@Heprex i stand corrected, yung mga info na binigay ko is pang ibang occupations pala. Not for ICT. Tama si @panda nasa 75pts cut off ang occupation mo, scrap my analysis na mag intay ng 3-4 rounds, para lang yun sa non-pro rata occupations. Heheeh

@chyrstheen Bale ganito ginawa namin:
Family Name_Given Name_Type of Document (wala pong spaces puro underscore lang.

Then if maraming type of document halimbawa mga COE mo sa iba’t ibang company ganito naman:
Tamad_Juan_Employment1_Company A
Tamad_Juan_Employment2_Company B
so and and so forth..

Other examples:
Tamad_Juan_Employment1_Payslip_Company A
Tamad_Juan_Employment2_Payslip_Company B

Hello need your advice. Lumabas na yun assessment result ko. Negative pero sabi ng CO ko palitan ko lang daw sa isang job code at sure na positive na. yun ang advice nya. Tanong ko lang ganu katagal aabutin ang reassessment kung change job lang gagawin ko? no need to upload additional documents daw. Kaso iba nanaman mag aassess sken. Salamat sa makaktulong

question po sa lahat..na CO po ulit ako ngaun April asking for new passport samen magasawa kc atleast 6mos validity eh less than 6mos na ung passport namen ds April eh..un na lang ang hiningi..grant na kaya un upon submission?mabilis kaya ung pagbigay ng grant?tingin nyo guys??

Hi Sir/Ma'am,

Need your immediate advise, I got a VISA refusal yesterday for 489 NT state sponsorship, it seems it was because of my outdated ACS (4/7/17 (9 yrs 6 months work experience ) which I appealed and got a positive response on (4/11/17 (13 yrs work experience), it just I uploaded the old one and become basis of CO of decrease of score for Employment Experience. per notice, only the sponsor can appeal for me so I am not too sure how I can progress this further. I emailed the CO with my updated ACS results but I not sure if he can still consider.

I believe yung case mo will be brought up sa Administrative Appeals Tribunal, and also you can try to email rin ang NT about this, but i think if refused yong visa sa AAT na ang case na yan. Hope this helps.

@fortunate_engr Regarding sa timeline mahirap ipredict if grant agad or any specific timing ng grant after you comply with your new passports. I think the best way is after niyo mag comply is try to do the “feedback” para masilip rin agad nila ang application niyo.

@Underwater_Mercenary Hi, meron akong kilala na ganyan nangyari sa kanya. Di nagpositive yung unang assessment nya sa isang job code kaya nag pa assess sya uli sa panibagong job code. Yung naging timeline nya is Jan to March including na dyan yung first assessment nya na nag negative. So baka ganyan rin na timeline ang sa iyo, pero mahirap naman sabihin ang specific timing kasi considered as new assessment yan even though di mo na kailangan mag re-submit ng docs. Iba na rin kasi ang magiging assessing officer mo, so fresh start for him/her. Hopefully mapabilis but sa tansya ko a minimum of another 4weeks, pero sana mas mapabilis pa. Good luck.

@OZingwithOZomeness Hi, Thanks po sa feedback, I called NT Migration they said, they will not file appeal for AAT as it will be in appropriate daw for them. Allowed po bang mag appeal and off-shore application for AAT?. I only have 20 days to appeal, tapos sabi sa notice, NT Government is eligible to file appeal for my case. confusing.

@Ricky78 Ive read that for state sponsored visa only the sponsoring state could appeal but its still dependent on the state if they will file it for you. If I may ask, how many points did you claim for work experience? When was the date indicated that you are skilled based on your assessment? Did you attach both the old and new assessment?

@chococrinkle i claimed 10 points, but my invalid ACS experience is less than 10 years which is basis CO, in my revised ACS i got 13 years+ which is suppose be sufficed to support my claim.

@Ricky78 correct me if i'm wrong but if the wrong ACS result allowed you to claim less than 10years but more than 8yrs of your work experience so it is okay to claim 15 points. so if you claimed 10 points there shouldn't be any problem as long as hindi ka nag over claimed ng points. Are you sure yun ang reason ng refusal ng visa? just curious.

@Hunter_08 hi, in my incorrect ACS, one of my work experiences granted only 3 yrs out of 7 yrs experience that is why CO thinks i only have 8 yrs+ work experience for the past 10 yrs, which is I really need more than 10yrs to complete my 60 points. In my correct ACS, there are no gaps between 2003 to 2017 got 13 yrs+ straight.

here details of refusal.

Employment Certificate - Y- Statutory Declaration.pdf. This document contained*A Statutory Declaration signed by AAA, a work colleague, attesting to your employment between October 2003 to June 2008.*Y employee identification card of AAA *Y company letters to the visa section of the United States dated 2006 and 2008 regarding your employment.

●Employment Certificate - Z.pdf. This document from Z is dated 7 March2017 and confirms your employment between June 2008 to January 2016. I note that your skills assessment from the ACS states that your employment between June 2008 to December 2012 is not closely related to your nominated occupation.

●Employment Certificate - O.pdf. This document from O is dated 22February 2017 and confirms your employment from February 2016

●Employment Certificate -X.pdf. This document from X Philippines is dated 2007 and refers to employment between 1997 to October2003 which cannot be considered.I acknowledge that your Australian Computer Society (ACS) skills assessment dated 7 April 2017 states that your employment at Y, Z (July 2012 to January 2016) and O equates to work an appropriately skilled level and relevant to your nominated occupation. However, it does state that the final decision to award points rests with this Department.

On 20 November 2017 you were requested to provide within 28 days, among other things, further evidence of employment. The letter specifically stated that you had provided insufficient information and listed a range of evidence you could provide.

*****I already uploaded my mostly my documents that is why I thought I don't have issue with my work experience evidences thus I focused on other pending documents in which I requested for extension below

On 12 December 2017 you wrote to this office by email. You requested an extension to provide a range of documents. You did not list employment documents as one of those items.

On 15 January 2018 you wrote to this office by email. You stated that the only outstanding items are the Form 80 for your wife and evidence of her functional English ability.

The onus is on the visa applicant to evidence the criteria for visa grant. You were specifically requested to provide further evidence of your employment claims. I am not satisfied that the evidence you have provided evidences any years of skilled employment as your evidence does not include any independently verifiable evidence such as but not limited to tax documents. Overall you have provided insufficient employment evidence. Following an assessment of your overseas skilled employment experience, I am not satisfied that you were employed in your nominated skilled occupation, or a closely related skilled occupation, for any period in the 10 years immediately before invitation to apply for this visa. Based on this assessment, no points were awarded under this criterion.

-- my comments: I thought CEOs sufficed as evidence which were asked in ACS application.

@Ricky78 Maximum points is only 15 points for 8 years and above experience. The way I understood CO’s reply it seems your work at company Z is not closely related to your nominated occupation thats why they did not count it as part of your work experience. Pls note also that DHA will only award points based on your experience for the past 10 years thus, they will only look at your experience since 2007 if you lodged last 2017. Kaya CO indicated that your experience with company X from 1997 to 2003 was not considered kasi beyond the last 10 years na sya. It seems you have less than 5 years experience as only companies Y and O were recognized. This is based on my understanding of the feedback of your CO. You may check with a migration agent for proper advise.

@Ricky78 so you claimed 15points for work experience right? sorry pero medyo cloudy yung situation mo kasi you said your first ACS result you have 8+ years consolidated work experience so if that is the case you can still claim 15 points at maski yung 2nd ACS result mo which is 13+ years exp you can only claim 15points. at bases sa reason/reply sayo ng CO who handled your application it seems that he is not satisfied with all your employment evidence kaya refused yung naibigay sayong result.. sa tingin ko nakulangan sya sa naibigay mong evidence like COE,tax return,payslip,contract,bank statement,SSS or any other evidence that can make your claim points stronger.. just my though.. I think try mong mag appeal para ma review yung case mo ng higher boss nila.

@Hunter_08 Yes, it looks that the case, medyo naka dagdag pa yung ACS sa confusion ng CO, i am ok file AAT pero based sa notice, NT Government is eligible to appeal. I emailed NT Government they said they will not file an appeal on behalf of offshore applicant, so I am not sure my direction. I called AAT to ask if I can file even my visa application is state sponsorship, they said anyone can file. (pero wala akong written confirmation so baka another dead end ulet). Please advise, if I should take the risk of 1700 AUD.

@Ricky78 ayd1700 is a lot of money. but if you could provide stronger evidences for your claimed points for employment you could give it a shot. basta be sure to provide every proof you have and siguraduhin mo na tama na yung mga ipapasa mo..

@Ricky78 Hi, based sa nabasa ko at gaya ni @Hunter_08 cloudy rin ako sa assessment situation mo, kasi kahit 8yrs or 13yrs ang positive assessment mo it can only claim until the maximum of 15points for skilled experienced. We should not count the number of years of work experience na pinasa natin sa assessing body, Our work experience could be 15-20 years example but what matters is if how many years will ACS count as your skilled experience which is basis to claim point and the department has the final say. Let us break down again your employment history:

Employment Y - is not counted since it’s beyond the 10years work experience window DHA requires since you lodged your visa year 2017, even though the department later said this experience equates to skilled experience=0pts

Employment Z- (2008-2016) Total number of years is 8 but knowing Assessing body they will deduct several years of experience because the 1st and 2nd yr experience is deemed not skilled yet, So ACS only counted the years from 2012 to 2016. Total years of skilled experience mo dito is 4 Years only. You cannot claim points here because as what your first ACS assessment result said it’s not relevant to your nominated occupation. Now, even sa sabi mong corrected ACS Assessment, the department agreed that your company Z experience equates to appopriately skilled level but they said it’s their decision to award you certain points
= 1st Assessment (4years only but irrelevant to nominated occupation) so result is 0 pts
= Corrected Assessment (4years skilled experience counted)

Employement O= they have counted your 1 year experience, so this equates to 1 year skilled experience.

Employement X= DHA said that your work experience here cannot be considered, so this equates 0 points or irrelevant.

Based on the information you shared and based from what I understand you only have a total of 5 years skilled experience as what your corrected or 2nd Assessment Result is which is good for 10 points BUT as what the department said it is their decision if they reward you a point or not.

I think ang malaking impact doon is your employment Z, doon nagkaroon ng conflict kasi if in the first assessment is na consider na ni ACS yun na relevant sa nominated occupation mo plus your 1 year experience sa Employment O should be a total of 5 years skilled experience walang magiging prob.

Siguro nagkagulo gulo na rin kasi bakit may incorrect at corrected assessment pa. Di rin sila na-satisfy siguro sa mga evidences na prinovide mo. I think nasa iyo na ang decision if isugal mo ang 1700AUD, if you believe strong yung case mo na they should reconsider of assessing your visa application mo isugal mo na sir but you have the option to re-apply again. Kaso this will go back to step 1 from lodging an EOI, then mga expenses and effort etc.

Lesson learned na lang siguro sir na let’s double check all our documents bago natin i-submit kasi the department have a lot of visa applications na inaasikaso, and they are only given a short period para i-assess thoroughly ang application ng bawat isa. Consult ka rin ng legal advise sir sa attorney para before you appeal sa AAT nabigayn ka na ng proper advise kasi 20 days lang din binigay sa iyo para mag appleal so kailangan mabilis ang action.

Goodluck sir and let’s pray na magkaroon ng chance for you to reconsider ang application mo, but of course you have to do your part on pushing it and processing it.

@Hunter_08 May nabasa rin kasi ako sa website mismo ng home affairs na di na pwede mag apply once na refuse or cancelled visa, kaso hinahanap ko uli yung link di ako madala dala ni google doon. haha pero i know pwedeng mag appeal pag na refuse kaso ang di ako sure if pwedeng mag re-apply. Try ko hanapin and balikan dito.

@Hunter_08 I stand corrected. You can still re-apply kahit na refuse yung visa. yung nabasa ko pala sa homeaffairs is regarding sa failed to meet the character requirement. It said “A person whose visa is cancelled on character grounds and removed from Australia will be permanently excluded from being granted another visa to re-enter Australua. The cancellation of your visa will also prevent you from applying for most other visas to remain in Australia.”, but yes, you are right, we can still re-apply kahit na refused. Naalala ko pala na nakailang apply at rejection din ako ng PR dito sa SG so somehow parehas lang yun. hehe Just Edited my post sa Employment breakdown ni @Ricky78 Thanks Hunter for calling my attention.

@ceasarkho thanks for all your feedbacks and suggestions, i just thought suffice na yung COEs tagala as basis of my ACS but i am praparing more evidences to support my claims for AAT but i again ang di pe den clear if i can appreal for my self as state sponsor yung application ko, at yung ang nakalagay sa refusal notice “your sponsor NT goverment is eligible to appeal to AAT” does it mean i am not eligible? I sent email na den to AAT for confirmation. Keep you guys posted. Thanks

Kung makakapagprovide ka po ng SSS contribution, ITR, payslips, bank statement, contract/promotion/salary increase letter, mas strong po ang evidence nyo na maprove ung employment nyo po
