    Advise ko lang po, to prepare as much document as you can to support yung de facto claims nyo. Para confident kayo at worry free.

    Sa case ko po kasi, nakapag present ako ng isang document (hindi pa po ito yung de facto proof namin) na naging basis for our de facto claims, Proof of Address for 5years. Billing statements ng partner ko at billing statement ko. Every Quarter for 5 years. Then after that, walang nang ibang hiningi si CO as in no other documents, wala ng picture, wala ng testimony, though naka prepare na po sya, naka abang lang in case hingin.

    So applicable pa din po yung kasabihan na "kung ano hingin, yun lang ang ibigay" ;-)

    after reading all the infos here in this thread, hindi ko na tuloy alam kung maglolodge pa ba ako ng de facto para sa partner ko.. medyo risky pala...

    She's already there in Melbourne under student visa which is about to expire by November 2013. I have my own application (190) kaso nga lang sa WA available ung work ko. hindi namin tuloy alam kung magtatake risk kami na isama sya as de facto under my application. Naging kami officially June 2010 kaso un nga lang - long distance relationship. Once a year lang nakakapagkita. We have pictures together, with our families. Nagkapagbakasyon sa Bali na kami lang. We have our skype dates, ym. facebook. Pero hindi ko alam kung sapat na ba to para mgrant din kmi under de facto relationship.

    or get her own work visa first in Melbourne since in demand naman ang work nya dun as nurse. un nga lang magkalayo na naman kami.. :( I'm currently here in middle east..

    Another option is mag-stay muna ko sa Melbourne with her.. kaso pano naman ung WA PR ko.. it will affect the Citizenship nomination also in the future. I need to stay and work in WA for at least 2 years.. LDR na nga kami ngaun.. Pati ba naman pagdating sa AU LDR pa rin? hayyyy

    @Arch_Onin..to consider that u r in a de facto relationship u must prove that u r living together in a minimum of 12 months.. so u must provide a documents that u have same address.. but if u dont have it can't be considered as de facto..

    The other way to include ur partner in ur application is to plan 4 a wedding, yan kng ready na kau both and include her as ur fiance.

    For a fiance u have to indicate the date of wedding.. include evidences how genuine is uR relationship is..

    Pano kaya samin? we live together for almost 2 years na and we have a baby? Sapat na kaya yung BC ng baby ko? with pictures? wala kasi kaming mga billing because he is a house husband and we are changing address mga 3x na. :(

    Hi @raiden14, I believe if you have a baby together, yung one-year relationship requirement is waived. But you might still need to provide other evidences that your relationship is genuine and continuing.

    @nfronda, thanks for your reply.. Clarify ko lang.. So I need to settle that wedding before the decision has been made on my Visa 190 application right? Magiging dependent ko sya as de facto sa application then wedding before my visa granted.

    ibang case naman ung "Prospective Marriage Visa (Subclass 300)" na may 9 months pa ko to get married with her.. I think hindi na to pwede mainclude sa visa application ko.... after na yata mgrant ang visa ko and separate application na.

    Oh my gulay.. kasalan galore pala talaga ang kailangan! dapat pala nung umuwi kmi last April nagpakasal na kmi.. hindi pa kasi ready particularly sa side nya eh.. haiz

    @Arch_Onin..hndi namn kailangan na mgpkasal kau b4 the decision.. pwde namn after the decision of ur visa.. to be included her as fiance dapt lg my ma specify kau na date ng wedding nyo so kaht anong date lg un.. un nga lg u must provide an evidence na mgpapkasal kau on that date..

    So kung gus2 m ung kasal nyo after the decision na lg put the date of ur wedding 1 yr from the date of ur lodgment..

    pag hndi m xa ininclude sa application m ngaun and after ur grant kau mgpapakasal magigng seperate application na xa.

    @Arch_Onin just want to share my experience in adding my partner sa application namin.
    before we lodge our application ay engaged ang status namin. then nung nagka CO kami hiningan din kami ng de facto requirements. so what i submitted was pictures with caption with our family and friends, airline tickets ng vacation namin, online conversation namin at saka invitation sa wedding namin. ayun inapprove naman ung application namin. you might want to consider then na magpakasal na before going to oz. hope makatulong sa case mo..

    Hi @Arch_Onin, I applied for a PR visa and included my de facto partner in the application. LDR din kami. We did not have to get married para lang masama ko sya sa application. Though this idea crossed our mind a few times, we didn't want to rush it. Here are some of the docs we provided:

    1. Notarized statements from principal applicant and de facto partner (story of progress of relationship)
    2. Notarized affidavits from third parties (friends, family members, other relatives) signifying authenticity of relationship
    3. Evidences for Financial Aspect of relationship such as evidences of joint assets (Deed of Sale and OR-CR of car under both our names, bank certs for joint accounts), payment confirmations for joint purchases using my credit card (including joint flights, hotel accommodations, etc.)
    4. Evidences for Social Aspect of relationship such as photos with friends and relatives during gatherings, invitations to weddings and other social events addressed to the both of us
    5. Evidences for Household/Living Arrangements of partners such as notarized statement from my landlord that my de facto partner was not living with me but consistently visited me for extended periods, phone bills, statement from telecom service provider that I have two accounts and one is assigned to my partner, flight itineraries for when my partner and I traveled to and from Manila to visit each other

    I also made sure to make a "cover statement" for items 3 to 5, which included a short narrative and a list of the attachments para hindi malito ang CO sa dami ng docs and photos. I think what's most important is that you're able to prove that the relationship is really genuine and that evidences are authentic. It was a huge challenge for us kasi we have not been living together, but bumawi na lang kami sa ibang aspects. It was tempting to claim that we have been living together but we opted to be honest. We did, however, emphasize that my partner visited me and stayed with me for extended periods (weeks or months at a time) all throughout the duration of our relationship.

    Hope this helps. I have to say, providing proof of our de facto relationship was what made the application extra challenging. Thankfully, we got the visa grant naman. If you don't want to risk it, you can always go for the marriage option. Good luck sa inyo! :)

    may enough time pa naman before we decide kung iinclude ko nga sya sa application. medyo risky lang kasi mageexpire na student visa nya sa November. One more option is kumuha nalng din sya ng sariling PR visa. Iwas hassle na rin sa part nya.. Again, thank you po! :)

    yup.. applicable ung english requirement for any secondary applicant (married or de-facto)..
    so you can satisfy it with a certificate from college/university..

    My partner separated from his ex-wife 5 years ago but not legally anulled/separated. We have a 3 year old daugter. I know that the requirements are waived if a defacto couple has a child but are going to have a problem since he's not yet legally anulled?

    06-01-11: Arrived Australia (457 visa dependent on my dad)
    28-05-12: Lodged RSMS 857 visa (seperate from my dad already)
    28-06-12: Done Medical check
    30-10-12: Submit AFP check
    07-11-12: Went home on a bridging visa B for holiday and wedding..:)
    12-01-13: CO allocated and nomination approved
    18-01-13: CO asked documents of my husband to be included on my application as migrating dependent..Thank u LORD!
    15-02-13: Husband completed all requirements (police check, medical, english requirements and joint statement)
    15-02-13: CO issued pre-grant letter instructing hubby to apply tourist visa to enter Australia in order our 857 visa to be granted.
    27-02-13: Hubby applied Subclass 676 tourist visa.
    06-03-13: Hubby's tourist visa approved.
    16-03-13: Hubby arrived Australia.
    18-03-13: Our RSMS 857 visa granted.. (nothing to ask more)

    baka po meron sa mga may visa na may same situation namin ni raiden14. Pano nyo po nadeclare as defacto kung yung partner nyo is not legally annulled. And in our case that we've been together for 5 years and have a child, do we still have to mention that he's not annulled?

    Hi Guys,
    Just want to get ur opinion and advice po from those who went thru similar circumstance.
    Me and my Defacto partner kasi is contemplating na isama ko nalang sya sa application ko. Initially nuong nag lodge ako nung 17 Oct, Diniclare ko yung defactor partner ko pero I answered "No" dun sa question na e include sya dun sa migration ko. Kasi balak sana namin na susunod nalang siya after I get settled first in oz kung sakali.

    Now, since nagpakilala na yung CO ko yesterday, hiningan nya ako nang Birth Cert at Passport copy nung partner ko at sabay tanong kung magmigrate ba sya kasama ko. Kaya medyo nag think twice ako and considered the possiblity na e include nalang sya. Altho, preparing and collating the docs to support our relationships is another issue since originally nga the plan is susunod sya.

    Need advise po if it is a good idea to include her nalang ngayon considering our circumtances below.
    1> Our relationships is going 3 yrs this coming Jan 2014.
    2>My partner works in Japan while I am in SG, so basically, LDR yung relationship namin. Everyday po kami nag uusap either sa Viber or Skype. At lagi din kaming either sabay umuuwi nang pinas, or papasyal sya dito sa SG or ako naman sa Japan. We do have Joint Bank Accts and Joint Equity funds.
    3>Yung mga Proofs po to justify na our relationships is Genuine and Continuing po, I am confident na makaka comply kami. Pero I am concerned dun sa "living together" dahil nga considering nasa Japan sya while dito naman ako sa SG.

    Need ur thoughts po.

    @Isyut..Bakit mo namn kasi nilagay na my de facto partner ka eventhough na ur living seperately. De-facto means live-in partner. Kaya kahit nilagay mo sya as non migrating dependent but then CO will ask her documents and also will ask her to undergo medical, then u have to prove that u are living together as u declared her as de-facto. In a de-facto u have to prove that u are living together in a minimum of 12months.

    So if I were u, tell ur CO the truth that u are not in a de-facto relationship but you have a partner but then ur living seperately. Explain to ur CO na lg na nagkamali ka sa pagkakaintindi ng de-facto.

    I myself muntikan ding magkamali jan. I also put that I have de-facto coz I have a boyfriend. But then my HR told me that better to put single coz we never live together. Kaya ayun single ang status ko nung nag apply ako.

    @GoodLuckAU..Sorry now ko lg nabasa ang comment mo.. Oo namn, it's ur right na mgpakasal. Wla nang paki ang immigration sau kasi granted na ang PR mo and then hindi namn partner's visa ang visa nyo.

    Sakin nga single ang status sa application den biglang naging married. Akala ko mgugulat ang immigration sakin, pero hndi namn. Sau pa kaya na ur in a de facto?

    - ang ibig ko po sabihin nag wowork sya sa japan while my work is in sg. Living separately dahil sa work assignments namin. But iisang bahay inuuwian namin sa pinas. Possible kaya na ma consider nang CO?
    -btw, pwede kaya itanong ko directly dun sa CO about sa circumstance namin bago kami mag decide to include or not? As of now di ko pa sinasagot si CO sa email nya last tues inaantay ko din kasi sg coc ko at health na ma upload.

    4 yrs na po ako dito sa sg, while sya around 5 yrs na din. Pinag-iisipan kung mabuti yung circumstance namin. Ang inaalala ko is yung documentation na kailangan e prepare which is ang dami pala at baka di ko ma meet yung 28 days na ibinibigay nang CO to comply. So, I'm contemplating dun sa above mo advise to tell my CO nalng mali pagka intindi ko sa defacto at declare nalang as "single" to make things simple.
    Anyway, salamat talaga sa advise mo. Appreciate it. :)

    clarify ko lang 929 is for change of passport details, tama ba ako? Kasi dun sa ecom site upper left di ba may options dun clinick ko yung change of passport tapos ang lumabas na form ay yung 1022 kaya yun ang form na finill upan ko para ma update yung details ko sa bagong passport ko.

    Tungkol naman po dun sa defacto wrong declaration ko, pwede kaya sa form 80 ko nalang e change tapos email ko si CO that I misinterpreted it?. Anyway, hinihingan din naman po ako ni CO ulit nuong 80 bec need I need to answer daw Q46. Salamat again :)
