Adding Secondary Applicants (Married/De-Facto/Engaged)

Time to help other applicants, we just received our grant notification with de facto. eto po yung mga proof na ginamit namin for de facto and long distance relationship po kami:

1. Evidence of Common Friends - 1 pdf file with clickable table of contents, description of this file, full of images including snapshot showing number of mutual friends in facebook then images of us with friends. All images have description and dates.
2. Evidence that the couple maintained contact during period of separation - Viber & Facebook messages, portion lang kasi sobrang dami.
3. Affidavit proving our relationship is genuine from my side.
4. Affidavit proving our relationship is genuine from my partner's side.
5. Evidence that we are recognized by our families as a couple - 1 pdf file with clickable table of contents, description of this file and images with description and dates.
6. History of relationship - statutory declaration stamped in Malaysia narrating our story since we first met and how the relationship developed.
7. Joint Accounts - certified true copies of our joint accounts.
8. Evidence that shows we are generally accepted and recognized as a couple socially - 1 pdf file with clickable table of contents, description of this file, wedding invitations addressed to both of us (iniscan lang namin yung cover nung mga wedding invitation showing our names) and images that we attend those weddings.
9. Joint Travel - 1 pdf with clickable table of contents, description of this file, images of our travel with dates and description, flight tickets & bus tickets.
10. Intention to have a long term relationship - 1 pdf file with clickable table of contents, description of this file, wedding supplier contracts (were already engaged to get married when we submit our EOI)
11. Joint Participation in Sporting - 1 pdf file with clickable table of contents, description of this file and pictures that we joined a lot of running events with dates.

@RED thanks! Kaw pala yong nakikita ko dati nagtatanong about sa mga marriage license if they will accept it as proof. Anyway, I haven't submitted my EOI yet because I'm planning to get married first. Would you recommend to submit my EOI and then change my relations status later on(during visa application na)?

@J_Oz haha ako na nga yun. in the end di ko din nagamit marriage license kasi di ko nakuha agad. Ang suggestion ko, no need to wait na ikasal kung tingin mo yung mga proof mo is enough na. Yun nga lang kahit tingin mo enough na, laging merong kaba, di katulad ng marriage certificate na yung nakahain. Nag gamble na ako kasi di naman din nakukuha agad yung NSO certified na marriage certificate, naisip ko lang na baka di tanggapin yung hindi NSO certified kasi yung marriage certificate na iissue sa amin e walang registry number which is normal lang daw talaga.

@RED Normally ba gano katagal nakukuha ang Marriage certificate?. Medyo hindi kasi namin masatisfy yong 12 months na living together(alam mo naman dito satin hehe). Although recognized ng families namin ang relationship namin plus we have travels together din(with families, my friends, her friends, officemates, etc.)

@J_Oz ang sabi sa amin sa church, 3 to 4 months daw yun bago lumabas sa NSO. pwede daw mashorten yun basta sasabihin mo sa city hall, ang problema lang daw dun madami daw nagrerequest ng ganun kaya possible daw na hindi maasikaso sa city hall. Wala pa bang 12 months yung relationship niyo? Yung amin wala din naman kami proof na nag live together for 12 months or more, statement lang kasi sa pinas naman kahit live-in na kayo not necessarily naman na both are included in the bills etc. lalo na kung house rent lang walang proof. hehe.

@RED mag 4 years na kami as bf and gf and plan namin talaga magpakasal na. kaya idedelay ko muna yong EOI.

@J_Oz isa pa palang reason kaya di na namin naantay na ikasal kami kasi yung electronics engineer parang malapit na magsara, nagopen lang ulit siya this year kaya di na kami nag take chance na baka bukas pa next year. tingin ko sa field mo wala namang issue kasi indemand talaga ang programmer so I don't expect it to be closed in the next few years.

@RED ah sabagay, although hindi natin talaga alam kung kelan magbabago ang mga sistema nila. Every year kasi halos nagiiba, so target parin is sana before July 1 para same parin yong sistema.

guys, paclarify naman po sa mga may ganitong experience.

Visa granted na po ako with de facto, getting married this December and will make my first entry on April or May. Ang kailangan ko lang ibigay sa CO e yung form 1022 and marriage certificate, tama ba? eto yung mga nabasa ko sa simula nung thread.

ay pag approved ba no need na. kinakabahan kasi ako baka magkaproblema. hehe. nagemail din ako sa CO namin kung kailangan ba kami magnotify kaso di sila nagreply.

Ang mggng proof nmn ngyun ni patner ko na mg aaply skn ng de facto is baby nmn. Mron po ba ganito encounter n scenario? Salmt po sa mga sasagot at reply.

hi @cody, wala ako idea sa case mo pero kundi ako ngkakamali may ilan na parehas sa case mo. back read ka lang ng mga comments sa thread nato at sa ibang thread, hindi naman karamihan ung pages per thread kaya gut feel ko makakahanap ka ng related sa situation mo.

the fact na meron kayong anak is a big proof na may defacto relationship kayo..
so malaking chance na yun na maaprove..

in case kailanganin, baka pwede kang gumawa ng affidavit/statement na hiwalay na kayo ng dati nyong asawa.. tapos put some reasons like...hindi lang maasikaso ang annullment dahil mahal ang bayad..t

hi, hope you can help me with my scenario: i lodged my application as a single independent skilled 189. But when i filled in form 80 i listed my same sex defacto as non migrating dependent. My CO asked me to provide them with my defacto's police clearance and medical check. I'm confused why they asked for this eventhough we dont have plan of migrating together soon. Our plan was to get him with a partner's visa once i get fully settled there. My questions are:

-will my partner be getting his visa too when i get a grant?
-why is my CO asking this?
-what if my defacto has a health issue that we do not know as of the moment, will it have a negative impact with my application?
-should i just delete him and just submit form 1022 to take him out of my application for easy evaluation of my application? or should i tell my CO to add him as secondary applicant or permanent visa with defacto visa?

Not sure about the same sex defacto but I read a lot of cases that they added their parents in their application as non migrating dependent and the CO asked the same thing. For parents case, if you put them as non migrating dependent, they will not get a visa so normally & ideally, applicant just exclude the parents in the non-migrating dependent section for easier processing. In my opinion, same case applies on your case.

@LittleFinger when my husband applied for PR, I was included in his application as non-migrating dependent. With that, I was asked to undergo medical check and to provide police clearance. The good thing was that I was able to use the medical check when I applied for partner visa ( same year ang pagapply ko meron lang 7 mos gap so kung nagmedical ako ng Feb, I lodged my partner visa ng Sep) I just quoted the reference number of the application of my husband so yun.

@LittleFinger Ang assumption ko kapag ang application is for Permanent Residence, definitely hihingan ng mga critical requirements, like Health and Police checks, yung Partner.. kahit sinabi pa initially nung main applicant na non-migrating yung Partner nya…

Parang to make sense kasi na mag-aapply yung Main Applicant to be an Immigrant pero iiwan mo naman nya yung Partner nya sa ibang bansa.. Definitely, sooner or later mag-aapply din yung Partner, unless they’re trying to go separate or parallel migration paths..

Assumption ko lang yun... don't believe me just yet hehehe

@LittleFinger they answered you already.. All their points are correct.

Now the decision is yours, to include your partner in the visa application as migrating, continue with non-migrating or totally remove from the application... Ask you CO kung pwde pa baguhin...

2. Hindi pa po nareregister sa Pinas ang kasal namin.
3. Umuwi po kami sa Pinas nung 2014 dahil nagkawork na po sya ng maayos dito. Sa madaling salita po, Single po ang status namin dito sa Pinas kasi nga po hindi registered ang kasal namin.
4. Ngayon po, naisip niya po mag-apply sa AU.
5. Ano po kaya ang magiging status ko, de facto po or Wife na talaga?
6. Ano po kaya ang pwedeng maging problema sa ganitong sitwasyon? Kasi ang records po namin sa Dubai eh Married, pero dito po sa Pinas eh Single.

+1 to @lock_code2004 pero I would play safe if I were in your position. If maaga pa naman sa application process e magregister na ako agad sa pinas, baka by the time na need mo na upload yung docs e ready na yung PH marriage cert.

Ang lagi namang tinatanong sa application sa Oz is "have you ever been married", so whether kung saan pa yan, as long as it is a "valid" marriage.. you can declare it for any application purposes...

just provide your marriage cert from dubai, your status should be married.

Question po. If the de facto is not claiming points for skilled 189, kailangan pa ba magsubmit ng Cert of Employment and ITR from his employers? Or yung main applicant lang?

Hindi na po kailangan. Yung main applicant lang. In my case, inupload na din namin yung Diploma and TOR ni partner, hindi din ito required pero may mga cases kasi dito sa forum na hiningi yun, kaya inupload ko nalang tutal may space pa naman yung sa amin. Hope this helps

Hope someone helps me yung defacto partner ko was invited for 189 visa, and it was lodged last Sep 14 (paid at 3600aud).

tanong ko lang po kasi nakapaglodge na siya ng application 189 visa and nabayaran na niya,eh ngayon lang namin nakita na pwede pala iinclude ako as defacto dependent. akala namen kasi un Partner Visa un only approach, eh pwede rin pala isama na ngayon palang. as of today, wala pa namang Case Officer assigned.

1. Nilagay pala niya is never married hindi de facto sa application..plan naming fill up yung form form 1022 to correct this information and additionally, form 1436 to add me as secondary applicant, ganito rin ba un ginawa nyo?

2. Magkano un visa fee mo para sa dependent partner mo? and panu babayaran ito, pede parin ba online or ndi na?

3. Medical Health and Police Clearance lang ba ung kailangan for me (same kami ng dependent mo na ndi natapos un college...)?lps me defacto partner ko was invited for 189 visa, and it was lodged last Sep 14 (paid at 3600aud).
