po, do we need to file for ROI if 190 po nilodge namin? Or ROI is just required for 491?

Also, if maglodge po ba ng 491 EOI need po ba muna mauna yung ROI or dapat approved po muna yung ROI?

DHA website clearly states that for your partner to be considered as your de-facto, you should have been living together for at least the past 12 months. Not sure why you claimed this being aware that you don't satisfy the required condition.

I don't think you can lodge a visa since you will have to prove your de-facto relationship. Since you have not been living together for 12 months, you can't prove it, and thus the likelihood of your application to be rejected.

Tanong lang po. Sa travel history po ba kailangan ilagay yung to and fro (UAE-PH) vice versa tuwing magbabakasyon? Pano po pala yung change visa from visit to work visa kailangan din ba ilagay yun sa travel history?

Hi question po! Magsusubmit po ako ng EOI for 189 and 190. May okay po ba if isang EOI for 189 and isang EOI for 190 ang gagawin ko? Or okay lang din po if sa isang EOI, both 189/190 na? Thank you so much po sa sasagot!!!!

2. Employment documents (offshore and onshore)
3. PTE/english assessment
4. Identity documents
5. proof of residency (i'm currently onshore)

yung sakin for 491 nagrequire din sila ng bank statements including your account where your salary gets paid. Not sure if they will require the same for 190.

DIY processing lang po ako so I wanted to make sure na tama po ung gagawin ko. So ang process po ay iupload muna po lahat ng documents, then pay the visa fees, and then iintayin ko po ung HAP ID for medicals? Tama po ba?

Ask ko lang po if yung medicals po ay pwedeng gawin after the 60 day period po? Or dapat nagawa na rin po ung medical within the 60 day period? Thank you so much po sa sasagot!

Possible po ba na relative/representative ang pumunta sa NBI branch sa pinas? If so, anong documents po yung need para po ma-release sa representative yung NBI clearance?

I don't think you can lodge a visa since you will have to prove your de-facto relationship. Since you have not been living together for 12 months, you can't prove it, and thus the likelihood of your application to be rejected.

Hindi porket may intimate nangyari, defacto na. Single/Never Married ka parin/ Sa Form 80, idedeclare mo siya as bf and name. Hanggang dun lang. Pero single/never married parin ang status.

What Is A De Facto Relationship For Visa Purposes?

Under the Migration Act, a person is in a de facto relationship with another person if they are not in a married relationship (as outlined above) with each other but:

(a) they have a mutual commitment to a shared life to the exclusion of all others;

(b) the relationship between them is genuine and continuing;

(c) they:

(i) live together; or

(ii) do not live separately and apart on a permanent basis; and

(d) they are not related by family.

Before we continue our discussion, you will note from the above that a factor common to both married and de facto relationships is that it is a genuine and continuing relationship. 
Additional Factors To Consider

In addition, when making a decision on either an onshore or offshore partner visa application (for both married and de facto relationships), the Minister for Immigration must consider all of the circumstances of the relationship, including the following:

(A) the financial aspects of the relationship, including:

(i) any joint ownership of real estate or other major assets;

(ii) any joint liabilities;

(iii) the extent of any pooling of financial resources, especially in relation to major financial commitments;

(iv) whether one person in the relationship owes any legal obligation in respect of the other; and

(v) the basis of any sharing of day-to-day household expenses; and

(B) the nature of the household, including:

(i) any joint responsibility for the care and support of children;

(ii) the living arrangements of the persons; and

(iii) any sharing of the responsibility for housework; and

(C) the social aspects of the relationship, including:

(i) whether the persons represent themselves to other people as being married to each other;

(ii) the opinion of the persons’ friends and acquaintances about the nature of the relationship; and

(iii) any basis on which the persons plan and undertake joint social activities; and

(D) the nature of the persons’ commitment to each other, including:

(i) the duration of the relationship;

(ii) the length of time during which the persons have lived together;

(iii) the degree of companionship and emotional support that the persons draw from each other; and

(iv) whether the persons see the relationship as a long-term one.
Additional Regulatory Requirements For A De Facto Relationship

In the case of a de facto relationship, both the applicant and their de facto partner must be at least 18 years of age at the time the application is made.

Additionally, to meet the definition of a de facto relationship when applying for a partner visa, it must have been in existence for at least the period of 12 months ending immediately before the date of the application unless:

compelling and compassionate circumstances exist; or
the de facto relationship is registered by a State or Territory Government agency in Australia.

Would like to ask advice regarding our situation. My husband and I would want to know kung sino ba dapat saming dalawa ang maglodge ng EOI kasi either one of us will retake PTE or both na mag retake kasi sumablay kami sa first take. Below is our qualifications.

Me: Electrical Engineer
Age: 29, 30 pts
English Language: Proficient (L-77,R-87,S-79,W-79) - 10 pts
Work Experience: 7 yrs & 2months - 10 pts
Bachelor's Degree Holder: 15 pts
Partner Skills: 10 pts

Husband: Civil Engineer
Age: 30, 30 pts
English Language: Proficient (L-81,R-83,S-90,W-74) - 10 pts
Work Experience: 7 yrs & months - 10 pts
Bachelor's Degree Holder: 15 pts
Partner Skills: 10 pts

We will be in Australia this coming August under 482 visa if no problems in our medical. I have sure employer there and my husband will still look for a job.
Please enlighten us.
