Hi lock_code2004, need help..I think mali ung date na nalagay namen sa de facto relationship details nmen when we lodge our visa..may question po kasi dun na:

What's ur relationship status? so nilagay namen was De Facto, then may follow up question na date the relationship began? what we understood was the date we became official couple (bf/gf) which is July 2003, I just realized when I was reviewing ung FORM 80 na it should be the date we started our de facto relationship (live together) which is June 2008 when we moved here in Singapore..if we fill up ung Form 80 then lagay namen na June 2008, it will contradicts the date that we have stated during our visa lodgement. Is there a way we can amend ung information namen sa visa application? Or shall we wait for our CO & highlight this issue? Pwede kaya un? Any input pls?

Thank you sooo much & God bless :)

Hi @lock_code2004, yes po we've submitted ung personal statement nameng 2, indicating ung mga mga important dates, specifically the date we became official couple which was July 2003 then ung date that we started to live together (June 2008).

I think its a minor issue but worried lng ako kc bka mapansin na di accurate ung information during sa lodgment ng visa & sa form 80..Sana nman di big deal sa magiging CO namen, as it was really an honest mistake :(

Either way pasok nman po kame sa requirement na at least 1 year of de facto relationship, I just hope our CO will accept our amendment sa incorrect information given during sa visa lodgement.

Ganun nalang po gawen namen, maybe we shall wait for our CO, di ko kc alam if anung part ko i-aatach ung form, bka mas lalo cya malito..

Thanks again for your usual help :)

    1. Depending on the stage of the pregnancy, it might delay the medical exam...
    2. you have to option, either manganak na sa AU, or manganak sa Pinas... in both cases, you need to inform them using one of the forms in DIAC... (change in circumstance/s: addition of family member/s)

I just want to ask for some advice po in behalf of my sister. Kc were on the process of lodging an EOI na and were contemplating whether she can include her bf as dependent to her application. I tried to do some research and from what i read, you cant add your bf unless you are living together (de facto). Im just wondering if there's other way for my sister to bring her bf along with her?

Were also thinking if its really not possible, we'll just proceed with the application without the bf then once the result comes out iapply nalang si bf ng fiance visa or spouse visa since they intend to get married next year. Only problem is my sister wants to migrate together with bf so if the visa comes out she intends to pay a visit here in Oz for initual entry then come back and wait for bf's visa to come out para sabay sila magmigrate.

May nakaexperience na po ba ng ganto situation? Would yu know if this sounds a good plan or there's another way around? Please help po. Thanks!

    @Hotpotato004 - dito tayo!! :)
Thanks Sir Psychoboy for the link, nagbackread nako and salamat sa mga info. :)

Followup nalang po sa post ko earlier. mejo limited din kasi ung information about fiances/engaged na kung pwede iadd as dependent. actually ung kaibigan po namin nagawa na to successfully pero vague ung information na nabigay sakin kasi ung migration agent nila ang nagasikaso ng papers.

Tanong ko lang po kung for example itry namin ideclare ng sister ko as de facto ung bf nya and hindi naconvice ung immigration, may possibility po ba na madeny ung application ng sister ko and maforfeit na ung binayad nya? in reality po kasi they're just plain bf/gfs (not living together) pero they have plans of getting married next year and would want to migrate together.

Pasensya na po pero ive been browsing through forums here and outside pero parang wala ako maxado mabasa about adding fiance as dependent, parang unexplored route po kc ata ito. Kaya nagbakasakali na magpost baka lang po kc may makapagbigay ng mas concrete na info about this.

    @Hotpotato004 - several comments:

    1) if you plan to declare them as de-facto, and your documents are not enough to show that, then the whole visa application will be denied.. its all or nothing.. kung baga sa kaso "the burden of proof" ay nasa applicant.. its how you present your case..

    b) as far as i know, if your sister is applying for student visa, she cannot sponsor "fiance/spouse" after ma-grant at maka-entry na sya sa AU.. sponsoring a fiance/spouse is only applicable if the sponsor is an AU Citizen/PR..

So it's either isama na ang partner sa original application, apply as a student guardian, or apply as another student visa..

    Read Eligibility Section> Family Members
    http://www.immi.gov.au/students/students/572-3/eligibility-family.htm

You must declare all family members on your application, even if they do not plan to travel with you to Australia. If you do not declare all family members on your application, they will not be eligible to come as dependants after you have arrived in Australia. You must also provide proof of your relationship to them, in the form of officially issued birth and marriage certificates.

Thanks lockcode for the inputs. Its actually a 190 skillselect visa that i am helping my sister with and not a student visa. But anyway thanks for great help.

ngek. haha.. san k ba nakuha ang idea na student visa sya.. lol.. mali ako..

kung visa 190, eh kailangan pa rin ng proof of relationship.. so applicable pa rin yung point 1, in my reply above..

as far as i know, merong mga nagdeclare nyan dito na fiance as secondary applicants, pero they provided proof of their relationship (read from the start of this thread).. or they provided proof na malapit na nga ang kasal nila..

kung mahina ang evidence, baka mas okay na mauna muna ang sister mo, at pag approved na ang PR visa nya, or settled na sya sa AU, by that time eh baka kasal na sila, yun nga lang panibagong application fee na naman para sa Spouse visa..

For De-Facto, here are some examples of supporting documents we provided:

    - personal statement covering factors stated in DIAC's requirements (see below), where did you meet, how the relationship developed.. parang love story .. commitment and plans...
    - signed statements of family and friends regarding their knowledge about the relationship, this is very important to show that the relationship is accepted by family and friends..
    - provide proof (such as pictures, cards) of special occasions (xmas, bday, anniversary)
    - provide proof (picture, visa, passport stamp) of your travel together
    - telephone bills, emails, chat (at times when you were not together), we provided history of ym chat, makikita ito dun sa yahoo conversation history, parang summary kung kelan tumawag at gaano katagal ang bawat tawag...
    - bank statements (showing transfer of funds/remittance from one bank account to the other)
    - if you are living together, bills showing the same address..
    - if not living together, provide statement (example in middle eastern countries, hindi pwede pag hindi kasal)

Some of the factors to be considered in deciding whether the partners satisfy the requirement include:
•knowledge of each other's personal circumstances
•financial aspects of the relationship, joint financial commitments such as real estate or other assets and sharing day-to-day household expenses
•the nature of the household, including living arrangements and joint care and responsibility for any children of the relationship
•the social aspects of the relationship, provided in statements (statutory declarations) by friends and acquaintances
•the nature of the commitment, including duration of the relationship, how long the couple has been living together and whether they see the relationship as a long-term one.
Hi @lock_code2004 ! Quick question, did you provide certificate of no marriage? Thanks.

Question lang po. When we lodge our application our status is still engaged but right now we are already married. Is it okay if we just provide our marriage certificate and submit form 1022 for our evidence of relationship or do i still need to provide those requirements stated in the de facto relationship? In our case we are not living together, we dont have joint accounts yet but we have been in relationship for more than 5yrs already. Kindly advise :)
