Hi. Thank you!

I don't know if tama forum ang pagtatanungan ko. Pero regarding TSS visa kasi ita. My employer ask me to fill up the TFN declaration, and a bit confused to answer Q7 & 8. My friends suggested that I should answer "australian resident for taxation and yes to the exemption" para mababa yung tax. Anyone encountered this question?

Hi po good day, doon po sa mga naka TSS visa , does the job offer come after the grant of TSS visa or before you lodge your application?
I kept on asking for updates from my employer pero wla pa daw feedback yung recruitment team.
I applied for as an ICU RN in a gov hosp. po with ANZCO code 254415. Ito po yung timeline ko po
Aug 16 received email na they will sponsor me
    Sept 10 nomination approved
    Sept 30 medical done
    Oct 5 TSS visa lodge
Oct 10 TSS visa granted .

I did the application and everything on my own po also with the help of this site and from friends who also applied tss before. When they emailed me the approved nomination (Sept 10) they told me to submit my visa and email them back if I got the visa grant. It took me almost a month to lodge my visa because I needed to get new nbi, afp and medical. When I got my visa I sent them a copy of my tss and they told me that they will forward it to the HR/recruitment team so that the recruitment process will be finalized and give me the offer letter which will take weeks daw. So this goes back to my initial question. does the Job offer / contract come after the visa grant?
I am unemployed and jobless for 3 weeks na because one of the visa condition states that you are only allowed to work doon sa nag sponsor sayo. Akala ko o kasi na once ma grant na ang visa makastart agad nang work in 1 or 2 weeks.
I was working as a casual RN in a different gov hosp in Sydney and I resigned from that position right away after I got the visa because of the condition. I was previously on a student visa when I applied for the TSS.
    TIA po sa sasagot :)

@aixirtap May mali po ata... the very reason that you were granted a TSS visa is because you have been nominated to a position/job offer that the employer could not fill up with local talent. As such there is a sure position for you together with all the rights and privileges attached to it, meaning a contract offer for about 4 years and remunerations attached to that contract. All these were included in the job offer that was attached and submitted during the nomination process.

Hello po. Magtatanong lang po if my nakaexperience ng ganito. May potential employer kasi ako sa QLD po and willing daw to sponsor. Nakareceive din po ako ng pre invitation from QLD for visa 190 awaiting for the approval of State Nomination. Currently offshore po ako. Pwede ko bang gawin na ilodge ko muna ang tss then wait for approval then lodge ako onshore ng visa 190? Sana may makatulong sakin. Thank you po

    @kars Pwedeng pwede po.

Pero to avoid unnecessary expenses, unless your employer pays for everything including visa application why don't you check the processing times for 190 in Queensland. Lately there seem to be a sudden spike in 190 approvals. Perhaps you can bargain with your employer to use the funds to be used for your TSS nomination and application for your 190 instead.

@pixie08 As is TSS by nomenclature is a temporary work visa. Unlike 489/491 which allows you to apply for 887 after a certain period of time, TSS lapses upon its validity date. However, TSS visa can allow you to prove your worth to an employer who can nominate you via ENS 186... via TRT pathway after 3 years or Direct Entry anytime.

@pixie08 aside from ENS 186 pathway, you could also apply for 189 or 190 PR visa while on TSS.

@snuffbox Q7 - YES, Q8 - YES. Since you are on TSS visa, I'm assuming you will only work for 1 employer so Q8 should be YES.

Thank you sir. My form was returned to me since I answer "Yes" for Q7 and 8. My employer says it should be foreign resident for taxation and we can't claim for tax exemption.

Do I need to resign current job before proceeding to Visa processing?
    Thanks in advance.

    @chinicachola Please clarify po...
    1. Transfer of employee, as in, same company, same role, but different location (e.g. Singapore to Australia)?

    • no need to resign, company must lodge nomination and comply with requirements, once approved employee/HR/agent lodges visa application. Visa application fees may be shouldered by company.
    1. Transfer of employee, as in, same role but different company?
    • currently in Au on TSS visa? You lose the nomination from current employer thus your intended new employer/sponsor must lodge a new nomination within 60 days otherwise your current visa becomes invalid and you will need to exit Au.

    https://immi.homeaffairs.gov.au/visas/employing-and-sponsoring-someone/sponsoring-workers/nominating-a-position/salary-requirements
    Overview
Employers who wish to nominate workers for subclass 482, 186 and 187 must meet certain salary and employment condition requirements. These requirements help to ensure that:

    • overseas workers are paid no less than an Australian worker would doing the same work in the same location, that is, the 'annual market salary rate (AMSR)'
    • these visa programs are not used to undercut the Australian labour market
If the overseas worker will be paid an annual salary less than AUD250,000 you need to show:

    • you have determined the AMSR correctly

    • the overseas worker will not be paid less than the AMSR, that is, less than an Australian worker would be paid
    • both the AMSR and what the overseas worker will be paid, excluding any non-monetary benefits in both cases, is no less than the Temporary Skilled Migration Income Threshold (TSMIT).

    Temporary Skilled Migration Income Threshold
The Temporary Skilled Migration Income Threshold (TSMIT) is currently AUD53,900.

Both the AMSR for the nominated occupation and the guaranteed annual earnings you will pay to the worker must be at least as much as the current TSMIT.

The TSMIT does not include non-monetary benefits such as accommodation or a car. Such benefits must be paid in addition to the TSMIT.

@japsdotcom I just had the same scenario. I lodged (190 QLD) last March 15, 2019 with my medical exam expiring on April 19, 2019. Wala naman naging problema, I just got my direct grant today, Oct 15, 2019. TSS din ako tulad nyo since April 2019. check your application lang for health assessment if finalised na ba and no further action needed yung status :)

Thanks @LovellaEllen. Granted na ang PR namin. :)
