    Dapat po ideclare truthfully kung may defacto. Delikado ideclare na single ka kung may defacto ka pala. Kasi malalaman at malalaman rin ng DHA if may defacto ka or not. Single po is walang d or spouse.

    Ilan points ka nun nainvite? Anung evidence ang ma provide mo for that claiming of Australian study points?

    Department of Immigration policy advises that ” … because invitations are ranked and issued on the basis of the declared skills and attributes and nominated occupations included in the intending migrant’s EoI, and to preserve the integrity of the invitation process, applicants must demonstrate that the indicative score on which they were invited to apply is at least equal to their assessed score against points test factors. If the indicative score is less than the assessed score, (the) visa criteria cannot be satisfied.”

    In other words, if an applicant for a skilled visa claims points to which s/he is not entitled the application criteria are not met, and the visa application must be refused.

    Bali naclaim ko po 95pts. Pero dapat 90pts lang pala. Nilagay ko po sa study evidence ko before ang graduate certificate in nursing. Akala ko po pwede maclaim ang points. 😔

    @ZAC16 yes need to withdraw the application coz visa refusal can affect future visa application. Ambilis nga ng ITA mo then CO contact ka kagad, in need kasi ngayon ang healthcare professionals lalo onshore ka.. keep the faith!!! Stand up ulit and apply!!!

    Your SA nomination was approved based on the claims you made on your EOI. There was an invalid claim therefore it follows the nomination would be invalid as well.

    As a migration agent, the best advice to give you is not to proceed with the application. It will be refused. You can fix this by withdrawing your application. Visa refusal may have a negative impact on future visa applications.

    Hello po sa inyung lahat. I would like to ask regarding my situation ko po.

    I applied student visa and my boyfriend was declared de facto by my education agent. I was unaware that de facto relationship should have atleast 12 months live in relationship and I need to prove that in the event na gusto ko sia dito papuntahin in the future. I know it was my mistake because i was uninformed and hindi din po ako ng research. I just relied to my educ agent na nagsabi ok lg idefacto kahit boyfriend plg.
    I consulted with the Migration Agent and she advised me to submit Form 1023 to change my status to engaged instead. Now, I am a bit worried kasi baka it will look i am lying kasi naghahabol din po ako ng 10 points sana.

    I would like to ask advise po sana if anu mas mabuting gawin. Kasi I am a bit worried na if i will submit Form 1023 i will become unlawful non resident here in Au.

    Presently I am engaged and planning to get married at the end of this year. I have a sister permanently residing in Adelaide with her fam.

    So my fiance and I are planning to apply for VISA 189/190.
    I would like to know if I can still apply for chain migration even if I got married already.
    And if that would apply as well to my soon to be husband.
    And one more thing, paano namin malalaman kung ma-avail namin yung +10 partner points? Given our situation.

    Salamat ng marami sa sasagot. :)

    Be mindful that being engaged doesn’t mean you can include your fiancée to your visa application unless you have been living with him for at least 12 months and can prove co-dependence in 4 areas - domestic, financial, emotional and social.

    With regards to claiming 10 points, you both must be in a de facto relationship (or married), he needs to have a positive skills assessment (occupation must be in the same list as yours) and with competent English level.

    Be mindful that being engaged doesn’t mean you can include your fiancée to your visa application unless you have been living with him for at least 12 months and can prove co-dependence in 4 areas - domestic, financial, emotional and social.

    With regards to claiming 10 points, you both must be in a de facto relationship (or married), he needs to have a positive skills assessment (occupation must be in the same list as yours) and with competent English level.

    Chain migration is possible as long as your sponsor meets the requirements and you and your fiancé are married/in a de facto relationship.
